Bhatkal: Yasin's family to approach HC against NIA court judgement

Daijiworld Media Network - Bhatkal

Bhatkal, Dec 20: Mother of Ahmed Siddibapa alias Yasin Bhatkal, responding to his death sentence pronounced by the NIA court on Monday December 19, has said that the judgement would be challenged in the high court.

Speaking to reporters after the NIA court sentenced five Indian Mujahideen operatives to death in connection to the Hyderabad blasts, Yasin''s mother Bibi Rehana and sister Bibi Mariah alleged that the NIA court had ''already decided in advance'' to sentence Yasin to death. "He was subjected to mental torture by the judge during the trial. We have already filed a petition against the judge in this regard in the Hyderabad high court," they said.

"He (Yasin) was also threatened with capital punishement. All this (capital punishment) was decided much in advance. We will approach the high court against the NIA court''s judgement," they said.

Yasin''s brother Abdussamad told reporters, "If you read the chargesheet filed against my brother, you will see that it does not warrant capital punishment. We do not know on what basis the NIA court pronounced death for five persons. We have complete faith in God. We trust the high court and we are confident that it will deliver justice to us.

"Our entire family has been visiting my brother every month for the past three years. Each time, he has told us that he did not do anything wrong. He has time and again said that he was innocent and was being kept in jail for without any valid reason. He had also told us several times that he was being mentally harassed and threatened with capital punishment. That is exactly what has happened now.

"We are saddened by this judgement. We will approach the high court and even the Supreme Court. Let us wait and see what God''s will is," Abdussamad said.

The law should take its own course. BTW it is not proper for the family to say that the sentence was decided earlier. India has a roboust Judicial system. There was always an opportunity to Yasin to become approver and work towards helping the judiciary. The family members should have encouraged him to do that and returned to the right path. Yasin's chosen path is against the humanity. There is no better religion other than humanity. People whilst practicing their own religion shall practice humanity more often. Religion nowadays have divided mankind.

Its good to hear that the family is approaching the court on their own, rather than going thru some political party. If you remember Janardhana Poojari in a election campaign in April 2014 promised Kabirs family a CBI probe on his killing even if he lost the elections. I was there as well. What has he done now?

We have to accept the fact and move on. I think they should have reigned their son/bro first, before he turned himself into a Mujahedeen. Their other brother/son has fled and is hiding in Pakistan. Any comments on that. What about the families who lost their kith and kin in the blast organized by Yasin?

I want to ask yasin bhatkals brother and mother , ur son was involved for the murder of 18 innocent people by conducting bomb blast.
so as oer shariah , he should also be killed if convicted .

Why ur community is opposing the court verdict , since as per shariah he should be killed .

since ur followers of islam , and shariah law

As mother and sister they have right to move to higher court. Shariah rules and regulations does not hold good in India even if the accused is Muslim.
He might be an accused, but for a mother he is still a son, whom she carried for 9 months and taken care of him till he grew up.
They might be followers of Islam, but they are Indian nationals first. They have fundamental right to fight legally till supreme court gives final judgement! Let the 'law of soil' prevail at the end!!
