'Bribe' video: Disqualify Sriramulu from contesting polls, Congress petitions EC


New Delhi, May 11 (Agencies): The Congress today petitioned the Election Commission demanding that BJP candidate B Sriramulu be disqualified from contesting the Karnataka assembly elections over a video allegedly showing him trying to a bribe a former chief justice of India's relative.

"We have requested the Election Commission to disqualify B Sriramulu from contesting the election," senior Congress leader Kapil Sibal told reporters after meeting the poll panel.

Yesterday, the Congress released two videos, dating back to 2010, allegedly showing BJP leaders B Sriramulu and G Janardhana Reddy negotiating a bribe to a relative of a former chief justice of India to influence a verdict in a mining case.

The videos also appeared on a local channel in Karnataka.

Later, state electoral authorities directed channels not to air the videos.

The memorandum by the Congress to the EC states, "This clear cut evidence relates to grave corrupt practices including attempting to bribe a Supreme Court judge. It goes without saying that even on a cursory viewing of this incriminating evidence, a clear-cut case for the cancellation of the candidature of B Sriramulu is made out for both the seats being contested by him in the upcoming Karnataka Elections.


"In a forty-minute video that has been made public and broadcast widely in the regional Kannada media on the evening of May 10, 2018, it is clearly seen that the candidate B Sriramulu and been other individuals (identified as G Janardhan Reddy, Captain Reddy and Swamiji) are seen sitting with the son-in-law of a former Chief Justice of India. The discussions between them, as seen in the video and reported by the media, relate to the payment of money to the son-in-law to secure a favourable judgment of the Supreme Court for the Reddy brothers.Upon viewing the video, there can be no doubt as to the agenda of the meeting taking place," the memorandum states.

Expressing displeasure at EC's move to ban channels from airing the video, the Congress said, "Surprisingly, ECl/CEO Karnataka has proceeded to grant an injunction banning the Kannada Television Channels from playing the tapes instead of taking action against B Sriramulu. Needless to add that this order is neither in the letter and in the spirit of the Constitutional powers now is it warranted by facts and precedence brought out above."

The Congress urged the EC "To take all such actions as may be necessary and required in law and direct immediate barring/disqualification of B Sriramulu from contesting Karnataka Assembly Elections 2018, and to take all such actions as may be necessary and required in law including direction for registration of offences against B Sriramulu, for violation of provisions of the Indian Penal Code, and the Prevention of Corruption Act, 1988; and to direct CEO Karnataka, to lift any injunction on the Kannada television channels or other media from showing and playing the tapes."

    The people of the State expect action from the CEC. There cannot be silence on such a serious issue and passing an injunction on the media from disseminating information to the people when the whole nation is for eliminating corruption from the country.

    Our Election Commision of India is lame duck. To date no one new how does affidavit of contestant of election is screened and issued certificate of eligibility to contest.

    Perhaps India is the only developing country were candidate with criminal record can be people's representative with multiple charges. But common citizen of India is not eligible for any government service without being any charges.

    BJP's party president Amit Shah and now Sriramulu both are are accused of bribing and murdering of Chief Justice of India and Judge related to their cases. Despite the murder charges Amit Shah became BJP's party President and not Sriramalu wanted to become BJP's Chief Minister of Karnataka.
    The Representation of Peoples Act 1951: Section 8 deals with
    Disqualification of representatives on conviction for certain offences. This section states that:

    - A person convicted of an offence punishable under certain acts of Indian Penal Code, Protection of Civil Rights Act 1955, Unlawful Activities (Prevention) Act 1967, Prevention of Corruption Act 1988, Prevention of Terrorism Act 2002 etc. shall be disqualified, where the convicted person is sentenced to — (i) only fine, for a period of six years from the date of such conviction; (ii) imprisonment, from the date of such conviction and shall continue to be disqualified for a further period of six years since his release.

    The Representation of Peoples Act 1951: Section 8 deals with disqualification of representatives on conviction for certain offences. Prevention of Corruption Act 1988,section 171E (offence of bribery)
    Sriramalu should disqualified. He is also involved in murder of his own colleague who exposed him of Rs 100 crores money exchange during 'demonitisation' to facilitate Gali Janardhan Reddy's daughter wedding.
    It is surprising from Election Commision of India dictating terms for media to bar from telecasting the bribery video.

    One the one hand you seem to know too much about Indian laws, but on the other hand you seem to assume that an allegation is the same as conviction??

    Are you seriously expecting the EC to disqualify any candidate when no court of law has found him guilty of an offence? Has EC replaced the court system in India?

    For your knowledge In his affidavit, he has shown six cases, including mining violations and a cash-for-bail case registered by Telangana Anti-Corruption Bureau.

    Gentleman, please have knowledge of the subject before putting your argument. Imagine if this man becomes Chief Minister will it be good for the common man of the Karnataka.

    I don't mind you support to any party in our democratic system. But I strongly believe you have atleast common sense to differentiate 'Good' and 'bad'.

    We must have some sort of respect and maryada. It does not matter which party the person comes from but when the corruption charges are so glaring and conspicuous, action must be taken and his candidature withdrawn. How can the authorities turn a blind eye to all that is happening? What is the future of this country if known criminals and corrupt rascals are allowed to contest the elections and loot the nation? What kind of a democracy are we talking about?

    Congress and Sidda are so scared and desperate now. How did a video from long time back crop up just a day before election? the modus operandi is simple
    1. Sidda scared of losing in Chamundeshwari and stands in Badami thinking it is safe seat
    2. BJP puts in a tough candidate there and Scamgress gets scard again of losing it. What to do?
    3. Make a fake video and release it just a day before election and ask for disqualification.
    4. If the candidate is disqualified then Sidda will win. What a plan?

    But unfortunately smart people will see through it, but again not all people are smart enough to see it (for those disagreeing to this)

    Mr Rational thinker - I would like to know your rational responses to other comments also. There are people asking to arrest him without even knowing whether it is genuine or not - please provide your rational inputs to them too or does your rational thinking work only when some one speaks against congress and your blind faith in them?
