Defamation complaint filed against Tharoor for 'scorpion' remark against PM Modi

New Delhi, Nov 3(PTI): A criminal defamation complaint has been filed against Congress leader Shashi Tharoor before a Delhi court for his alleged "scorpion" remark against Prime Minister Narendra Modi.

In his complaint, Delhi BJP leader Rajeev Babbar said his religious sentiments were hurt.

"I am a devotee of Lord Shiva... However, the accused (Tharoor) completely disregarded the sentiments of crores of Shiva's devotees, made the statement which hurt the sentiments of all the Lord Shiva devotees, both in India and outside the country," the complaint said.

"The complainant's religious sentiments were hurt and accused deliberately did this malicious act, intending to outrage religious feeling of Lord Shiva devotees by insulting their religious believes," it said.

The complaint, filed through advocate Neeraj, termed the statement as an "intolerable abuse" and "absolute vilification" of the faith of millions of people.

The complaint was filed under section 499 and 500 of the Indian Penal Code (IPC) relating to defamation.

The Delhi's Patiala House Court on Saturday adjourned hearing in the matter for November 16.

Tharoor had stoked a fresh controversy last Sunday while speaking at Bangalore Literature Festival, claiming that an unnamed RSS leader had compared PM Modi to "a scorpion sitting on a Shivling".

No control in filing defamation case and the court should charge heavy penalty to those who fail to prove their allegation in court.

Why didn't the complainant feel hurt in BJP's inability to build the Ram-Mandir in near-complete term of the party ? The party promised to build the temple if it comes to power but it failed. Why you don't see anything wrong with this ?

Secondly, Tharoor had quoted a RSS member's quote. You are begging for the name of the original person who uttered the phrase - assuming Tharoor discloses the name and source, will you file a defamation case against the RSS member ?

In that case, you should thank Tharoor fro waking you up from you slumber. God know how many quotes like this you ignored but now you find it malicious because the quoting person is from a non-BJP party.

Pity ! You guys are so inactive, even in practicing your own faith.

Jenifer. Tharoor made this remark of ' quoting a RSS 'only once he realized the slip up and looked sheepish. On supporting the party that did not build Ram Mandir, it was not in the BJP manifesto at all, So no issues even if it did some of the promises cannot be met, no issues. In that case, May I ask you why do you still support RaGa even after 3o plus elecoral defeats and 22 state losses? Also on your 'faith' comment, please note that even your grandparents too practiced this faith before being converted. Trust this clarifies.

    Ms. Sandhya,

We the readers are a bit premature in discussing what Tharoor said or quoted, certainly we must wait for what he himself will say, something in which he is very apt at.

RG or the entire party lost in the past because Modi promised 15L from black money he will bring back if elected. Tell me, who will let go such an opportunity to get rich ?

Now, for faith matter - I am born to patents practicing my present faith. Do you remember which faith your ancestors practiced before 2000 years ? Same applies to me too. I questioned the complainant about his faith because Tharoor's quote awakened him from slumber. You are even worse because you haven't raised a question at all !

Under the law, as I know it, repeating (i.e. quoting) a defamatory word (or words) - if it is defamatory in the first place - is defamation by the person repeating it.

That's why, I put 'quote' 'unquote' when I have to quote something from some other source, Sir, without those two words, the source becomes me and I could be punished for plagiarism.

Tharoor too, did say that his quote is originally from a RSS man but he did not name him (surely to save the followers from embarrassment). Now, lets watch the fun when he is compelled to name him by this very defamation complainant.
