Mangaluru, Jan 24: As the office of the deputy commissioner (DC) of Dakshina Kannada district has failed to comply with the order issued by the chief civil court (senior division) at Puttur to pay compensation in connection with a tragedy which had happened nine years back, the court has now ordered to forfeit assets of the deputy commissioner's office including vehicles towards recovery the dues.

A ninth standard student, Shah Rukh Khan, had died after the lintel of Akshara Dasoha building fell on him. In this case, the court had ordered payment of five lac rupees by way of compensation to the parents of the boy. As the order was not   obeyed, the above court has ordered for the seizure of vehicles and movable assets of the office of the deputy commissioner of Dakshina Kannada district.

The lintel in question had fallen on the head of the student when the 'Akshara Dasoha' building was under construction in the compound of the government school at Vidyapura, Kabaka, Puttur taluk. This tragic incident had happened on March 4, 2010. In this incident, the boy had suffered serious injuries after the lintel fell on him, and had breathed his last later.

Parents of the boy, Abdul Khader and Tahira, had filed case against the government school and contractor, seeking disbursement of compensation. The chief civil court at Puttur which heard the case, had ordered the government to disburse compensation of five lac rupees to the parents of the deceased. The government had gone on appeal against this verdict, but the court had rejected the appeal. Even after eight months of the judgement, the government had failed to pay the compensation. Therefore, the petitioners had filed execution petition in the court to recover the dues.

Advocates, Ibrahim K S from Mangaluru and Arun B K from Puttur, had represented the petitioners in the case.
