Triple Talaq Bill stalled as Rajya Sabha adjourned after Oppn uproar


New Delhi, Dec 31(PTI): The Rajya Sabha Monday failed to initiate a discussion on the contentious Triple Talaq Bill, with a united opposition led by the Congress demanding that the draft law be sent to a select committee for scrutiny.

With the government pressing for a discussion on the Muslim women (Protection of Rights on Marriage) bill, 2018 after Law Minister Ravi Shankar Prasad tabled the same, the opposition stuck to its demand for sending the bill to a select committee. Amid a stalemate between the government and the opposition over the issue, the house failed to transact any significant business during the day.

The House was adjourned for the day amid din over the issue.

  

Earlier the House was adjourned twice during the day with an adjournment in the morning following protests by AIADMK members over the Cauvery issue. The House also saw another brief adjournment of 15 minutes in the afternoon soon after the Triple Talaq Bill was tabled.

Leader of Opposition in the Rajya Sabha Ghulam Nabi Azad said the bill was very crucial and requires further scrutiny and claimed that more than half of the members belonging to several parties have demanded that the bill be sent to a select committee. He accused the government of breaking the tradition of sending bills to select committees for scrutiny before they become a law.

Minister of State for Parliamentary Affairs Vijay Goel said the government was ready for a discussion on the issue and accused the Congress of creating hurdles in the passage of the legislation. He said the Congress has already supported the bill in the Lok Sabha earlier.

"The Congress and other parties are only playing politics on this issue which is very important for ensuring the rights of married Muslim women," he said.

Hitting back, deputy leader of the Congress in the Rajya Sabha, Anand Sharma said, "It is the government which is doing politics. Nobody is opposing the bill. Let there be legislative scrutiny".

"The government is misleading the people.If the bill has been passed without legislative scrutiny in the Lok Sabha then it should not be passed here without referring to select committee. Rajya Sabha is not a rubber stamp," he said. Responding to this, Prasad said, "This bill is very important. We want to discuss it here and are ready to listen to any suggestion. Even after bringing the ordinance, there have been incidents of triple talaq till yesterday. It is a question of gender equality...We want to discuss and pass the bill."

Deputy Chairman Harivansh said, "I want to run the House. We have agreed for a holiday tomorrow. The members should allow the House to function today."

As members continued to create a din, the Deputy Chairman adjourned the House for the day till Wednesday.

The bill was passed in the Lok Sabha on Thursday last week.

    Though the SC in 2017 declared instant triple talaq null and void as a method of divorce under Muslim family law, it has been argued that an ill-intentioned Muslim husband may still try and use the invalid procedure to browbeat his wife and throw her out of the house. The irony is that it is precisely because this threat of illegal abandonment is real that the Modi government’s solution is so wrong-headed.
    6 reasons why Talaq Bill should be referred to select committee
    1. The SC last year declared instant Talaq unconstitutional. Hence, as per the law, even if pronounced, cannot take effect. The marriage effectively remains despite the pronouncement. So, what is the Bill trying to achieve by criminalizing the ‘offence’ and by providing a 3 years jail term?
    2. The Bill is discriminatory in the sense that while Muslim husbands are sought to be penalized with imprisonment for divorcing their wives, Hindu, Sikh or Christian husbands who abandon their wives face no such punishment.
    3. The Hindu Marriage Act does provide for a jail term to the husband in case of cruelty and desertion but it is 1 year’s imprisonment and not 3 years.
    4. At a time when the SC has decriminalised adultery & homosexuality, it is regressive to criminalise ‘instant divorce’, which is a civil wrong.
    5. No other country has a law that criminalises the act of ‘divorce’.
    6. The law is flawed because it provides for both jail term for the errant husband as well as his obligation to arrange for maintenance of the wife and children. The jailed man is unlikely to be able to arrange for maintenance, making a lot of the wife & children worse.

    Motive behind introducing this bill by The Anti BJP and RSS is to create panic among muslim community. If the bill is passed husband will land in jail for 3 years comparing to the hindu divorcee one year only. The greater impact of this bill will affect the more to muslim wife who will be cornered for the rest of her life without getting a penny maintenance from her husband side.

    BJP government want to oppress the Muslim community by introducing the Triple Talak Act. This bill has many loopholes. BJP should concentrate on the development of the Country and should not waste time on these unimportant issues.

    Nobody is opposing on this issue but why BJP wants to bring in a law through illegal means???. Eventually any case goes to the court for justice, court will reject this case and give verdict against Muslim women citing there is no law as per the chartered rights of constitution. It's all eye wash and media hype by BJP and in the end it benefits none but chaos.

    If BJP is so much concerned about Muslim women then why are they in such a hurry to make this bill into law through unlawful means through back door if they have the confidence of the people????. Nobody opposed this bill in the parliament and now opposition wants it to follow proper procedure and go through proper channels, then why BJP is against it?????. Exactly the same case with Babri masjid too. BJP wants to do everything illegal because it's a party of criminals and a friend of none but themselves.
