Triple talaq bill unacceptable if against Quran : AIMWPLB


Lucknow, Dec 27 (PTI): A day ahead of the tabling of the triple talaq bill in Parliament, some Muslim women's organisations said on Wednesday that the proposed legislation would not be acceptable if not in consonance with the Quran or the Constitution.

"Nikaah (marriage) is a contract. Whosoever breaks it should be punished. However, if it (Bill) is not in the light of Quran and the Constitution, no Muslim woman will accept it," All India Muslim Women Personal Law board (AIMWPLB) chairperson Shaista Amber said.

"I had sent a letter to the Law Commission requesting it to show the draft bill to the All India Muslim Personal Law Board (AIMPLB), AIMWPLB, Jamait Islami, Jamiat Ulma-e-Hind and organisations working for women who were given talaq. I got a reply that if needed, it will be discussed but that did not happen," she added.

Holding the AIMPLB responsible for the present state of affairs, Shaista said the board never bothered to take triple talaq seriously, and now it was too late.

Muslim Women League's president Naish Hasan said that in the Family Court Act there is always a chance to save a family but the proposed bill does not give such a chance.

"Third party has also been given the right to complain in the bill. That is not fair," she said.

Naish added that the bill should be stalled for now and discussions should be held as a law in haste will complicate matters. We will protest if the bill is passed without any discussion, she said.

Demanding withdrawal of the bill, the AIMPLB had earlier said the proposed legislation was against the provisions of the Constitution and violated the rights of women.

Describing it a "conspiracy", the AIMPLB at its meeting here on Sunday had accused the government of snatching the right of divorce from men.

AIMPLB chairman Maulana Rabe Hasani Nadwi will request Prime Minister Narendra Modi to withhold or withdraw the proposed bill that criminalises the practice of instant divorce, an official spokesperson of the Muslim body said.

In August, the Supreme Court by a majority of 3:2 ruled that the practice of divorce through triple talaq among Muslims is "void", "illegal" and "unconstitutional".

The government then drafted the 'Muslim Women Protection of Rights on Marriage Bill', according to which giving instant divorce will be illegal and void and will attract a jail term of three years for the husband.

The bill seeks to criminalise the practice of instant divorce by repeated the word talaq thrice.

    Quran is not higher than Constitution of India everyone require to have common law. If state of Goa has a common law why not rest of India.

    Triple talaq was just allowed in the time of HAZRAT UMAR QALEE FAs rule and punished by then the authority but validated the divorce.Here the supreme Court invalidated it and how can somebody be punished where the civil contractual offence not took place. This bill will be missused same like dowry act where the family will be destructed . Shariah cannot be rewrtten at any cost by any disbelievers who unable to understand Arabic hadees and it's context. MODI SAAB YASHODHA BEN KO AAP INSAAF DHILAAYIYE.

    Triple Talaq is not allowed in Egypt, Turkey and majority of real Islamic countries. Now, who are these saying they are ' more' Muslims that these Islamic country one . In fact in 1947 there was a country created especially for those who want to live by the holy book, so those opposed to Indian laws should migrate to Pakistan. It is hilarious that the same people dont mind living in USA ,UK, Europe under uniform civil and criminal laws.

    Triple Talaq is NOT banned in any of the Islamic countries. Its INSTANT triple Talaq, which is banned.

    The Quran gives equal right to both husband and wife to seek divorce. There are a number of verses in the Quran that call for attempts to reconcile in the case of marital discord. There is a verse calling for mediators, from families of both sides, if reconciliation between husband and wife is not working out. The verses clearly call for reconciliation and mediation process to be carried out over a period of 90 days. Allah has ordered the man or the husband to carry out this process. Divorce can happen at the end of this time period if the process does not lead to any reconciliation.
    The above system is not banned in any of the muslim country. I DO NOT THINK, there is a better way than this for separation. Government must involve AIMPLB in drafting the law , so that it will not contradict with the sheria law.

    Why these ladies need a law as per Quran?
    Tomorrow everyone will start asking some laws based on Bhagavadgitha and Bible!!

    Let the government seriously think of implementing Common Civil Code. Christians and Hindus might not have problem with that, but whoever has problems, can look for options for shelter!!

    Dont worry guys.
    Your views is not important anymore.
    You guys initially said triple talaq was part of quran .
    and when supreme court deemed it illegal, you guys change your tune.
    Its not going to work anymore.
