Want to meet my husband, says Hadiya


Salem (TN), Nov 29 (PTI): Freed by the Supreme Court from the custody of parents and directed to pursue her studies, Hadiya, who is at the centre of a love-jihad case, today said she desired to meet her husband Shafin Jahan.

She arrived here in a police vehicle from Coimbatore, about 170 km from here, amid tight security, to pursue her studies at a homeopathy college here. "I have sought permission from the college authorities to meet my husband. I hope they will allow," she told reporters at the college where she will undergo a 11-month internship.

During the proceedings yesterday, the apex court refused to allow Hadiya's plea to go with her husband. Earlier, she arrived here in a police vehicle from Coimbatore, about 170 km from here, amid tight security. Hadiya, wearing a yellow scarf, was whisked away to the Managing Director's office at the college soon after arrival.

Hadiya's body language appeared to be in contrast to her conduct during her departure from Kochi to New Delhi a few days ago when she shouted she was a Muslim and married on her own will. The woman quietly walked past the big contingent of waiting media persons and went straight to the MD's office accompanied by police and college officials. On her way to hostel, Hadiya said she does not need security at the college.

"It is not necessary, but at least for two days I think security will be there," she told reporters in reply to a question. A Police official said they would have to comply with the court's order and adequate security would be provided to her in the college and hostel. On the issue of allowing Hadiya to meet her husband, the official said it could not be done without any order from the court. Expressing solidarity with Hadiya, a small group of persons stood outside the college compound holding placards.

It read "Stop judicial terrorism, we stand with you Hadiya, Allow her to live with her husband." The Kerala High Court had on May 29 annulled the marriage of Hadiya with Jahan, terming it as an instance of 'love jihad', following which the man approached the apex court.

    Totally baffling and crazy. A 25 year old woman of sound mind and body cannot decide on whom she should marry, in the world's largest democracy. This is nothing by infringement of ones fundamental right. If the parents don't approve her marriage let them disown her, but why keep her imprisoned. I don't think the lady is brainwashed, but it is the parents who have been brainwashed by the fundamentalist right wing. Hadiya has made herself clear, very loudly and in the Supreme court, that she has converted and married out of her own free will and that she wants to be with here husband and no one has the right to deprive her of her rights.

    It'z a first step of her success. too Brave girl, In spite of harassment , torture, brain washing by her parents last 6 months when she was kept in her home . she didn't change a bit. stuck to her words, religion.

    You must be a fake believer of your own faith. Her pure IMAAN is Hinduism, gentleman, she got converted to Islam. There is no doubt that she will convert to some other religion if she finds that one right.

    If it was in her husband's hands, her studies would have been a total 'bye-bye' - its the courts that she could ask to study further and her wish granted. Because the court knows that if she will be abandoned tomorrow from both parties, at-least her profession would held her to earn her bread. India doesn't need more jobless citizens at the excuse of inter-faith marriages.

    I said 'change' because her parents only 'harassed' her and she is alive to change if she wishes.

    If she was in the other party the parents would have lynched her for family honor because marrying without the consent of father isn't valid there. Then, how is it valid when a girl comes from other faiths and a man can marry her without taking her parents' approval ?

    I am sorry Jennifer. I have to disagree with you on this. Every matured individual has the right to chose religion of her faith. Yes, it hurts parents when their children change their religion. However, if the girl feels she is happy by doing so, parents have to compromise for the sake of their children's happiness. No one knows which religion is true religion. But, everyone knows that Creator is one.

    Peter, you are right, as an adult, one has the freedom to chose his/her faith, partner in marriage, bla bla bla but its all for others. For a certain community, there is a specific rule of the thumb that a girl must marry after/as per her father's wish/permission, else the marriage is invalid. However, it takes 360 degree opposite when it is applicable to cases where girls coming in. In such cases the girls get lynched for family honor but Hadiya's parents are humane enough to keep her alive.

    And the courts are understanding enough about how important education is for an individual for survival if she is thrown out by both parties at a later stage.

    From the SC judgment one can also understand she is under threat or pressure from either side and from her body language they have come to the conclusion that what she said in court was out of fear. That’s why the court directed her to continue her studies under the guardianship of the head of the institution and fixed another hearing in January.

    Just FYI
    Muslim woman must have a consent from her guardian ( Wali) for marriage. That can be her father, brother, uncle, grandfather. If nobody is with her a religious head can be nominated as Wali.

    The wali does not have the right to prevent a woman from marrying on the basis of his own whims and with no valid reason ( without proofs )

    A woman can not be forced to marry with anyone without her consent.

    Enlightened by what you have put here, may I ask you, any of you who are supporting Hadiya's marriage to the man (with a supposedly guardian) - is OK with you all if any adult female member of your family goes with a guardian and marries a man of her choice ? Well, the religion can be same or different - you have no choice over it.

    ..Parents filed the case against Boy for forcible converting, brain washing & they allege daughter had a plan to go to Syria..they are not approving their marriage..they said in court..but its not in the case of Zaheer/Naqvi..so where is the comparison..in Kerala, every parent should be alarmed..as parents of a daughter they have reason to concern..just check how many from kerala left and how many took their wife & kids to syria/Afghanistan..you cant put everything under carpet saying LJ propoganda..in UK, a Asian gang of more than 60 caught under secret survelience..they are targeting white girls, grooming & using as slaves..its real , reports out there check..

    What Supreme Court did is just transfer of her custody from parents to an institution. She is still not free. It is just a transfer of confinement of an independent citizen. The issue at hand was her right to convert and to marry whomever she wanted as an adult but, curiously, this fundamental right was overlooked in this case. Amazing that the SC did not set the brave 25-year-old Hadiya free to live with whoever and wherever and appointed college Dean as her guardian. From day one, Hadiya had been clear about the fact that her conversion and marriage were both consensual. She was kept in custody to suppress her own voice and intent and pressurise her to give up.

    During the open court hearing on Monday, when the Chief Justice of India Dipak Misra had asked her if she wanted to continue her studies at state’s expense, Hadiya had replied: “I want to but not on state’s expenses when my husband can take care of me.”
    When she was asked to name any guardian in Tamil Nadu, she had said her husband Shafin Jahan would be her guardian. But Justice DY Chandrachud rejected this suggestion saying husband cannot be guardian of wife. The judge’s views have surprised Hamid.
    “It’s very strange that Hon’ble judges of the Supreme Court have questioned the guardianship of married women. If the husband is not the guardian of wife then who would be?
    How does Chief Justice Dipak Misra came to conclusion that Hadiya wanted to pursue her study only in Salem and being adult her guardian has need to be Dean of the college?
    Do High Court has the right annul the marriage of two adults on the basis of 'Love Jihad'?

    CJI is the same person who has passed the 'national anthem' verdict in cinema hall. He has handled the Cauvery tribunal dispute in favour of Tamil Nadu whenever Karnataka contested. He is close to PM Modi who handled fake encounter case and Godhra riots case.

    Now Salem’s college principal issues crazy diktat, he won’t allow Hadiya to meet anyone other than parents.

    ..when her parents lost custody battle, then she should be allowed to be with her husband..good or bad, its her fate..but one thing is sure, even if he planned to go to SYRIA, now its difficult due to SC/Media attention..now she is well protected..by the way, Court has already failed parents of Nimisha(Hindu), a dentist who converted became Fatima left to Afghnaistan with husband.. Merlin, a Christian IBM employee converted left to Afghanistan with husband, Sonia, a christian an engineering graduate converted had small baby left to Afghanistan..are they not matured, didn't they highly educated..then why courts can't see plot, why they fail parents/society just going by books!!..some time Courts has to move beyond books/constitution for better of society..

    Jossey, the SC of India has not over ruled Kerala HC verdict. SC has only directed her to continue her studies. Those who think that this is over, picture abhi baki hai mere dost.

    In the meantime, Kerala Police has submitted a nail biting evidence report to SC, HC and NIA. If possible, read that too
