Jay Shah files criminal defamation case against 'The Wire'


Ahmedabad, Oct 9 (PTI): BJP chief Amit Shah's son Jay today filed a criminal defamation case in a metropolitan court here against news portal 'The Wire' over a report claiming his firm's turnover grew exponentially after the party came to power in 2014.

Additional Chief Metropolitan Magistrate S K Gadhvi ordered a court inquiry into the matter under CrPC section 302.

In his application, Shah prayed for, "criminal action against the respondents for defaming and tarnishing the reputation of the complainant through an article, which is scandalous, frivolous, misleading, derogatory, libelous and consisting of several defamatory statements."

The seven respondents in the case are the author of the article Rohini Singh, founding editors of the news portal Siddarth Varadarajan, Sidharth Bhatia and M K Venu, managing editor Monobina Gupta, public editor Pamela Philipose and the Foundation for Independent Journalism, the non-profit company that publishes 'The Wire'.

The case has been filed under IPC sections 500 (defamation), 109 (abetment), 39 (voluntarily cause grievous hurt) and 120 B (criminal conspiracy).

The Wire, in its report said that a company owned by Jay Shah saw a huge rise in its turnover after the BJP came to power in 2014. However, Jay Shah had rejected the charge, insisting the story was "false, derogatory and defamatory".

The court was of the opinion that it will issue summonses to the respondents only after the initial inquiry establishes a case.

The next hearing for a court inquiry will be on October 11 when two witnesses from Jay Shah's side who had first informed him about the publication of the article are likely to depose.

Shah is yet to file a civil defamation suit against the respondents. He had earlier announced that he will also file Rs 100 crore civil defamation suit.

A political storm has erupted after the article titled 'Golden touch of Jay Amit shah' was published. The Congress has demanded an inquiry into the matter, while the BJP called the article defamatory.

    Filing defamation case is like filing divorce case....it does not show filer in good light...it should be last course of action...

    I heard Gadkari has an army of lawyers who are ready to file defamation cases against anybody who talks against him....this has become BJPeee culture nowadays...with Subbu-Gadkari-Jhootley....what else we can expect...

    These people are omnipotent like God till 2019...they can manage courts as well...lets see what will be their position after 2019...in case they loose 2019 elections...

    Out of the Rs 80 crore revenue that his firm declared in 2015-16, Rs 51 crore has come from foreign investments. The most shocking aspect is that such a good profit-making company stopped its business the next year. Why would a person shut such a great business? It is surprising that soon after the company got a loan, this company shut its shop. Is there a possibility that Jay Shah indulged in money laundering?”

    How is it possible that a stock trading Jay’s Kusum Finserve company got a government tender to establish a power generation company. Is it not necessary for a company to have prior technical experience and skills to receive such contracts?

    The BJP fielded former power minister Piyush Goyal – under whom the power-ministry controlled IREDA gave away a loan of Rs 10.35 crore to Kusum Finserve to set up a windmill project controlled by the power ministry, to do the firefighting.

    The allotment of the contract points out the nepotistic practices in the Modi government as it directly relates to the influence Amit Shah wields in the party?

    It appears that with change of power, the fortunes of people associated with the ruling party also changes. Just like an arid land turns green in monsoons, Jay Amitbhai Shah’s fortunes have changed with the BJP coming to power.

    Whether Modi, in keeping with his image of a leader who had promised na khaoonga, na khaane doonga (Neither will I take bribes nor will I allow it), will order investigative agencies for a probe?

    With 100s of alleged paid tweets, nervous BJP throws its might already started defending Amit Shah’s son. Rohini Singh is an investigative reporter who worked at the Economic Times till recently. In 2011, she broke the story of Robert Vadra’s business dealings with DLF. She was much celebrated then by bhaktha's in social media now started comparing to 'supari journalism;'.
    This #AmitShahKiLoot need to be investigated if PM Modi is serious to make corruption free India.
