Press freedom can't be above national security: Jaitley


New Delhi, Mar 7 (IANS); Union Finance Minister Arun Jaitley on Thursday said that the freedom of press cannot be above national security and that the framers of the Constitution too realised this fact.

Jaitley's comments came in response to a media query about the government telling the Supreme Court that the material published in The Hindu newspaper on Wednesday and earlier on February 8 about the Rs 59,000-crore Rafale fighter jet deal was based on documents "stolen" from the Defence Ministry.

"Let me be very clear... What goes on in the court let's leave it for the court to decide. It is obvious that defence notings of sensitive interests to this country have been leaked out," the Minister said.

"Don't forget that we have a very free press in India and we respect it. But even the framers of the Constitution have said that national security is an exception. And that has never been challenged in the last 72 years," he added.

After the news report contradicting the Narendra Modi government's claims on the Rafale deal was published in The Hindu, the government through Attorney General K.K. Venugopal told the Supreme Court on Wednesday that it was in violation of the Official Secrets Act.

The Centre on Wednesday told the Supreme Court that the leaked documents related to Rafale deal cited by those seeking a recall of the December 14 ruling giving a clean chit to the government on the purchase of 36 Rafale fighter jets were confidential papers stolen from the Defence Ministry.

Referring to the eight-page dissent note by the three members of India Negotiating Team (INT), Venugopal told a bench of Chief Justice Ranjan Gogoi, Justice Sanjay Kishan Kaul and Justice K.M. Joseph that it was being probed if the documents were stolen by former or present employees.

N. Ram, who is author of the report and publisher of The Hindu, said that he and his publication were protected by the Article 19(1) of the Constitution which guarantees freedom of expression, besides being shielded by the Right to Information Act (RTI).

    Leak of confidential documents on Sunanda Pushkar murder case is a serious matter to Congress and its leaders have asked Arnab Goswamy to be answerable for the crime with exemplary punishment. But leak of confidential documents involving national security on rafeal deal is not a serious breach and same congress leaders support N. Ram, Hindu Editor. N. Ram says freedom of expression guaranteed under constitution is supreme than national interest and he will not disclose the source, be he who he may who direct him to do so. Since the case is presently before Supreme Court, the position taken by Editor of a national daily is audacious, irresponsible and, hence, untenable. Fourth estate has no reasons to downgrade the credibility of democratic institutions and N. Ram should understand that freedom of press is not absolute but highly qualified with an array of riders. If he do not listen the voice of nationalism, it is high time to initiate "Boycott Hindu Newspaper Campaign" in India and this ruthless and self proclaimed intellectual owner of this business conglomerate with conflict of interest should be shown the exit door.

    Helloo... Sunanda Pushkar is not President of India ! She is a housewife, wife of a MP. How can you compare documents of personal mail of an individual to a Nation's security related documents ?

    JAITLEY JI,. YOU ARE A LAWYER AND MINISTER SO BEHAVE. RAFALE DEAL COMMISSION OF 30,000/- PLUS CRORES INVOLVED. JPC INQUIRY, CBI, SC ALL INQUIRY REJECTED WHY??? EVEN INSANE PERSON WOULD have agreed for inquiry but CHOWKIDAR DOESN'T WANT IT MEANS CORRUPTION. ALL INDIAN CITIZEN'S WANT INQURY BUT BJP MINISTERS AND SUPPORTERS ACT DIFFERENTLY.     What a pity.. finance minister gives explanation on defence matters. Then who is giving explanations to finance related matters ?? Total Jumla Govt. Not a single minister except Highway minister knows what is their portfolio...

    The Finance Minister should safeguard his briefcase that he uses to present the budget. Because the Budget (or nation's finance) too is as sensitive as the nation's security. I say this, because the Defense Ministry has allowed its documents to be stolen. With such irresponsible government at the center, one can't be surprised if Finance Ministry is burgled some day.

    As for the press freedom or whatever is printed in 'The Hindu' foremost, the scam shouldn't have happened because its 'the governance with a difference' that is ruling the nation. BJP has proved that is it no different from any other government hence it has no right to criticize any individual or an entity.

    Jetley Saab The Congress did not invoke the official secrets act for all the exposes made by the BJP and also N Ram and Chitra on the Bofors scam. Do you remember how youll captilised on all their exposes with even single letter in the exposures like A being speculated as Amitabh Bachan or his brother Ajitabh Bachan his brother as they were close to the Gandhi family.

    Be a sport and stop raising national security to curb freedom of speech when your house is on fire
