After PNB fraud, RBI bans use of Letter of Undertakings for overseas credit


Mumbai, Mar 13 (PTI): In a major decision, the Reserve Bank of India (RBI) on Tuesday banned banks from issuing Letters of Undertaking (LoUs) -- instruments used allegedly by diamantaire Nirav Modi and his uncle Mehul Choksi to defraud state-owned PNB of Rs nearly 13,000 crore in connivance of bank officials.

The RBI said the decision to discontinue the practice of LoUs and Letters of Comfort (LoCs) for trade finance comes into force with immediate effect.

"On a review of the extant guidelines, it has been decided to discontinue the practice of issuance of LoUs/ LoCs for Trade Credits for imports into India by AD Category–I banks with immediate effect," the central bank said in a notification.

Punjab National Bank (PNB) reported fraudulent issuance of LoUs/ Foreign Letters of Credit for payment of import bills and fraudulent transactions in accounts, amounting to Rs 12,967.86 crore, to the RBI through its fraud monitoring reporting system.

A multi-agency probe, including by Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) has been launched into the PNB fraud.

The RBI notification further said that Letters of Credit and Bank Guarantees for trade credits for imports into India may continue to be issued subject to compliance with the provisions.

    Modi government have been constantly blaming their own failures on the UPA/Congress in the last 4 years. Perhaps they think that people voted them to power to blame Congress party rather than govern. So let people vote Modi government for another term so that they can fail and continue blame UPA/Congress for another 5 years.

    Didn't Kurta-Pyjama FM take 4 years to realize it ? Why he didn't do it before Nirav fled ?

    Why not at-least since 2016 after the government was informed about it ? What was his gain if Lungi-FM had gains ?

    India's RBI Governor Urjit Patel missing. He has stop speaking since PM Modi's last 'Demonetisation' and some report says he is 'camotised' counting old note.

    If anyone seen him last please inform BJP's Rajya Sabha member Subramanian Swamy or senior finance ministry official whom billionaire jeweller Nirav Modi and his uncle Mehul Choksi allegedly gifted gold worth Rs 1 crore on Diwali last year.
    Ban on Letter of Undertakings is understood from RBI. How will RBI is going to get the money back? Is Forbes listed fraudster will face the jail?
    This new rule from RBI is another example that PM Modi's much talked 'Demonetisation' is utter failure. For this reason neither RBI no PM office is able to give the success.
