Women can't be treated as chattle: SC strikes down adultery law


New Delhi, Sep 27 (IANS): In yet another landmark judgement, the Supreme Court on Thursday decriminalised adultery after striking down a British era law, Section 497 of the Indian Penal Code, terming it as unconstitutional, archaic and manifestly arbitrary, with one judge saying women can't be treated as "chattel".

"Mere adultery can't be a criminal offence. It is a matter of privacy. Husband is not the master of wife. Women should be treated with equality along with men," Chief Justice Dipak Misra said.

Most countries have abolished adultery as a crime. "It shouldn't be a criminal offence, other people are also involved in it," Misra said, reading out the judgement, also on behalf of Justice A.M. Khanwilkar.

Earlier this month the apex court had decriminalised same sex offence under Section 377 of the IPC, which was another British era law.

Any discrimination shall invite the wrath of the Constitution, the Chief Justice said, adding that a woman cannot be asked to think about the way society desires her to do.

Justice Rohinton F. Nariman, reading out his judgement, said: "Women can't be treated as chattel".

Justice D.Y. Chandrachud in a concurring but separate judgment said society has two sets of morality in sexual behaviour -- one for women and another for men.

Society treating women as embodiment of virtue leads to things like honour killings, he said, adding that the archaic law is against dignity, liberty and sexual autonomy guaranteed under the Constitution.

    I would like to give my views on divorce. The logic may sound bizarre but it is an attempt
    to understand the logic behind divorce. Many might think that it is loaded heavily against
    women .It is not so. It is my humble belief that divorce rules stem from mode of creation.
    Mode of creation is follows,
    A)
    1) God created man in his own image
    2) Woman was created from the rib of Adam.
    3) Adam and Eve marry and they become one.
    My understanding of “becoming one “ is as follows. For example Husband is always late for appointments and Wife is always too early for appointment, their children will on time for the
    appointment. This how we edge towards perfection. It is important that the both boys and girls
    who want to get married should pray for suitable partners. This does not mean marriage will become bed of roses but God will always be present in their marriage to guide the couples.
    B)
    1) When man marries he gets his rib back and he is the owner his rib and the man alone can
    reject the his rib.
    Some of the following verses that deal with divorces are
    1) Mat 5:31-32,Mat 19:9,Mark 10:11-12,Luke 16:18
    2) Romans 7:2-3,1Cor 7:10-15

    Summary:

    Man can divorce his wife only for adultery. If he divorces his wife for any other reason
    he is guilty of making her an adulteress. Any man who marries a woman divorced for
    adultery is guilty of committing adultery.
    If a woman divorces a man for immoral behavior she should not remarry instead
    they should strive for reconciliation .The reason being that the “rib” still belongs to her
    husband and if she remarries she will be guilty of adultery. The question arises as to what
    should the wife do if the man remarries after divorcing his wife for reason other than
    adultery?(Lk 16:18) . My sense is that she can remarry as the man has rejected the rib and
    the husband who divorced her is guilty of adultery. This is my view and needs
    much to be discerned by the church. However there are special cases in which
    dispensation is given by the Church under the authority given by Jesus in Jn 20:23 .
    These issues need to be taught in marriage preparation course. We need to understand
    that divorce does not constitute adultery ,rather remarriage adultery in some cases .
    but we be aware that someday we will die and stand and stand before God and
    judged. Every christian who chooses to exercise his free will should be aware of the
    blessings and consequences.

    These 3-5, 2 legged creatures are disputing " Pati Parameshwar & Sati Savitri" is laughable...

    Promoting adultery by these 3-5 mere humans....its effects on family relations in long run could nothing but disastrous...

    Only adulterous women can be happy with this (evil/wicked) judgement....I am sure less than 10% of Indian women are in that Category...

    Sorry to break some bad news to you..... the Modi Government actually opposed decriminalization of adultery.

    While on the issue of triple talaq, the Government did support the stand in Supreme Court;
    On the issue of gay rights, the Government left it to the conscience of the Supreme Court to decide; and
    On the issue of adultery, the Government actually opposed it.
    On the issue of Aadhaar, it is probably a 50:50 victory to the Government.

    As you could see, only one matter could actually be credited to the Modi Government.

    It is actually a sad state of affair that the Supreme Court (an unelected body) has to amend/ rectify so many of the absurd laws of our country; and whereas an elected body called the Parliament and Government are still talking about Ram mandir!! What are the MP’s paid for?

    So, stop praising Modi for matters which his Government opposed or did not support in the Supreme court.

    Don’t get too confused. One thing that comes out this judgement is that Sec. 497 of the IPC has been adjudged to be unconstitutional. What it really means is that adultery is not a CRIME. That means a man cannot be prosecuted and sent to prison (or fined).

    Everything else that you refer to in your comments regarding divorce, property, child custody, etc. etc, are all CIVIL matters and will be dealt with by the civil courts just like it was being dealt with yesterday. Nothing changes in this regard.

    And yes, a man can divorce his wife if she is having an illicit affair. And for everything else, please contact a lawyer.

    P.S. - Did your wife really cheat on you? If so, bad luck, you can no longer file a police case against her lover.

    Man and women were created as one ( 2 bodies but one in thought, mind) just like’the Father and I are one) so one. When Commandments were give.n To Adam they applied to his wife as well , because what God has put together ought to stay that way. If every man and woman follows Jesus and denies oneself the marriage will be blissful. The main reason is offendce, because we look to our spouses to fulfill our needs and they themselves are a dry cup. Each one of us should sit before the Lord and fill from Him and only then pour it into our families. Then even with troubles, life becomes enjoyable

    i understand what you say but we have several religions here and we just cannot make those as a law. Religion is a practice and belief but law is for the whole society. Therefore, let us welcome the new law which is of course better for the society and may solve many adultery related crimes like rape etc. Let India progress. For progress we need to think out of the box and keep aside individual religions.

    Oh Roshan! I know your male ego got hurt! I am sorry for that! But learn to live with this hurt because in the future you might get bigger hurts. Men's ego cannot be the yardstick to govern any country or society. Vedas or Bible or Quran or any other holy books. They are not greater than the Constitution of the country. If the religious tenants are against the Constitution, our choice should be Constitution. Adultery could be immoral but cannot be illegal. A woman or man does not mortgage his or her sexuality to his spouse by way of marriage. Whether Pati is Parameshwara or Siddharamaiah, it does not matter. Pati is human and so is patni and hence their humane needs and humanness must be respected. Those countries which have made religious books as their Constitution are bleeding today. Country should walk on the path of legality and not necessarily on the path of morality. Moral values differs from person-to-person, society-to-society or religion-to-religion. But the Law and Constitution are same for all. Male-dominated and chauvinistic religions should be sub-servant to the Constitution and not vice-versa

    Please do not do the mistake of equating wealth as good governance. People in Saudi and Brunei do not even have the right to choose their leaders, have no say as to what laws should be applied in the country; and at least in Saudi women need to be accompanied by male outside their domestic setting; and how many princes of the house of Saud are monogamous?

    And your argument of protecting marriage by making adultery a criminal offence is ridiculous. Forcing someone to stay on glued to marriage that no longer works is cruel. Why shouldn’t a man and a woman have the right to decide their own destiny if their marriage has broken down?
