Cheating case against Smriti Irani over academic record


Pune, Apr 16 (IANS): A Maharashtra Navnirman Sena leader on Tuesday filed a complaint of cheating against Union Minister Smriti Irani, questioning the differing academic qualifications in her affidavits submitted by her to the Election Commission in the 2004 and 2019 Lok Sabha elections.

In her complaint, MNS's ex-municipal corporator from Pune, Rupali Patil has accused Irani of "cheating, misleading voters and criminal breach of trust" under various sections of Indian Penal Code.

"In her 2004 election affidavit, when Irani contested from (Delhi's) Chandni Chowk seat, she had stated that she was a Bachelor of Arts graduate of 1996 from Delhi University's School of Correspondence. In the 2019 poll affidavit, she has mentioned she was educated up to First Year Bachelor of Commerce but not completed the three-year degree course," Patil told IANS.

Irani had made similar statement in her 2014 election affidavit, but Patil wonders how can her qualifications come down from 2004 to 2019, and said she is resorting to falsehoods to lure voters.

Patil's lawyer Vijaysinh Thombare said that these blatant contradictions amount to sheer cheating of the voters for seeking votes and criminal breach of trust as she has filed false affidavits before the EC.

"The complaint has been accepted by Pune Court Judicial Magistrate First Class B. S. Gaikwad who will pass his orders in the matter soon," he said.

Patil said all attempts by her to lodge a separate complaint with the Pune police failed, forcing her to move the city court over the issue.

Irani's educational qualification have been a matter of controversy with the Congress and other parties raising questions on them.

The BJP has nominated Irani to fight against Congress President Rahul Gandhi for the second time from Amethi where she was defeated by him in 2014.

    Generally, a person’s qualification increases with the passing time but BJP’s CM candidate for Karnataka assembly elections BS Yeddyurappa’s and Union Minister Smriti Irani educational qualifications have taken a considerable dip in the past few years.

    BJP leader Yeddyurappa was College graduate in 2013, Class 12 pass in 2018

    The 75-year-old BJP leader had shown a BA (Bachelor of Arts) from Bangalore University as educational qualification during 2013 state assembly elections in Karnataka. However Yeddyurappa, who filed his nomination papers for the Shikaripura Assembly constituency in 2014, and again in 2018, has mentioned in his election affidavit that he has done a Pre-University Course (PUC) from Government College Mandya, Mysore University in the year 1960-61; which is equivalent to Plus-two, i.e., 12th pass.

    Thanks to Election Commission of India, people's representative with a fake degree can become Ministry of Human Resource. At the same time jobless genuine MBA graduates, Engineers, Ph.D. holders, and postgraduates are applying for railway track cleaning and sweepers jobs.

    While PM Modi recommends 'Pokada' , his minister Piyush Goyal says losing jobs is a good sign for the economy. His Tripura Chief Minister says asks to open 'Pan Shop' or raise milking cows for living for the educated on India.

    Section 125A of RP Act makes the filing of false affidavit an offense punishable with just six months imprisonment, but it was a much serious offense and should be included in the corrupt practices under section 123 of RP Act.

    Ironically Supreme Court of India that supposes to cleanse the Electoral system washes off its hands in a reply to PIL " Filing Of False Affidavit For Election Nomination Is Wrong, But Can’t Direct Parliament To Make It An Offence".
    Only in India;
    The government employee with false documents in punishable maximum punishment for the said offense is 7 years imprisonment.
    The people's representative who furnishes fraudulent document is just punishable for 6 months.

    In England, these offenses are usually charged under the Fraud Act, where the maximum sentence permitted by law is 10 years imprisonment.

    Those who secure jobs and admissions in educational institutions in the reserved category on the basis of fake caste certificates would lose them and be punished, the Supreme Court. A bench of three justices -- Chief Justice of India JS Khehar, Justice NV Ramana and Justice DY Chandrachud -- reversed a Bombay High Court verdict which had held that if an employee is in service for a long time and later it surfaces that he had got it on the basis of a fake caste certificate, then he can be allowed to continue the job.
    Why the same law on government jobs by SC is applicable to Peoples representatives? Is serving MP's are not govt employees?
