Can't disclose exam records of 1978, when Modi graduated: DU to Delhi HC

New Delhi, Mar 1 (PTI): The Delhi University (DU) on Wednesday submitted before the Delhi High Court that the varsity's BA exam records of all its students of 1978 is held in a fiduciary capacity and cannot be disclosed under Right to Information (RTI).

The submission has been made by the DU in an affidavit which the court has not taken on record as it had earlier closed the varsity's right to file further replies in the matter.

The affidavit was filed by the varsity in its plea challenging a Central Information Commission (CIC) direction to allow inspection of the university's records of all students who had passed BA examination in 1978.

The CIC had directed the DU to allow inspection of records related to all the students who had passed BA degree in 1978, the year in which, according to the University, Prime Minister Narendra Modi had also cleared the examination.

The CIC had rejected the contention of the Central Public Information Officer of the University that it was a third party personal information, saying it finds "neither merit, nor legality" in it.

The court had on January 23, 2017 put on hold the operation of the CIC order.

During the hearing on Wednesday, Justice Rajiv Shakdher said DU will have to first seek recall of the court's earlier order closing its right to file a reply and thereafter, its submission may be taken on record.

The court also sought DU's response on an application filed by persons, claiming to be experts in relation to the RTI Act, seeking to be a part of the proceedings.

With the direction, the court listed the matter for further hearing on May 22.

Additional Solicitor General Tushar Mehta, appearing for DU, opposed the plea of the RTI activists seeking to be part of the matter, saying they have "vested interests".

In the affidavit filed through central government standing counsel Arun Bhardwaj, DU has said that the result of a student once declared is accessible only to that student and is "personal" to her or him.

The varsity has also said that disclosure of exam results of all the students could lead to "public embarrassment" of some or may cause "disturbance" of his/her routine life.

It has also said that a separate mechanism available for other institutions which want to verify the results or degrees of a student who has passed out from DU.

SMR. Karkala, you wrote "Caesar himself is under suspicion". What a shameful situation for a PM of a largest democracy ? In the last 70 years, from Nehru to MMS, nobody doubted about the education of any PM. Every University gets inquiries daily in hundreds of the students' degrees, and they promptly reply. Here, Additional Solicitor General had to involve in such a situation. In his Education, there is controversy, in his marriage, there is controversy, in his involvement in Gujarath massacre, there is still doubt in the minds of people irrespective of verdict, his every Bashan is full of fekugiri. He had successfully completed his Post Graduation in the Major subject of "Bharatiya Juumla Pariksha" not in DU but in NU (Nagpur university ) in the year 2014!!! Where as if you search his records in DU, you will get GARAM GARAM PAKODA & KARAK MITA CHAI only !!!!!

For any institute, it is a matter of pride to share that famous personalities have been affiliated with them. This helps the institute gain publicity and improve their image, and thereby help attract better students to strengthen the institution's present and future. This is why Punjab university never grows tired of flaunting its association with former PM Manmohan Singh.
Now when nothing from the date of birth to the name to the year of the course is in order, one can't help but feel there is something fishy regarding the whole claim. A prima facie case has been established and the onus now rests on PM Modi to restore the nation's confidence in his credibility. It won't suffice to shoot the messenger and make light of the alleged crime. A fraud is a fraud. The question is not of how educated or not our PM is. The question is whether the nation deserves to be in the know of its PM's educational attainment. Should India be cheated when it comes to such information?
If the PM can cheat and trick when it comes to his degree, can we guarantee that he won't cheat or commit fraud in other matters? The trust and credibility of the most important public office of the world's largest democracy is sacrosanct. So it's essential that the cloud over Modi's degree is cleared either way, sooner than later.
Also, we can't just wait for him to come out clean. The fourth pillar of democracy - Indian media - deserves to do its job of scrutinising the matter with more vigour and courage than it has displayed so far.
It is inexplicable why the media has not undertaken an independent investigation into the whole affair. Its silence makes one fear that the worst may be true.
It's said Caeser's wife should be above suspicion, but here Caesar himself is under suspicion.

It is advisable for all the multinational companies who employed Delhi University graduates in India and abroad to verify their degrees in the wake of Prime Minister degree row.

Height of irony is, this man is giving advice to students on 'Pariksha pe charcha' . A theme like 'Certificate bagar pariksha' would be more appropriate and more aspiring for the aspiring bhakths and feku admirers. Denial to information is truimp card he's holding, used it while cornered on Rafale deal on the pretext of National security and now on fake affidavit.

Why else an university withholds records of students passed out from the institutions on a particular year ?
