Mangaluru, Jun 14: In an incident reported from Kumpala Chitranjali Nagara near Ullal, a lady beat her husband black and blue in public for marrying her by falsely claiming himself to be a Hindu. Reportedly, the youth had earned the confidence of the lady by introducing himself as a Billava youth. The video showing the wife hurling abuses at her husband and hitting him, which reportedly happened on Wednesday June 13, has become viral through social websites including WhatsApp.

The man who was at the receiving end of this treatment happens to be Sayyed (28), residing at Darkhas House in Ajjavara, Sullia taluk in Dakshina Kannada district.

Sayyed had misled the lady by falsely claiming himself to be Arun Poojary, she says. The lady has lost both her parents, and was working for a paying guest accommodation in the city two years back, when she got to know Sayyed who was a paying guest there. Sayyed was working for Jio Company, it is said, and he told the lady that his name was Arun Poojary.

The two got married in a temple in the city and started living in a rented home at Kumpala. It is being claimed that Syed used to harass his wife. Recently, when submitting documents to a bank, she realized that her husband's real name was Sayyed, not Arun Poojary. The lady said that she thereafter filed complaint of cheating in Ullal police station, but the police personnel overlooked her complaint, and sent her husband away by issuing him just a warning.

In the recent past, Syed is said to have intensified torturing of his wife. On Wednesday, he arrived home at Chitranjali Nagara and created a scene. The lady, turning livid at the behaviour of her husband, duly supported by her sister, indiscriminately hit Syed with a wooden stick.

Ullal police, who took over custody of the injured Sayyed, have admitted him into hospital for treatment.

The police said that prima facie, it seemed to be a family matter and that the aggrieved could approach the police for justice.

    Some times, the look can be deceiving. But going through the photos including youtube, I feel, the girl might be very much fallen for the boy. If the boy is deceiving nature and married a girl from another community, then, why this boy will come at girls house.

    Boys attitude seems to be quite Ok. He doesn't look like rowdy. Good thing both have not married as far as marriage is concerned. Being both are adult, let them face the music.

    They may consider themselves to be "married". However, based on the background information, I have my doubts as to whether the marriage could be considered legally valid.

    First and foremost, question is as to which law of India does the marriage fall under? Definitely not the Hindu Marriage Act 1955 since both parties need to be Hindus; and certainly not the Special Marriages Act 1954 as detailed procedure required to register a marriage has not been undertaken.

    Secondly, for any marriage to be lawful, there has to be legally valid consent. A consent obtained by giving wrong information regarding his name and religion surely would not test of scrutiny in any judicial forum.

    However, please bear in mind that it is not the duty of the police to judge the legality of marriage under these legislations.

    This present case looks more like the guy wanted to sleep with the girl and by hook or crook got what he wanted.

    I do not know what sought of legal expertise the local police station has to consider the criminal law implications of this current case.

    Firstly, in order for the marriage to be considered lawful, there has to be legally valid consent from both the parties. A consent obtained by deceit is not a valid consent. Whether the consent was valid or not is not for the police to decide, but rather it has to be decided through a proper judicial process. I am sure any judge in India would agree that if a guy has lied about his name and religion, it surely is a deceit.

    Secondly, they got married in a temple. Presumably the Hindu Marriage Act 1955 would apply for testing the legality of the marriage. Again, if this Poojary guy fails to prove that he had converted to Hinduism prior to his marriage, then even this test will fail.

    Having said that, please bear in mind that the police generally do not get involved into marital dispute of any couple, unless a clear-cut case of physical and mental abuse is made out. The girl could surely file a civil suit in the local court to annul the marriage and seek compensation for the financial and emotional loss. Or the easier option is to go for a mutual divorce out of court, but in which case the girl needs to first acknowledge that the marriage was valid.

    I really feel sad for the girl. What was that guy thinking? How could the foundation for a marriage be laid on a deceit? How did he even think that he will not be caught out? Was the emotions of the girl so trivial that he did not care?

    P.S. – I am not a lawyer. Hence, happy to be stand corrected.

    You are right. According to law, if one misrepresented and married its not binding.
    Now can the women press for rape charges?
    Or is it right on her part to take law in her hand and assault the accused?
    What if the man has died due to such assault, would that act be a communal murder?
    Our super courts need at least 50 years to decide this case😃😃

    Please do not exaggerate the force applied by the girl. The beating is nowhere close to even render him unconscious, let alone killing him. Neither you nor I know the emotional dilemma that this poor girl is going through, so I will let this beating pass.

    As far as your question on rape charges are concerned, it is far too complex legal dynamite. As you would be aware, marital rape is not a crime in India. Hence, if the police are to even file an FIR, then the marriage has to be first annulled by a competent court (police cannot make that judgement call). And then, the even bigger question is whether the girl gave her consent to sleep with him applying the legal precedents set over past 150 years. The yardstick for determination of ‘consent’ in a marriage and in a criminal rape trial are entirely different. The judgement in any rape trial, if any, would probably be a lottery depending on who the presiding judge is.

    As far as I know, proper identity proof is required in every PG accomodation. So how come she didn't know his identity before the marriage? Got married in the temple only? Didn't register the marriage? Why? At marriage registration office proper identity would have ascertained.
    Looks like she was infatuated with this guy earlier. Now the passion has waned. So now the marital bed looks like torture.
