Bantwal: High court stays FIRs against Kalladka Prabhakar Bhat over provocative speeches

Bantwal, Aug 23: The state high court has granted interim stay against the permission granted by the state government to investigate Kalladka Prabhakar Bhat and also the hearings going on in subordinate courts against him. The court, which had earlier stayed trial in three cases, has now issued interim stay in another case registered against Bhat by the local police.

The single judge bench of the high court presided over by Justice Aravind Kumar passed this order on Tuesday August 22 after hearing arguments presented on behalf of Bhat. It also ordered service of notices to home department, Bantwal police, and complainants.

Placing his arguments, advocate for Bhat, Arun Shyam, contended that the cases registered against Bhat have no substance and that in his speeches he had not uttered anything that would have been provocative or given rise to communal clalshes. He argued that the government had acted against law in giving permission to register cases against him.

The police had received complaint that during the programmes in the town and Vittal, Bhat had delivered inflammatory speeches which would have whipped up communal passions among Hindus and Muslims. The complainant also had said that as a result, tense situation was created in the area as his addresses promoted hatred.

The government had permitted the concerned to investigate Bhat for offences under sections 153 A and 505 (2) of Indian Penal Code. Bhat had questioned this in the court, arguing that the government had given these permissions out of political enmity.

    When it comes Kalladka Prabhakar Bhat who makes his living on preaching hate the same High Court in Karnataka by single judge stays the FIR against him even the it was on Home Ministry records.
    The Single judge must answerable for the following points;
    1.Why the application of mind is not applicable in the case of Bhat?
    2. Is communal riots breaks out from such hate preach don't equate terrorist destruction?
    3.Do India has separate laws set for majority or minority when crime is same?
    It does seems political influence on the judges having preferential treatment delivering the verdict. It is time for judges to remind their oath they have taken. Apart from cinema house India should also make the singing of 'national anthem' compulsory in courts to remind the judges of their duties.
    I would also blame the ruling coastal Congress leaders for soft approach to Hindutva politics.

    Its high to boot out Ramanatha Rai. As per his election promises, Kalladka Bhat should be arrested. Now its not goin to happen. As long has communal minorities are fooled, Rais vote bank would be intact.

    There are many from various political parties who have made hate speeches.So do not target a particular person on political line.It is kiddish to point that tulu speeches should be translated for judges.They do not know that there are translaters in courts.I think they should file an appeal in court to act as translaters rather than making such comments.

    People,

    People are final judges....I think Daiji should display all Kalladka's speeches on its portal...so people will listen to them and decide if they are hate speeches or Nationalistic speeches...especially strong Kalladka supporter's like Joseph, Jossey and few more....

    Some of the speeches are in Tulu , perhaps High Court judges don't understand Tulu....may be baab Joseph could translate them into Kannada/English...

    Now it is clear that we have a very weak judicial system which has no eyes and ears. The whole world can watch 100% true news that shows video audio on what KPB speaks. There is no doubt that he speak with a purpose. There is no doubt that the purpose is to pollute the peaceful environment of the society which is living with peace and harmony. The motive is so dirty that many of the KPB included hurting religious sentiments where he even reached to the extent of why the women wearing hijab.
    The DC SP and all IPS and IAS cadre people of the district are responsible for these kind of court stays.

    ..one after another all cases falling flat..i wish K Bhat go to court against stopping fund from kollur temple to his school..definitely court will give positive judgement since its school & more importantly its a kannada school..Also it will seek details of schools which Mujrai temples fund..many Congis schools may come out..
