Special CBI court acquits all accused including A Raja and Kanimozhi in 2G case


New Delhi, Dec 21 (PTI): A special CBI court on Thursday acquitted all the accused including former Telecom Minister A Raja and DMK chief M Karunanidhi's daughter Kanimozhi in the multi-crore 2G spectrum allocations cases. Fifteen other accused in the case and three companies were also acquitted.

Others acquitted in the case are former telecom secretary Siddharth Behura, Raja's erstwhile private secretary R K Chandolia, Swan Telecom promoters Shahid Usman Balwa and Vinod Goenka, Unitech Ltd MD Sanjay Chandra and three top executives of Reliance Anil Dhirubhai Ambani Group (RADAG) -- Gautam Doshi, Surendra Pipara and Hari Nair.

Directors of Kusegaon Fruits and Vegetables Pvt Ltd Asif Balwa and Rajiv Agarwal, Kalaignar TV director Sharad Kumar and Bollywood producer Karim Morani are also acquitted in the case.

Besides them, three telecom firms -- Swan Telecom Pvt Ltd (STPL), Reliance Telecom Ltd and Unitech Wireless (Tamil Nadu) Ltd -- were also accused and acquitted in the case.

Special CBI Judge O P Saini pronounced the judgement in the 2G scam which had rocked the UPA government.

In its charge sheet filed in April 2011 against Raja and others, the CBI had alleged that there was a loss of Rs 30,984 crore to the exchequer in allocation of 122 licences for 2G spectrum which were scrapped by the Supreme Court on February 2, 2012.

All the accused facing trial in these cases had denied allegations levelled against them by the CBI and the ED.

The court's verdict came more than eight years after the CBI filed an FIR against "unknown persons" and began its investigations following a recommendation by the Central Vigilance Commission.

    Shetre the case was not of 'fake licenses' at all but about a process that was in place. If it's merely fake licenses, auctioning does not give guarantee that fake companies cannot bid or the comapnies which beed aren't funded by 'fake entities'. Vinod Rai said that instead of 'first-come-first-serve' basis, if 'auctioning' was in place, government would have got more money. Very true! Govt would get money from the bidder but how this bidder will reover this money once he wins the bid? Natuarally he will pass this cost to the customer. That's why there's a logic behind not auctinong scarce resources because end customer will be the loser in terms of costs.

    Rai's cardinal error lies elsewhere. The upfront cost of spectrum has an inverse relationship with telecom spread. But the higher the spread, the faster, GDP growth and tax collections. The CAG had the obligation to look at the gain to the exchequer from faster GDP growth and computerised tax networks enabled by cheap spectrum, when he estimated the loss from not auctioning off spectrum. This gain is far higher than the revenue forgone by not making spectrum sale a source of revenue.

    Technology has made dedicated spectrum for each operator obsolete. Operators should dip into a common pool of spectrum, and all spectrum charges should be on a pay-as-you-go basis, not upfront. These are economic gains, not the stuff of accountants. Accountants should stay just accountants. Not claim to be wizards of policy or conscience-keeping.

    you are 100% right Mr. Kulal. I am sure that the same logic will also be applied in the fictitious coal scam. Most of the allocation of coal fields were done at the recommendations of Chief Ministers from Orissa, MP, Bihar, Jharkhand and Chattisgarh..............But the UPA was left to carry the blame. If Coal fields are auctioned at rates perceived by the CAG then our electricity and power bills will go up 20 fold or even more. Ignorant people don't seem to understand this.

    A well-hatched plan by BJP in connivance with CAG chief Vinod Rai, activist Anna Hazare and media has fallen flat. But only after BJP, Vinod Rai and Anna Hazare reaped full fruits of it. 2G was never a scam. There were no kickbacks, no bribery, no favouritism, no exchange of money etc. It was pure assumption which was rooted from Anna Hazare and Vinod Rai's hunger for publicity, and BJP hunger for power. Auctioning of scarce resources is a bad idea because the customers will bear the brunt. True, the government will get profit but the companies which brought Spectrum by bidding highest will pass on this cost to the customers at the end. Further look at the financial status of our telecom companies today. All of them are in huge loans. The auctioning money was entirely taken in loans by these companies and recent report from the Reserve bank has proved that telecom companies are struggling to cope with huge loans. Who is to be blamed? Publicity hungry activists and power hungry leaders? CWG was a scam because there were kickbacks and favouritism. But 2G was never because government's so called loss as told by Vinod Rai was only 'assumption'. There was a policy in place for many years and same policy was continued. It's not the job of CAG or Courts to involve in policy-making. CAG is an accountant and should remain an accountant and should not try to be a policy wizard. Similar should be the case with the Courts. It's not Judiciary's job to interfere or dictate in the policy making. It's the job of the Legislature. Just as Legislature should not interfere in the works of Judiciary, even the Judiciary should not interfere in Legislature's work. Otherwise these kinds of historic blunders occur.

    Congress should know that Mr yediyurappa was exonerated by courts in the various cases filed against him. DId Siddu & CONgress apologise when courts exonerated Yediyurappa?. Siddu also benefited largely on account of alleged scams. If the readers want Modi to apologise, then yediyurappa also deserves apology for denotification & minin g scams.

    The Honble SC has already decreed that the allocation of spectrum was conducted in an arbitrary manner and was exploitation of natural resources of the country.To this effect SC cancelled 122 licences.While this verdict of the CBI court has said that the prosecution failed to prove criminality and that CBI botched the investigation.Hence there is no doubt that there was in fact a scam but it was not proved beyond reasonable doubt which is the standard of proof in criminal cases.
