Setback for Vijayan as Kerala HC quashes FIRs against ED


Kochi, Apr 16 (IANS): Chief Minister Pinarayi Vijayan on Friday suffered a setback after the Kerala High Court quashed the two FIRs registered against Enforcement Directorate officials by the Crime Branch unit of Kerala police in the gold smuggling case.

It was in last month when Vijayan gave the nod to the Crime Branch unit to register cases against ED officials based on a complaint by two women police officials that they were allegedly being pressurised to testify that the gold smuggling case accused Swapna Suresh was coerced into giving statements implicating Vijayan in the case.

According to the two women police officials, who were providing security to Swapna Suresh, when under judicial custody, that they had heard of the ED pressurising her to name Vijayan.

On Friday Justice V.G.Arun ruled that the Crime Branch had not followed the rule of law and hence the two FIRs have to be quashed and the authorities can take the case up with the concerned court - Ernakulam Principal Sessions Court.

Union Minister of State for External Affairs V.Muraleedharan said that at least now both the CPI-M and Vijayan should stop such acts.

Senior Congress legislator V.D.Sateeshan said Vijayan is a master when it comes to gimmicks and playing to the gallery.

"All this went ahead because it was Assembly election time and Vijayan wanted to portray a false image that he is one who will take on anything and to gain the confidence of the people, especially when he was leading the Left front in the election.

This is similar to the fight that takes place in the circus ring, when everyone knows it's a fake one," said Sateeshan.

Union Ministers including Home Minister Amit Shah, Nirmala Sitharaman among others had slammed such move by the Kerala government.

    True federalism means that the central agencies will do their jobs in a professional and impartial manner. Most of the central agencies are behaving like caged parrots of the BJP and are virtually hounding opposition parties and their leaders. They have lost all credibility and are suspect in the eyes of the people. The alleged attempts by these agencies to extract forced statements from the accused to implicate the Kerala state leaders including the CM necessitated an inquiry by the state CID. The High Court should have allowed this inquiry by the state CID as the people would have come to know the other side of the story as for the past nine months it was one sided story being churned by these central agencies and faithfully parroted by the local press in Kerala. The Attache in the UAE Consulate who is central to this diplomatic baggage was allowed a safe passage out of the country to UAE. Conspiracy theories were being floated every second day by the central agencies and nine months of investigations has reached no conclusion except for shadow boxing against most of the state leaders including transgressing in unrelated issues. The Country is painfully aware of how the Central Agencies are being misused to target opposition Leaders and Parties. This is the Ugly face of Modi's Maan Ki Baat and his innocent pretensions behind TV cameras in his repeated addresses to the Nation.Central Government Tax and Enforcement Agencies like Income Tax Dept and Enforcement Directorate have rarely raided BJP Leaders over the last six years. It will be nice to know through the media if any BJP leader has been issued any IT or ED Notice during the last six years. ED or IT departments would have known that large sums of money were transacted for luring of MLAs at the time of toppling of non-BJP governments but have turned a blind eye.

    How can HC quash such high profile case without trial involving govt officials?????.....This is similar to SC quashing the case against central govt for not receiving the documents relating to Rafael scam then BJP claiming documents been misplaced and lost. So, going forward we don’t need any courts or law to get justice, it’s going to be jungle raj in banana republic under BJP rule.

    Your fake BJP was sure of getting a verdict against its interest hence the case was quashed before it could be tried. There is not much negotiation room for BJP to manipulate this clear cut case exposing BJP and its faithful biscuit eaters. Clean chit to BJP before trial. One way cowardly justice.
