Supreme Court Bars Sanjay Dutt from Contesting LS Polls

New Delhi, Mar 31: The Supreme Court has rejected Bollywood actor Sanjay Dutt's plea to contest this year's Lok Sabha polls. Dutt was to be the Samajwadi Party candidate from Lucknow.

Supreme Court refused to stay his conviction in connection with the 1993 Mumbai blasts case. Dutt was convicted under the Arms Act and sentenced to six years in jail by a TADA court. He is out on bail at present.

"We are not inclined to suspend his conviction," a Bench headed by Chief Justice K G Balakrishnan said, according to PTI.

"It is not a fit case to grant stay of conviction," the Bench also comprising Justices P Sathasivam and R M Lodha said.

The court said that Dutt was convicted for "serious offence" and that the actor's case could not be equated with that of BJP leader Navjot Singh Sidhu whose conviction and sentence in a road rage case was stayed by the apex court to enable him to contest the Amritsar by-elections in 2007.

The Bench said that Dutt was disqualified from contesting the elections under the Section 8 (3) of the Representation of People Act, which debars a person sentenced to two or more years of imprisonment, from standing for polls.

The judges said that the power of the court to suspend the conviction of a person to enable him to contest the elections has to be exercised rarely.

The apex court had on Monday reserved its order after hearing the contentions of the actor and the CBI which is opposing the actor's plea.

    At the observations & counter observations of Mr.Varun, the SC order on Sanjay Dutt has come. The Judgment is welcome one. The convicted should not be permitted to contest. But at same time accused cannot be treated on par with convicted. Though late but still the judgment is good one.

    Happy and Not very happy with the SC, The decision was perfect But, the “Goondas” involved in provoking for the 1993 Bombay Blast still want to run the country. The first case should have been solved way before the second.

    Very good judgement by SC. Irfan Ahmed ., ABU DHABI & Valerian Pereira, Shirthady - you forgot to mention criminals like Md Shahabuddin, Atik Ahmad, Mukhtar Ansari, Taslimuddin, Azaduddin Owaisi etc. in your list. These people have dozens of murder and rape cases against them. Is it becoz they have reservation in crime ?

    Keeping arms is not a big offence when compared  to the  massacre in Gujrat as well as in Orissa. Even demolishing worship place is bigger offence then Sanjay dutt did. I am not supporting Mr.Dutt but so many criminals are getting tickets from various party and entering Parliment and Assembly. We people should stop them by defeating in election.

    WHILE THE SUPREME COURTS BARS NOTED FILM ACTOR SANJAY DUTT FROM CONTESTING LS POLLS DUE TO HIS INVOLVEMENT IN THE 1993 MUMBAI BLAST CASE. MY QUESTION IS WHILE SANJAY DUTT SERVED HIS SENTENCE AND ADMITTED THAT HE WAS INVOLVED IN THE MUMBAI ATTACKS OF 1993 , WHY IS THE SUPREME COURT SO FIRM IN ITS STAND WITH WHATEVER SANJAY DUTT IS DOING? WHAT ABOUT ARUN GAWLI AND SHIBBU SORREN AND MANY OTHERS WHO HAD FACED CRIMINAL CHARGES BEING ALLOWED TO CONTEST ELECTIONS? WHY IS THE SUPREME COURT SO PARTIAL TO SANJAY DUTT?

    This is a very good conclusion taken by SUPREME COURT & CJI. There are many more candidates contesting elections. DEBAR ALL THESE CANDIDATES WITH CRIMINAL RECORDS FROM CONTESTING ELECTIONS. Dont allow any candidate to contest election with any kind of (criminal/murder/arson/looting ...)cases. Then only PEOPLE OF INDIA will respect COURTS/JUDGES.

    Peoples representation act has got strengthened due to this supreme court's verdict.Sanjay Dutt is a true example to our hot blooded youngsters,who involve in some illigal activities in a spur of the moment,when caught then they repent their silly stupid mistake for life.

    As a star or as Sunil Dutt's son he breathes free air, otherwise he would have broken the stones in Jail.

    One of the recent best assessment by the honourable Apex Court of India. By this Supreme Court has sent clear message to the political parties and the citizens. Hope political leaders will try to understand this. Our constitution is the best in the world. Voters should be bold enough to discourage and reject criminals participating in the legislature process in our Country. Otherwise there is no use in just relying on the Judiciary system to do everything. Jai Ho India!
