B'luru: HC seeks personal appearance of govt officers for withheld plan sanction

Bengaluru, Oct 26: The state high court (HC) has instructed Mangaluru assistant commissioner, tahsildar and Bilma gram panchayat development officer, to personally appear before the court on November 8 along with all relevant documents. This order was issued in connection with a petition filed by Hemanth Shetty, who wants to build a residential building in Bilma gram panchayat limits near Mangaluru. Allegedly, he has been made to run around for a year.

The complainant, Hemath Shetty, had questioned the action of the official in not issuing sanction for his building plan and the resolution adopted by the gram panchayat general session not to give sanction for his building plan. The single judge bench of the HC presided over by Justice Vineet Kothari, which heard the petition filed by Hemanth, passed the said order.

During the previous hearing, panchayat development officer of Bilma had filed objection, saying that the site granted to Hemanth's father in survey No 83 in the village had been cancelled in the past. Advocate for Hemanth Shetty, who raised objection to this statement on Thursday, said that the chief executive officer of Dakshina Kannada zilla panchayat had given him an endorsement saying that there are no records about the cancellation of the site allotment. He accused the PDO of filing fake documents in the HC and sought instructions to hold investigation into these things.

The HC, taking serious note of this issue, summoned assistant commissioner, tahsildar and Bilma panchayat development officer, to personally appear for the hearing on November 8.
