Muslim women hail triple talaq bill, seek ban on polygamy


New Delhi, Dec 29 (PTI): A day after the Lok Sabha passed the contentious bill on instant triple talaq, the development was hailed by several Muslim women involved in judicial war against the practice, with a rider that the government should have also banned polygamy.

The women, including those who waged the war against the archaic practice in the Supreme Court, said with the passing of the Muslim Women (Protection of Rights on Marriage) Bill in the lower House, "a new beginning has been made" and it will prove to be a deterrent for the husbands from saying talaq-e-biddat to their wives.

They said the new law should have also banned the practice of polygamy among Muslim men which, they said, was "more worse than triple talaq."

The women, advocate Farah Faiz, Rizwana, Razia, who were associated in the fight against triple talaq and polygamy in the apex court, expressed satisfaction that at least "a start" has been made by the present NDA dispensation.

The same opportunity had come in 1985 when the Shah Bano case happened, but was lost by the then Central government, they claimed.

"A new beginning has been made which would protect Muslim women from immoral practice of nikah halala," said Faiz, whose view was shared by Rizwana and Razia with a slight variance.

'Nikah halala' is a practice intended to curb incidence of divorce. Under this, a man cannot remarry his former wife without her having to go through the process of marrying someone else, consummating it, getting divorced, observing the separation period called 'Iddat' and then coming back to him.

Rizwana and Razia were of the view that the government should have dealt with the issue of polygamy by banning it in the same bill.

"I welcome the move but now men will take undue advantage of the law and indulge in polygamy openly as it is still in practice. With polygamy still in practice, abolition of triple talaq cannot alone not help us," said 33-year-old Rizwana, a victim of polygamy.

Razia (24), whose husband divorced her over phone citing birth of daughters as the reason behind it, hailed the law brought by government and hoped that women like her would get justice.

Married at the age of 16, Razia said, "I was given triple talaq by my husband on phone as he did not want to bring up our two daughters. Triple talaq is a crime and has spoilt many lives. I pray that all women like me get justice with this new law. However, I wish that the practice of polygamy is also banned."

Advocate Chandra Rajan who had represented All India Muslim Women Personal Law Board (AIMWPLB) also hailed bringing of the legislation and said it would go a long way in history.

"If this new law is implemented in true spirit then it will go a long way and prove to be a deterrent for the husbands from saying 'talaq-e-biddat' to their wives," she said.

Rajan said the AIMWPLB has, from the very beginning, demanded that there should be a law which should hold the practice of instant triple talaq null and void and impose punishment on husbands practicing it.

"We are disappointed only on one count that Sharia was not defined by the government in the law. As long as Sharia is not defined, confusion and misuse of such practices will prevail," she said, adding to this extent, it can be said that the government brought this law in a haste.

"The best thing the law proposes is that custody of minor child will be given to the mother. This happened with Shah Bano who was the victim of triple talaq and one of the petitioners in the Supreme Court," Rajan said.

She, however, questioned the mention of All India Muslim Personal Law Board (AIMPLB) in the law and said that it is an NGO and by mentioning their name it is like giving them a sanctity.

Faiz also shared the view of Rizwana and Razia that the government could have also brought a law making the unethical practice of polygamy null and void and protected lakhs of Muslim women.

"At least this government has done something and a new beginning has been made. Amendments keep on happening in the law but the start has been made," she said.

Faiz who fiercely argued against the practice of talaq- e-biddat (triple talaq) said the government should have enhanced the imprisonment term from three to seven years and made it a sessions court triable offence.

"Misguided husband, who were till now able to go scot-free after pronouncing triple talaq to wife, will now be deterred from the practice.

"No one will listen to Maulanas and misuse the practice which has been made null and void by the Supreme Court as police can lodge the case and initiate criminal trial against him," she said.

Rizwana, a Railway employee who had approached the apex court for abolishing the practice of polygamy, said, "With polygamy still in practice, abolition of triple talaq cannot alone help us."

    The real animals are those who support and validate non licenced relationship or live in relationships where the mates used like use n throw condoms. The real animals are those who validated same sex relationships including marriage. ISLAM never craeted a family without address proof in society because all are licenced handling.     With regard to the permissibility of multiple spouses for men and its prohibition for women, there are several issues which are obvious to every intelligent person. Allaah has made woman like a vessel, but man is not like that. If a woman becomes pregnant (when she has had intercourse with a number of men at one time), the father can never be known. People’s lines of descent and lineage will be mixed up, families will be destroyed and children will be lost. Women will be burdened with so many children that they will be unable to bring them up and spend on their maintenance. Maybe women would find themselves forced to sterilize themselves, which would lead to the extinction of the human race. Moreover it is medically proven now that one of the major causes of the serious diseases which have become widespread, such as AIDS etc., is women having intercourse with more than one man, and the mixing of seminal fluids in the woman’s womb causes these lethal diseases. Hence Allaah has prescribed a waiting period (‘iddah) for a woman who has been divorced or whose husband has died, until enough time has passed for her womb and passages to be cleansed of any traces of her former husband, and the monthly period also has a role to play in this matter. Perhaps these brief pointers will dispense with the need for a lengthy discussion. If the purpose of the question is research for a university or other assignment, he may refer to the books which have been written on the topic of plural marriage (polygyny) and the wisdom behind it. And Allaah is the Source of strength.

    Do you know there is one other type of religion you follow that you keep your girls shut between four walls but you men grab every woman available from other religions ?

    Take the example for Belthangady where married (with one year old child) man caught in the forest with a girl of other community ? When you can't stop such religious practice, let women take the law at their side and seek protection. In other words, if you men don't err, your women will not take legal assistance. They had to resort to this because, you as their protectors, took every advantage of them but they had nobody to help them.

    "Polygamy" The biggest evil of this world must be stopped by LAW. Its not only applicable to ISLAM. Any Men or Women having illegal relationship must be labelled as polygamy or any other name. Muslims are doing this as per their Shariah Law. Others engaged in this illegally in all religions as well as in communist countries. Because of this how many families destroyed all over the world. Any men or women involved in this must be severely punished at their own cost and not at tax payers money. Their "Charbi" will come down quickly.

    Muslim men can marry maximum four as prescribed in Quran which our constitution also upholds under personal law. If any muslim says that the verses of Quran be amended then it's an act of kufr or they can be called as kaafir. The Muslims are not bothered about polygamy but never allow any force to rewrite the shariah.

    Anticipating Muslim women's support to the bill, Mamata Banergee of TMC who opposed the proposal earlier walked out but didn't oppose the bill. Shrewd politics. Sharp division came within the community !!

    A social reform cannot be made with such human laws. We have dowry law, child marriage law, so such practices stopped??? No way, social reform cannot be changed with any such human laws but only through divine law and proper education.

    By the way these ladies asking banning poligamy should shun Islam and practice other Religion of their choice if they feel Islam is hard to follow. These nuts cannot ask to change shariah just for their sake. If again any political party or Court tries to interefer again on Shariah then surely there will b strong protest by Muslims across the country and there are many who are ready to give their life to protect shariah. So better for these ladies who are demanding to shun Islam and practice religion of their choice.

    First time in 70 years Muslim women got trust in a National govt. which really protect Muslim women by implementing triple talaq bill. Now onwards you will follow Indian law by filing a divorce in the court of law and not over the ‘phone’. Remember you are in India, and you follow Indian law not Sharia Law. If you want to follow your religious law we told you to go to Pakistan in 1947. Now also you can go we are most happy.

    If it is in your capacity, try to stop men like the conductor (a married man) in Belthangady whom people (group members) caught cosying up with a woman of another community in the forest area.

    You need to know that the world, and especially women in your own community, have come to understand that all what you men do too as is not completely according to Shaharia.

    DIVORCE SHOULD BE GIVEN ONLY IN CASE OF:

    1) INSANE MAN OR WOMAN.
    2) MENTALLY OFF MAN AND WOMAN.
    3) IMPOTENTS.
    MARRIAGE IS NOT A CONTRACT TO WRITE AND GIVE TO THE WOMAN YOU HAVE BEEN GIVEN SO AND SO AND ONCE SHE IS NOT SATISFYING THROW HER OUT.

    WOMEN IS NOT A MATERIAL.

    I CATEGORICALLY URGE TO BAN BOTH POLYGAMY AND DOWRY.
