Triple talaq hearing begins - 5 judges of 5 religions on Supreme Court’s bench


New Delhi, May 11 (DC) : A five-judge Constitution Bench of the Supreme Court will hear from Thursday a batch of petitions challenging the constitutional validity of the practices of triple talaq, nikah halala (forms of divorce) and polygamy in Islam.

The bench, sitting in the summer vacation, comprises an interesting combination of CJI J.S. Khehar (Sikh), Justice Kurian Joseph (Christian), Justice Rohinton Nariman (Parsi), Justice Uday Lalit (Hindu) and Justice Abdul Nazeer (Muslim).

With Prime Minister Narendra Modi asking Muslims not to politicise the triple talaq issue, the Centre has maintained that these practices are not protected under the right to religion guaranteed under Article 25 (1) of the Constitution. It said the fundamental question for determination by this Court in this case is whether, in a secular democracy, religion can be a reason to deny equal status and dignity, available to Muslim women under the Constitution.

The All-India Muslim Personal Law Board on Friday justified in the Supreme Court the “triple talaq” form of divorce and cautioned the court from interference with personal laws in the guise of social reform and bringing in uniform civil code. The board said all three utterances of triple talaq are effective and validly terminate the marriage is accepted by all the four distinct schools of jurists, namely Hanafi, Shafai, Maliki, and Hanbali.

The board said that though pronouncement of triple talaq is considered to be a sin, it is still a valid and effective form of divorce. In Islamic jurisprudence, many times an irregular or improper nature of an act does not affect the legal consequences of the Act. Though Triple Talaq is the least appreciated form of terminating a marriage, yet is very much effective and in line with the Shariat law,” the board said. Asking the court not to interfere with freedom of religion, the board said the issues raised in the batch of petitions had already been decided by the court and hence the issues need not be re-opened again.

The Centre said it is of the view that gender equality and the dignity of women are non-negotiable, overarching constitutional values and can brook no compromise. The practices which are under challenge, namely, triple talaq, nikah halala and polygamy are practices which impact the social status and dignity of Muslim women and render them unequal and vulnerable qua men belonging to their own community; women belonging to other communities and also Muslim women outside India.

The Centre said there are unreasonable classifications which arise from practices such as those under challenge in the present petition, which deny to Muslim women the full enjoyment of fundamental rights guaranteed under the Constitution. The paradox is that Muslim women in India are more vulnerable in their social status because of the prevalence of such practices, even though they live in a secular country.It submitted that the practice of polygamy is a social practice rather than a religious one and therefore would not be protected under Article 25.

Issues to be adjudicated are: The court will determine among other things whether triple talaq violated basic human rights of Muslim women who are subjected to this religious practice; whether the practices of talaq, nikah halala and polygamy are protected under Article 25 (1) of the Constitution (right to freedom of religion); whether Article 25 (1) is subjected to Fundamental Rights of Indian Constitution and in particular 14 (right to equality) and 21 (right to life) of the Constitution; Whether the practices of triple talaq are of a secular nature, namely marriage and divorce, and thus not protected under Article 25(1) although they may be considered as a part of religion?

Whether this practices run counter to Constitutional Morality that guarantees equality before law and equal protection of laws?; Whether instantaneous triple-talaq in one sitting (talaq-e-bidat) in the absence of witnesses and without any attempt at reconciliation and nikah-halala are legally permissible?; Whether this practice has been abolished by various Islamic states, which establishes the fact that such practice is not integral to the practice of Islam?; Whether the All India Muslim Personal Law Board and similar associations have the authority to determine and declare the personal law applicable in India for the numerous sects and sub-communities of Islam that exist in India and practice Islam in various ways?

    Any law that causes suffering, inconvenience and hardships to an innocent human being should be abolished. During the much talked about Shah Bano case the Supreme Court advised the then Government to enact laws aimed at bringing about uniformity and equality in the society under the framework of the constitution. Unfortunately the Rajiv Gandhi Govt. didn’t give heed to the court’s advice solely for political reasons. PM Modi's bold decision in this direction is most welcome and highly appreciated.

    In UP all are scared of Yogi and hence Tripple Talak has stopped. I saw a video clipping, where a wife threatens the husband by responding as 'yogi yogi yogi' to Hubs tripple talak. and then the husband sheepishly says it was a 'Mazaak' joke.

    ..religion should not come in the way of fundamental human rights..polygamy,tripple talaq immensely effects women, its like hanging sword..Hindus had some tradition, i am glad over the year it was vanished..But before digging MODI marital status, you should check whats happening in Andhra/Telangan regions how girls married of to Gulf men and are dumped within 3 months of marriage..people from your own community fighting in the court against this menace..Former Union minister a congressmen Arif Mohammad Khan, very vocal on tripple talaq, he requested SC to treat act of triple talaq as contempt of court and invite prison term of at least three months until new law formed..actual Arif Mohd khan quit the Congress in 1986 over differences with the Congress government on the Shah Bano case, when Congress Govt reversed its stand fearing muslim vote bank..

    For the whole country of KSA:
    In 2014 there were 33,954 divorce cases.
    In 2015 with roughly 133,000 marriage contracts, there were roughly 40,000 divorces.
    This year (2016), there have been some 157,000 marriages and about 46,000 divorces meaning that almost thirty percent of couples end up in separating.

    According to Shari’a, men are allowed to practice polygamy and are permitted to have up to four wives at any given time. There is also no minimum age for marriage in the Kingdom.
    While most women wait until after high school or university to get married, girls in the Kingdom can get married from the age of 13 and some are even married before they begin puberty, according to Alhakami. Many parents marry off their children for financial purposes and some men and women are still forced into arranged marriages by their families.

    Why are you comparing divorce cases of a given year (say 2016) to marriages that took place in that same year (say 2016)?. Its is unrealistic way of comparison. The correct method of comparison should be “Divorces that took place in a given year (say 2016) and total married coupe as of that year (“UNTIL 2016”, not “IN 2016)( say total of all marriages that took place from year 1917,1918,1919………2010,2011,2012,2013,2014,2015,2016).

    Why do you want to go to KSA? Come to India- According to the 1961 census (the last census to record such data), polygamy was actually less prevalent among Indian Muslims (5.78%) than among several other religious groups. Incidence was highest among Adivasis (15.25%) and Buddhists (7.9%); Hindus (5.8%),
    Regarding early age marriages its quite common in many parts of India as well where girls are married off for financial reasons.

    Whatever the legal analyses may be but the rule book of almighty and the practices of prophets sunnah along with his companions tops over all man made law. Shariah must not be interfered by any regime or govt. Mr modi first of all take some concern about what actually the present position of yashodha ben and how zakia jafri provided with fair justice. After all media nonsense in triple talaq the records says that the percentage of talaq is very less in muslims community. Lets not forget that bilkis banoo has to wait fifteen years to get some half justice in serious case of communal gang rape where as the least significant triple talaq has got so fast attention by the same judges. Its look like that Legal guardinas also started to dance the tune of modi regime.

The example is Pune techie rape and murder case and Bilkis Banoo rape and murder of 14 members of her family.     God made man & woman 2 live together & what God has joined man should not break. women should not b used exclusively for physical appetite. man & woman both r good 2 live lovely together with children. divorcing breaks structure of da whole holy family. there should not have dowry & divorce among any faiths. presently divorce, talaq & dowry r practised in da m.e. no women likes divorces.

    Are you opposing riple Talaq or Talaq itself?

    If you are opposing Talaq itself for the reason of survival of the divorcee women, note that in Islam a woman is under protection from her Father, sons, brothers for her survival. She need not work for her survival. In case of anyone of the above are not alive then she can remarry. Also there is Zakath system (for poor people) in Islam which makes it Obligatory for a Muslim to pay 2.5% of the wealth excluding his basic needs.

    "And the women (after the pronouncement of the divorce) must wait for three monthly courses... and their husbands are fully entitled to take them back (as their wives) during this waiting period, if they desire reconciliation." (Al Baqarah 228)

    "Then, if the husband divorces his wife (for the third time), she shall not remain lawful for him after this divorce, unless she marries another husband..." (Al-Baqarah : 230)

    "When you marry the believing women, and then divorce them before you have touched them, they do not have to fulfill a waiting period, the completion of which you may demand of them." (Al-Ahzab : 49)

    "And if those of you who die, leave wives behind, the women should abstain (from marriage) for four months and ten days." (Al-Baqarah 234)
