EC Files Criminal Case against Varun Gandhi

NEW DELHI, Mar 17: The Election Commission on Tuesday filed a criminal case under non-bailable law against BJP candidate in the Lok Sabha Varun Gandhi for  allegedly making inflammatory remarks with communal overtones and served notice to the party seeking its explanation.

The three-member commission directed the Uttar Pradesh Chief Electoral Officer to file a case under Indian Penal Code and Representation of the People Act against Gandhi, PTI reported.

The EC ordered issue of notice to BJP and Gandhi for alleged violation of Model Code of Conduct. The EC also ordered transfer of district officials and suspended two others for alleged dereliction of duty.

Earlier in the day, Varun Gandhi claimed that the CD containing his speech has been tampered with. "I know it has been (tampered with)", he told TV channels while replying to a question.

"All I want to say is that tomorrow I will be addressing a press conference in Delhi and I will be clarifying my stand on every single issue....I will be addressing from a proper party forum," the young scion of the estranged Gandhi family said.

At a recent election meeting in Pilibhit from where he is being fielded, Varun had said "this is not a 'Hand' (Congress symbol), it is the power of the 'Lotus' (BJP symbol). It will cut the head of ....... Jai Shri Ram."

Continuing in the same vein, the grandson of Indira Gandhi and son of the late Sanjay Gandhi and Maneka told another meeting "If anyone raises a finger towards Hindus or if someone thinks that Hindus are weak and leaderless, if someone thinks that these leaders lick our boots for votes, if anyone raises a finger towards Hindus, then I swear on Gita that I will cut that hand.”

On a complaint from the Congress party, Varun was slapped with a notice by the Election Commission charging him with violation of the model code of conduct for elections for allegedly making communal remarks during a rally held on March 6 in Pilibhit.

Varun has also come under attack from within the party and its allies. Terming the comments as "shocking", BJP leader Shahnawaz Hussain demanded an unconditional apology from him while the party asked all its poll nominees to "practice caution" in their speech.

We have advised all our candidates to practise caution and restrain in their speeches," party spokesperson Siddarth Nath Singh said.

Asked if his party would initiate any action against its candidate from Pilibhit for his alleged inflammatory speech, Singh said "that is to be seen but we do not subscribe to such views and this is sure."

Varun had faced criticism from BJP vice president Mukthar Abbas Naqvi yesterday who said his remarks were a manifestation of his Congress past.

BJP's ally and JD (U) leader Shivanand Tiwari said that the Election Commission should take cognisance of Gandhi's speech and that there should be a "legitimate" inquiry.

In his reply submitted to the District Magistrate M P Agarwal, the BJP candidate had denied the charge.

    Not surprising that only the two Muslim leaders from the BJP have criticized Varun for his hate speech - Not a single other leader has been shocked or dismayed at the 'Never before' derogatory remarks used against Muslims! The Shiva Sena chief has expressed his admiration and stood by Varun for spitting vitriol against Muslims. Not surprising.

    But inwardly other BJP leaders also must be supporting Varun's stand.After all that it their speciality- Communal hatred. But since it is election time they do not want to alienate Muslim vote banks gathered by the two Muslim faces in BJP!

    As for showing the other cheek remark, the foolish young man does not even know that Mahatma Gandhi took it from the teachings of Christianity ! He pretends he does not want to insult the Mahatma! Why is he flaunting the Gandhi name? When the mother is fighting to save even tiny animals from suffering even a tinge of pain, the son wants to chop off hands and .......Immature, and childish, playing to the gallery, gets carried away by the cheering( jeering) of the crowd, What kind of leader will he make? One more hate monger- get rid of him!!

    Nagesh nayak, Bangalore, as you said UPA govt. did nothing during 26/11, I agree with you… what NDA govt. did during Kandahar hijack did they attack Afghanistan... did they kill the hijackers.... instead the honorable home minister negotiated with the terrorists... so don't point at the govt.s. Both are no different. It is our collective failure in all fronts.

    According to your comments you suggest that the govt should have attacked Pakistan. Remind you when US attacked Iraq the whole world rejoiced.     Its really sad the hatred I see even in blogs!!! Why are we not remembering we are humans first & then you can call me what you want.. Hindu/Christian/Muslim..It just shouldn't make any difference to one as long as conscience is clear & faith is strong! It is also silly people have moved out to Muslim countries/Christian countries.. and still brag about Hindutva & support the goondas actions! If one thinks being part of minority population means 'no human rights in India', then you should not be living outside India.. You can't have it all! You want only Hindus to live in India but at the same time you want to work in Muslim / Christian countries.. What weird logic is this? Just learn to live peacefully & let live!

    Make Varun Gandhi an example. The EC should disallow his candidature for the upcoming elections. In fact the party he represents should also pay for this by not being able to field a candidate from the constituency that Varun intended to run.

This is in spite of having the top brass of all political parties campaigning in Delhi. Looking at these two leaders i am sure you will agree that Congress and BJP still has some good leaders. About Modi - we all know that he was a mute spectator during the communal riots and him top police force is facing heat now. I too agree that he has developed Gujarat but he failed to protect the human rights. Yeddi may be a good leader but he is failing to protect the human rights. The same rights are given to each and every citizen irrespective of his religion because India is his motherland. Hope you understand this and criticize the wrong and applaud the right.

    Not sure why there is so much of fuss. Hindus were persecuted, terrorised by Islamic invaders for centuries and its still happening in Kashmir and in rest of the part of India. Have we forgotten 11/26? We Hindus, we have lost the nerve, we are a coward .. and when someone takes some stand, we pull him down. There is nothing wrong in Varun's speech. We need someone educated who can help raise confidence in Hindus. Why don't election commission look into Mulla Mulayam, Abu Azmi, Mayawati and few congress people speeches? Why Hindus have to be blamed? Go Varun Go. I'm admirer of your father and always wanted a person like Sanjay Gandhi to be a PM. A strong-willed man who can steer India from the terrorism emitting from within and outside country. I'm with you. And I want you to achieve greater heights. I like your statement I'm a Gandhi, A Hindu and an Indian. And I'm proud of that - that a leader is saying that he is HINDU when even BJP leaders are trying to hide their own identity.

    Sanjay Gandhi was the one who destroyed India's democracy and was the architect of Emergency rule in India and all its untold torture and suffering. Many of the BJP leaders of today where jailed during Emergency by Sanjay.

    Mr. Varun Gandhi is a young blood and naïve in politics. He should have involved in issuing statements on development concerns of the nation rather than inciting violence. Politicians first utter their senseless speech then blame media as the media tampered their speech.

    If that is the case why EC asked the police to file criminal case against him? Does the EC also blind to tell the police to file FIR without verification? In a public speech everybody listens and that is the naked truth even bjp within their ranks raised eyebrows and condemned Mr. Varun Gandhi.

    I agree with Mr.Varun Gandhi's claim that his speech has been tampered with by overzealous media. what he said if put in right perspective would only mean, if someone harms hindus he would cut thier hands. What's wrong in his speech? He was just assuring hindus of safety from anti-national and subversive elements living in india. Why some one has to find falut with his speech and assume its meant for them, unless they have sinister design and agenda. There is saying in kannada - "Kumbala kai kall endre hegalu mutti nodidananthe".

    Political pundits admit that if one wants to shoot to fame, just take the political short cut "make hate and furious comments against minorities in a public function". I think he has lowered his dignity and self-esteem by his hate speech. Unfortunately, some one adviced him to do this to become better known. What is he and what has he done to the same people he is hating? As Mr. Barak Obama said, "we don't need many of the same people". We have seen many doing this, gaining short-term fame and disappeared disgracefully.
