Jay Shah case: SC asks Gujarat court to stay defamation suit against 'The Wire'


New Delhi, Mar 15 (Agencies): 'The Wire'The Supreme Court on Thursday directed the trial court in Gujarat not to proceed with defamation case filed by Bharatiya Janta Party (BJP) president Amit Shah's son Jay Shah against news website The Wire for its report.

The bench, however, was critical of the way news websites are writing reports and asked the media to be more responsible. A three-judge bench of the Supreme Court, headed by Chief Justice of India Dipak Misra granted partial relief to The Wire journalist till April 12.

The Wire's editor Siddharth Varadrajan took to twitter calling the judgement in favour of 'media freedom'. "A promising day for media freedom, Supreme Court restrains further proceedings in Jay Shah criminal defamation case against @thewire_in. Our petition to quash the same listed for hearing on April 12."

Jay Shah had filed a criminal defamation case in a metropolitan court in Gujarat in November last year against news portal The Wire over a report claiming his firm's turnover grew exponentially after the party came to power in 2014.

Additional Chief Metropolitan Magistrate S K Gadhvi had ordered a court inquiry into the matter under CrPC section 302.

In his application, Shah prayed for, "criminal action against the respondents for defaming and tarnishing the reputation of the complainant through an article, which is scandalous, frivolous, misleading, derogatory, libelous and consisting of several defamatory statements."

The seven respondents in the case were the author of the article Rohini Singh, founding editors of the news portal Siddarth Varadarajan, Sidharth Bhatia and M.K. Venu, managing editor Monobina Gupta, public editor Pamela Philipose and the Foundation for Independent Journalism, the non-profit company that publishes The Wire.

In December last year, Ahmedabad court had vacated an ex parte order of October 12 placing absolute restraint on the publication of the controversial article. The order, however, restrained the news website from indirectly or directly linking the article with Prime Minister Narendra Modi till the final disposal of the defamation suit filed by Jay Shah.

    yes i know my kid sing " three little monkey jumping on the bed ......." , so you should know all will fall down and brake its leg... well there is not little here and no one ignorant of whats happening....if Jay has advantage of getting business and improving sure its by political links but if he has record straight and taxes paid no one is bothered... by wire the kangress baby should concentrate on billions looted over years rather running around with pity things... so end of the day all sit on same table and at present Shah has upper hand...

    Amit Shah The country would like to know which bussiness model did Jay Shah used to gain so much profit is such a short record of time. Jay shah can be taken for the election rallies in Karnataka and elighten all of us.

    It is not the profit but the turnover increased from 15 lakhs to 80 crores. This is due to the company getting into new venture and received grands from the Govt schemes for non-conventional energies like any other company and ventured into new business. However later on the company went on loss and was closed.
    'The Wire' selectively reported the statistics for the purpose of defaming and got itself into trouble.

    I don't know if you read the story of the 'THREE LITTLE MONKEYS' that I keep referring to nowadays; I actually am helpless to drag you into this story......

    Shetty, So what , who cares , even if he is the president .Fact remains , how did the son manage to horde such mammoth amounts of money. How did they rake in such amount of money. He is answerable & liable for every misappropriation of funds, Perhaps it was black money stored with Jay Shah for Safekeeping , Nation wants to know . ..Count down has begun , Slowly & surely people are waking up from their slumber . They are seeing the B.J.P for the party that it really is . The disparity between the poor & the ultra rich is revealed . 51% of Indias wealth is held by the top 10 percent . The Ambanis , Adanis & the Shahs & the Modis are striking it Rich. Now Jay Shah has joined them Let Truth Prevail.
