New Delhi, Jul 18 (PTI): The Centre today made it clear there is no provision in the Constitution for a separate flag for any state and the tricolour is the only flag for India.

This comes after the Karnataka government initiated a move for a separate flag for the state with Chief Minister Siddaramaiah defending the step after it came under attack from rival parties.

"We are one nation, one flag. Legally there is no provision either for providing or prohibiting a separate flag for any state," a home ministry spokesperson said.

Home ministry officials said Karnataka already has a flag which represents only the "people and not the government".

That flag is not used in national ceremonies like Republic Day or Independence Day but on occasions like state foundation day, an official said.

But the use of that flag was also challenged in courts by some people and a decision on the matter is yet to be taken, the official, who wished not to be quoted, said.

A nine-member committee has been formed by Karnataka's Congress government and tasked with submitting a report on designing the separate flag for the state and providing a legal standing for it.

If the flag comes into being, Karnataka will be the second state to have its official flag after Jammu and Kashmir, which enjoys a special status under Article 370 of theConstitution.

 

Congress high command seeks clarification from CM Siddaramaiah

While the Karnataka government is being blamed for flaring up a separatist mindset by constituting a committee to design a separate state flag, the Congress high command has directed the Chief Minister to come up with a clarification.

This move is being seen as a political gambit by the Congress government ahead of assembly polls next year and the party seniors seem “unhappy” with the controversy and intend to end it.

"The Congress does not have a policy for a state having a separate flag. I have asked the government to clarify the issue. The country has only one flag and that is the national flag,” said AICC General Secretary in-charge K C Venugopal to Deccan Herald.

Even Rajya Sabha MP Renuka Chaudhury stressed that India should have only the national flag and is unable to understand why Karnataka government is keen to have a state flag.

The State government’s move to have a separate flag comes in the backdrop of rising public sentiments against BJP's Hindutva agenda and the Centre’s alleged move to impose Hindi on the Kannada-speaking people of the state.

Kannada writer and journalist Patil Puttappa and social worker Bheemappa Gundappa Gadada had made representations to the state government for a separate flag alleging that disrespect is shown to Karnataka by the Maharashtra Ekikaran Samiti, which has called for the Belagavi district to be integrated into Maharashtra.

Though Chief Minister Siddaramaiah has defended his government's move on the grounds that constitution does not bar states from having its own flag, it is interesting to note that the Congress had opposed a similar move when proposed by BJP.

In 2012, when BJP government was ruling in Karnataka, and proposed to make Karnataka’s unofficial red and yellow flag official, the Congress had moved to the High Court saying that separate flag would be “against the unity and integrity of the country.”

    Right, where flag is concerned I agree it should be "one nation one flag"
    But where states are concerned high time south indian states separate from central govt administration.
    South Indians are progressive, hardworking, less cheating, mostly of them pay taxes also let populated. North India is absoulute opposite people are lazy, dont want to work and are living on tax money of south. when farmers of North India got waiver of loansthough the tax money is of south, why south Indian farmers denied waiver of loans??
    High time the revenue of respective state is used for its own administration. Also, it is easy for people to keep a check on accountability. Only 5-10% revenue can be given to centre for common benefits like National security, aid during natural disasters, science and technology.
    High time this is implemented. Because north india is like a pot of hole how much ever you fill it is empty.

    To be an Indian first you have to respect the culture and values of your own state. Many states make a country. Moreover, there is no rule in the Constitution which says that a state cannot have a flag.

    When Maharashtrians, Tamilians, Keralites, Telanganites and people for the Hindi belt can display their love for their state then why cannot you people do the same?

    There is nothing wrong with states having their own flags IN ADDITION to the National Flags. USA, Germany, UK and even tiny Switzerland they have that. Only rule is that you can not hoist just the state flag. Both or only national flag should be there.

    It is odd for the Central Government to declare that India must have only one flag.

    Many states/provinces in other countries have their own flags.

    For example, every state in USA has its own flag.

    There is absolutely nothing wrong in having a state level flag. Of course, the question as to why do we really need one is really debatable.

    If the political parties in India and RSS can have their own flags, the declaration "one nation, one flag" sounds a bit hypocritical.

    Why we as a developing country need state flags when we have so many problems like farmers committing suicides,shortage of water and electricity ,problem in Jk due to Article 370 ,unemployment,cross border terrorism,and China showing its muscle power at the border. No doubt,Karnataka GDP is better than other states because of IT, that does not mean Karnataka should have better Identity than other parts of India. First we should become super power like US then compare with them in unproductive ,silly issues like having state flags.

    There is a lot in deffrences towards our state from centre , by hosting karnataka flag there is no dis respect to the national flag, karnataka flag is for only fighting kannada and karnataka unity issues, can centre impose hindi ban in tamil nadu?

    Unofficially, Karnataka flag do exist and what Siddhu wanys is to make it official.

    How having a state flag is against One Nation? If BJP can have its flag, RSS can have its own, Congress can have its own, Marxists too, then why not a State? Did Modi govt forget one of its promises during the Naga Accord that it will allow them to use their own flag? We already have Nada Geete. Has that made us less patriotic or has it threatened the unity of the Nation in any way. If national flag is the symbol of nation, state flag is the identity of the state. It's the States that make the nation and not the Nation that makes the States. Our country's identity and strength is diversity and having State flag is part of this diversity! National flag is always be the priority. State flag will never displace the national flag. Then why this fear? Is our country that weak that a state having its own flag can threaten its unity and diversity? Maharastra, Karnataka etc have already been using their unofficial flags for state programmes for years now. Have these states threatened the unity of our country in any way so far? Why those who speak of One Nation One Flag today were silent when BJP Belgaum MP Suresh Angadi protested against the state government holding the flag of Maharashtra in his hand? What were they doing when Maharashtra flag on hoisted on Belgaum Municipal Corporation premises? States having its own flag is not unconstitutional in any way. Yes, it is under the constitutional powers of a state. However, the manner in which the State flag is hoisted should not dishonor the national flag. It has to be always below the national flag. The national flag code specifically authorizes use of other flags subject to the regulation by the court. So State flag is not unauthorized.

    Read Article 1 of Indian Constitution - India is an "union of states" and not "union of political parties or associations". So states demanding a separate flag does matter; and any such flag will require a constitutional amendment.
    (I know that J&K has a separate flag and citizenships. J&K is a different kettle of fish due to Article 370 which is a gift from our chacha Nehru, though Ambedkar and Sardar Patel were totally opposed to that idea).
    Under our constitutional scheme, all citizens of India have one identity. The founding fathers of our constitution were very clear that there shall be no further sub-national identities based on religion / caste / language. Especially after the experience of dealing with the partition back then, they were absolutely right in rejecting any demands for recognition of any identity other than a national one.

    A separate flag for J&K is the least of the problem that is facing the that state. Please read some basic history of J&K accession to India, NC's political movement, Chacha Nehru's relation with Sheikh Abdullah, Article 370 and Pakistan's role in Kashmir. Four distinct wars with Pakistan could not solve the problem; and you think scrapping the flag is going to solve J&K's problem?

    Secondly, Karnataka cannot demand a separate flag under the constitution using J&K's analogy. Article 370 is absolutely unique to J&K and the result of that legalised exclusion is there for everyone to see.

    Under our constitution, a citizen residing anywhere from Kanyakumari to Amritsar or from Kandla to Kohima all enjoy the same fundamental rights and are subject to same national legislations (barring few exceptions in remote sparsely populated areas). However, there are many central legislations that do not apply to J&K as it needs to be approved by the State assembly. Article 370 was granted by chacha Nehru to Sheikh Abdullah in order to accommodate the Muslim majority character of J&K and retain their separate Kashmiri identity (whatever the ?#@! it means). It was just a matter of time before this long distance romance with J&K by rest of India sow the seeds of infidelity as the Shia Muslim dominated Kashmir valley began an illicit affair with Pakistan.

    And what does a separate flag for Karnataka mean? I can speak English, Hindi, Kannada, Tulu, Marathi, Guajarati, Bengali and Assamese. What is my linguistic identity according to your logic? Please remember that the states in India are an administrative units to discharge the basic constitutional obligations. The states do not constitute a sub-national identity to its residents. If that was the case then the whole of Rajasthan, Haryana, UP, Bihar, MP, Jharkhand and Chattisgarh would have been one state; and there would have been no need to bifurcate AP into Telengana.
