Freedom of press not absolute: SC asks Arnab to move competent court to quash FIR


New Delhi, May 19 (IANS): The Supreme Court on Tuesday said free citizens cannot exist if the news media cannot speak, and journalistic freedom lies at the core of freedom of expression, but it is not absolute.

The observations were made by a bench comprising Justice D.Y. Chandrachud and M.R. Shah, while asking Republic TV Editor-in-Chief Arnab Goswami to move competent court to quash an FIR for a news show on Palghar mob-lynching.

The top court also refused to transfer the probe from Maharashtra Police to CBI. But, it extended some relief to Goswami by providing him protection from coercive action for next three weeks.

On May 11, the bench had reserved the judgement on pleas by Goswami. Justice Chandrachud, pronouncing the judgement, said India's freedom of press stays as long as journalists can speak truth to power, but noted freedom is not "absolute".

The bench observed that free citizens cannot exist if the news media cannot speak. "Journalistic freedom lies at the core of freedom of expression," said the top court.

Goswami had sought transfer of the FIRs filed in connection with his shows on the Palghar lynching and Bandra migrant gatherings. Goswami had urged the apex court to quash the cases filed against him, as it was an attempt to silence him as a journalist.

The top court reiterated that it is the duty of the court to protect the freedom of expression, and noted multiple complaints against Goswami will have a stifling effect. Multiple FIRs were filed against Goswami regarding the Palghar lynching in various states, the top court agreed to quash all except the one currently under investigation in Mumbai.

The top court refused to quash the FIR and asked Goswami to seek quashing of it before the competent courts, and follow the normal process by moving the Bombay High Court.

    But 'Republic TV' freedom of expression continue to create the divide to benefit ruling party in the center.

    This is going to be a landmark judgement for responsible freedom of press. But for Arnab, this heinous crime in Palghar and the voluntary congregation in Bandra to spread the pandemic, would have been swept under the carpet.

    Encouragingly, the multiple stifling FIRs filed against Arnab in various states by the chamchas of Manu Singhvi, Kapil Sibal, PC, etc., have been quashed by the top Court.

    The truth will prevail and the guilty will be punished suitably.

    If Arnab Goswami is claiming freedom of speech, free journalism and revelation of truth then why only target the opposition especially congress and publish unfounded concocted material, why not bring out the truth about its own BJP too if he is portraying as Satya Harishchandra??????.... Then be fair and open BJP's can of worms and filth?????...Freedom of speech comes with responsibility and consequences and respect to opponent. It's not a one way all the way weapon of right.

    I don't want to start channels to win elections by false and fabricated news and highlighting your own parties unfulfilled and fake promises as truth and accomplishments and showing opposition in bad light to discredit thier achievements. I have channels which are free of politics FYI.

    Do we have one set of rules to ordinary citizens and another set for the powerful? The case is in the court and bowbow is extensively discussing and belittling police as if he is not entitled to follow normal course of justice but wants protection from SC.

    Everyone knows that freedom is not absolute be it for a journalist or a citizen. That is taught to us in our constitution of India class. We are interested in knowing the outcome of "FIRs filed in connection with his shows on the Palghar lynching and Bandra migrant gatherings. " JUSTICE DELAYED IN JUSTICE DENIED" to the persons whom Arnab insulted and humiliated on his Republic TV on Palghar lynching. We also know that "JUSTICE HURRIED IS JUSTICE BURIED". We need no lessons on these adages.

    At least SC not quashed one FIR, which will put Arnab in trouble. Powerful BJP ministers batting for this guy, if they did same to send the migrants to home till now all migrant issue would have been closed. The way Arnab presenting his news it is very awkward and brainwashed agenda people only can digest his barking
