Ishrat a Terrorist, says Gujarat - Nab the Guilty, Demands Family

Ahmedabad/Mumbai/New Delhi, Sep 8 (IANS): Her family recalled her patriotism, the Gujarat government insisted she was a terrorist and political parties called for Chief Minister Narendra Modi's resignation. The death of Mumbai collegian Ishrat Jahan five years ago continued to polarise Tuesday, a day after a court report said she was killed in a "fake encounter".

Undeterred by the report of Ahmedabad metropolitan magistrate S.P. Tamang that 19-year-old Ishrat and her three friends were gunned down in cold blood by Ahmedabad Police's Crime Branch (Detection) on June 5, 2004 in a "fake encounter", the Gujarat government insisted they were terrorists.

According to the 240-page report, the four -- Ishrat Jahan, Javed Ghulam Sheikh alias Pranesh Kumar Pillai, Amjad Ali alias Rajkumar Akbar Ali Rana and Jisan Johar Abdul Gani -- were not linked to any terror group.

State government spokesperson and cabinet minister Jay Narayan Vyas told reporters that the inquiry report was "bad in law and so the state government will challenge it".

Backing what the police had said at the time, the government also maintained that the four were Lashkar-e-Taiba (LeT) operatives who had been tasked to kill Gujarat Chief Minister Narendra Modi and organise terror attacks in India.

The Gujarat government spokesperson said magistrate Tamang's inquiry was bad in law for two reasons.

"One, the process of natural justice demands that the accused should be given an opportunity to reply but no such opportunity was given. Secondly, since the high court had constituted a team and gave time to it till November, it was not fair that any other judicial officer also inquired into the case," Vyas said.

He sought to cite an affidavit of the union ministry of home affairs filed in the Supreme Court to insist that the four had links with the Lashkar-e-Taiba.

Reading out from the affidavit, Vyas said a mouthpiece of LeT, Ghazwa Times, had said soon after the encounter that Ishrat Jahan was an activist of the terror outfit.

While the Gujarat remained adamant in its stance, Ishrat's family, still coming to terms with the enormity of the death and the fact that she had been branded a terrorist, spoke out to demand the sternest punishment possible for the guilty policemen.

"She was as patriotic and loved the country as much as you and we do," said an impassioned Nusrat, Ishrat's younger sister.

"We are happy that finally the blot on our family has been erased and she has been proved innocent," the 22-year-old said, adding that the family knew right from the beginning that her killing was a "conspiracy".

Her mother Shamima Jahan added tearfully that Ishrat's killing had branded their entire lives and affected the job and educational prospects of her six other children.

With the terrorist slur finally being removed, "our lives can come back on track", she said.

Ishrat, a resident of Mumbra suburb in Thane district, was a second year B.Sc student at Mumbai's Guru Nanak Khalsa College. Having lost her father two years before her death, she embroidered clothes and gave tuitions to help support her family of eight -- including her mother and six brothers and sisters.

Political parties, with the exception of the Bharatiya Janata Party (BJP), reacted with outrage to the magistrate's report nailing the state government's lie and demanded Modi's resignation.

The Congress said there was a "a man eating government in Gujarat".

Congress spokesperson Manish Tewari also appealed to the Supreme Court and Gujarat High Court to "take suo motu cognizance of all the encounter killings between 2001 and 2009 where there are allegations of fake killings".

"This is inhuman, if a proper investigation is done then many more skeletons will come out," Law Minister M. Veerappa Moily told IANS.

"Given the spate of illegal encounter killings which took place under the encouragement of the state government, Narendra Modi should take moral responsibility and quit office," the CPI-M politburo said in a statement.

BJP spokesperson Ravi Shankar Prasad, however, said that the central government had accepted that Ishrat was a terrorist.

"The Gujarat government has also said it was a correct, legally required encounter," he said.

It is unfortunate that lot of innocent muslims are massacred in Gujarat under the guise of terorism and anti nationals when the saffron party came to power in Gujarat and Narendra Modi is the present day Hitler as CM. The guilty Police should be punished for killing innocent Ishrat and the Chief Minister Modi should resign for committing such heineous crime which citizen of this country will not tolerate such crimes.

There is a man eating government in Gujarat. No religion allows killing of an innocent. Then how these saffron brigades can support this dangerous terrorist called Modi? Fear God, oh Modi. You will be asked by him to give an account of all these. The guilty should be punished. It was a mass murder. May all mighty God give courage and peace to Ishran''s family.

In True Sense Every Common man who is not a public or govt servant is a terrorist. Any innocent person in India can be branded as terrorist by the Law. The Govt gets cornered in many ways but they will not accept their mistakes. It took 60 years for the Congress Govt to come to their senses but still I would say nearly 40% of their party improvement has to be done. In the same way for the BJP and all the Hindu Fanatics it would take another 60 years to set their house in order.

By that time another scoundrel political party will come into existence to destroy the Indian People Left and Right. We have to get back to before 1947. We are to be ruled and not to rule.

Tell me where the encounters are real? In most cases they are fake, carried out either to primarily please some top brass politicians or at times to hide the links of high-profile people with those encountered. But what is happening in Gujarat is not mere fake encounters but systematic anhilation of Muslim community.

There may be a lot of ''ifs and buts'' attached to my view. But those who have observed Gujarat developments over the years keeping aside one''s religion and religious views, understand this. However, if we see from the tinted eyes of religion, we may get a lot of ''proofs'' to justify this anhilation just as justification that more than 2000 were killed and lacs sent packing homeless because Sabarmati coach was set on fire by Muslims. It can happen only in our land that souls of 55 Hindus get solace and eternal piece only when 2000 Muslims are killed or vice versa.

Rites of purification after death, offering mass or puja asking for God''s mercy on the deceased is not required today. If the person died is Hindu then kill 5 Muslims or vice versa. This what we are giving to the world being the descendants of great Sindhoo civilization. For me Gujarat''s Modi government has been a blot on Indian democracy just like the days of systematic killings of Sikhs by Congress-led men in the early 80s.

Let''s not question development since Gujarat has been India''s richest state right from the days of Independence and Modi has just continued what earlier goverments did. But development nurtured by the blood of innocents, be it Muslims or Hindus, can it be termed as sign of progress? Just like we cut trees to constrcut new roads, we are killing people under the guise of development. And lol! We have ready justification for that too. Gujarat''s entire system has bathed in blood.

This is the reason Modi will never be accepted a true and universal leader like Vajpayee or Sonia Gandhi. The situation is such that today Sonia can contest from any constituency of the country and yet win effortlessly, much like what she did when she won against BJP heavyweight Sushma Swaraj from Bellary. But I have 200% doubts of Narendra Modi winning if he contests outside Gujarat. Even nature would support him just like nature did not fulfil Advani''s dream of becoming PM of India. Can a man who divided India at a sacred place callled Ayodhya in 1992, unite Indians being PM. Never!!. So it was not Congress nor voters who defeated him but the nature.

It is not for the first time that Gujarat''s encounters have been proved wrong by court. We have had similar cases in the past too. But the truth is that nothing will happen and these fake encounters will continue and mind you only Muslims will be encountered, as if in India only Muslims are terrorists and rest all saints, goody goody!!

Very unfortunate. If Ishrat Jahan was a terrorist what has happened is good and is in the best interest of our country. If she was innocent, then perperators of the crime and their defendants and protectors must be brutally killed.

Now I feel what made Ishrat to get killed was her name and her religion. Beware of the court of Law of God. Its very horrible and no perperator/sinner would be able to escape. The same pattern is followed in Karnataka and all BJP ruled states are unleashing terror against minorities and just implementing RSS agenda. Is it not natural that victimised people stand up against the injustice and spread more terrorism against these states?
