Supreme Court rejects plea for Constitution Bench on Ayodhya dispute


New Delhi, Sep 27 (IANS): By a majority 2-1 judgement, the Supreme Court on Thursday rejected a plea for referring the Ramjanambhoomi-Babri Masjid issue to a larger Constitution Bench and referred the case to a three-judge bench to be set up that will begin hearing from October 29.

"No case has been made out to refer the case to a Constitution Bench," said Justice Ashok Bhushan, reading the judgement on behalf of himself and Chief Justice Dipak Misra, who headed Thursday's three-judge bench.

The bench was giving its verdict on petitions by some Muslims who had pleaded that the 2010 judgement of the Allahabad High Court splitting the title dispute into three parts be heard by a Constitution Bench as it involved reconsideration of a 1994 ruling by a five-judge bench of the apex court which had held that mosque was not an essential part of Islam to offer namaz.

The petitioners had contended that while deciding the title suit in 2010, the Lucknow bench of Allahabad High Court had referred to the observations made in the 1994 judgement by the five-judge bench.

However, in a dissenting ruling, Justice Abdul Nazeer said the judgement in the 1994 Ismail Farooqi case needed reconsideration and the matter should be referred to a larger seven-judge bench.

The majority judgement on Thursday held that a newly constituted bench will commence hearing from October 29 on a batch of petitions filed by both the sides -- Hindu and Muslim stakeholders -- challenging the 2010 judgement trifurcating the disputed site into three parts for Ram Lalla, Nirmohi Akhara and the original Muslim litigant.

"Observations in Ismail Farooqi case on mosques not being essential to religion was in the context of acquisition of mosque and made with respect to facts of that case. The observation made in Ismail Farooqi case has to be treated as only observation and not as the deciding factor of suit," Justice Bhushan observed.

In his minority judgement, Justice Nazeer said "questionable" observations in the Ismail Farooqi ruling were arrived at without undertaking a comprehensive examination and they had permeated the judgement in the main Ayodhya title suit.

He said a Constitution Bench must decide what constitutes essential practices of a religion and thereafter the Ayodhya land dispute should be heard.

Justice Nazeer also said that whether mosque was an essential part of Islam for offering namaz was to be decided considering the religious beliefs and requires detailed consideration.

He also said that the question of the 1994 Ismail Farooqi judgement needed to be referred to a seven-judge bench.

    This case is a very sensitive one. Both the communities have a say on this issue. My opinion is seal the land and put it under the archeological monuments. Both the communities will be happy. Fix the days of worship in the place accordingly. As a citizen of this country, I don't want to see bloodshed and disparity.

    A ruling only to continue the title suit of the land starting from 29th October, nothing to rejoice or lament.
    The present CJI is retiring & new one might give different ruling if appealed again.
    The title suit only will decide with whom it was when India got independence & not what mythology , faith or belief of the opposing parties unlike High Court which gave a prejudiced out of the box solution as judgement.
    Archaeological diggings had brought out many facts that show the pillars used in the mosque were from Budhist Temple as Yaksha & Yakshi were found carved on them.
    The same way skeletons of Islamic burial too were found in the precincts , Will Ram be happy to be installed in that place?

    Lets assume the temples, the fortune or national treasure was not looted. Tell me, what could have been your gain ? Zero ! Because, just what you have educated you earned, what asset you earned, is only your gain. Therefore, please understand, one more temple will not make any difference to a common man.

    With what intention the Saffron Brigade broke the monument I don't know. They could have stopped it functioning as a mosque and could have converted it into a museum or some center for the benefit of the public. I say, this is totally stupid of those who climbed atop the minaret and did the destruction. They have become old now, till now they could not bring up the structure. The place that did not come for any use(worship) how will it make any difference to Hinduism - please tell me.

    Whether Sudan, Egypt, Libya or Iran, these are nations ruled by one king or dictator, gradually conquered or defeated by coup. India is not like that. India was a land mass of several kingdoms that British/French/Portuguese invaded and make Indians slaves. The country was liberated from the invaders by fighting unitedly. The fighters were not just Hindus. It was a united fight by people of all religions. Yes, even then the fight for supremacy by two communities emerged and a peaceful solution was taken up. This does not mean that the land mass that we are living on was comprised by just Hindus - it was an united piece of all communities, including Muslims.

    Your call of a Hindu nation because Hindus are majority does not hold any justified reason because then the Sikhs, Buddhists, Jains, Christians, Parsis and Muslims may want a separate nation. Are you ready to split India into so many pieces ? Just like the Babri Mosque demolition, your plea to will be dragged on and by the time you will be old and brittle and your next generation migrated somewhere.

    Therefore, respect the constitution that was enacted as secular and respect the united fight put up by our freedom fighters. Enjoy the property handed down to your by your ancestors and be satisfied. If you aren't please enlarge your assets as famous business tycoons in India have done. But please leave the nation at peace, do not tear the nation up.

    Your reply is vague and very very generalised. Its a hindu majority country not a hindu only country. Minorities are safe as long this country remains hindu majority. As for as freedom struggle, not all religions vehemently fought against british. Its a historical thing that british were soft to some religious people as most of them were not anti british. About babri mosque that was a temple place which was demolished to build mosque by a barbarian invader . Hindus have right to reclaim the temple place.

    now it not important for me weather building temple or mosque, for alternatively construct a full pledged hospital like, narayan hradayalaya/lilavathi/Apolo or pure Ayurvedic hospitals under the authority of govt( not privatization).
