Mangaluru, Apr 12: Ahmed Bava, Fakir Ahmed and Syed Mohammed Naushad, who were earlier held guilty by the judge of the third additional district and sessions court here, were handed life imprisonment by the judge of the court, Pushpanjali Devi, on Wednesday April 12. They were arrested in 2008.
The judge, who had pronounced all the three guilty, had stated that the quantum of punishment would be decided on Wednesday. Three of the accused in the case are still at large.
Fakir Ahmed was out on bail at the time of pronouncing the judgement on April 10. He was then arrested and brought to the court on April 12.
The court had observed that the charges levelled against Syed Muhammed Naushad, Ahmed Bava Abubakker and Fakir Ahmed have been proved. They were among seven suspected terrorists arrested from Ullal in city outskirts on October 3, 2008. The other four, Mohammed Ali, Jawed Ali, Muhammed Rafique, and Shabbir Bhatkal, have been exonerated by the court.
The arrested accused had been charged by the city police of involvement with manufacture of explosives illegally and planning destructive activities. They were also charged with having links with the Indian Mujahideen.
All three convicts have been given imprisonment under Section 16(1)(B) of Unlawful Activities Prevention Act, and ordered to pay Rs 10,000 penalty. Failing to pay the penalty will attract one more year of rigorous imprisonment.
They have also been awarded life Imprisonment under Section 5(B) of Indian Explosive Substances Act, together with a fine of Rs 10,000, failure to pay which will result in another year of rigorous imprisonment, apart from life Imprisonment under Section 120 (B) of IPC, life Imprisonment under section 20(5)(1)(AA) of Arms Act and fine of Rs 10,000, and under Sections 17 and 18 of Unlawful Activities Prevention Act.
Syed Mohammed Naushad has been sentenced under Section 420 of the IPC to rigorous imprisonment of 7 years and fine of 5,000, rigourous imprisonment of 3 years and fine of 3,000 under Section of 468 of IPC, and 3 years of RI and Rs 3,000 fine under Section 471 of IPC.
