'Should be charged with murder': Madras HC comes down heavily on EC


Chennai, Apr 26 (IANS): Lashing out against the Election Commission, the Madras High Court on Monday termed it "the most irresponsible institution in the country" and should probably face murder charges for not preventing parties from breaching Covid-19 protocols during campaigning during the Assembly elections.

It also warned of stopping the counting process on May 2 unless proper plans were drawn up for the process.

A bench of Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy, while hearing a plea moved by Tamil Nadu Transport Minister M.R. Vijayabhaskhar, said: "You (EC) are the only institution responsible for the situation of Covid and should probably be put on murder charges for not preventing political parties from misuse of Covid 19 protocol. You have been singularly lacking any kind of exercise of authority. You have not taken measures against political parties holding rallies despite the court saying 'Maintain Covid protocols, maintain Covid protocols'."

The minister had petitioned the court seeking direction to the Election Commission to follow a slew of measures in ensuring fairness during the counting of votes on May 2 for Karur constituency where he had contested the elections as an AIADMK candidate. There were 77 candidates in fray at Karur constituency.

"We assure you that we will stop counting if we do not find before May 2 a blueprint on how proper maintenance of Covid protocol is assured so that this state does not succumb to the idiosyncrasies any further," the bench said.

The Chief Justice also observed that public health is of paramount importance and that it was distressing to remind constitutional authorities on the counting and possibilities of a further surge after May 2.

    i salute the Madrasis and the madras hc for lashing out at EC, mouthpiece of chaiwala and daku These third rated gujjus, who are just fit for some trading are ruling the country because they played with the emotions of the gullible uneducated and gawar public of India. Only states like tamilnadu, Kerala, andhra pradesh, west bengal, maharashtra can bring this dangerous duo to thier knees. The coward public and govt of Karnataka has not guts.

    If the Madras HC uses its reasoning without any bias, it should not charge the EC. Rather, the main culprits none other than the PM, HM and many other powerful leaders of BJP. Do you have the spine?

    If EC is following master's orders, that would be like punishing a pet dog. Strangely no one is speaking about the Kumbh Mela where (I read somewhere) more than 30 lakh people gathered without any social distancing. And there were so many political rallies.

    I am so sad that our country my motherland is in such a chaos,our politicians are not able to decision when and what comes first.Whether dread covid to stop or campaign on political basis.They prefer first religious feast ,mass marriages ,.but not knowing when and how much oxygen is lacking in hospital,who is responsible for it.In such a chaos God also cant help us.We want a Politician who really lead a land with a hard hand and mind set.Cow brain is here simply at wrong place.

    First the court should have charged all the parties in Taminadu for holding rallies with murder, then charged the minister with murder for holding rallies and then coming to court to stop counting of votes because he is loosing elections.

    The election commission had enough powers to postpone elections or ban election rallies which it failed to do. As court observed in the past it is a toothless body. If a man like sheshan was the chief election commissioner things would have been different. Even Supreme Court or High Courts could have taken suo moto taken cognisance and postpone the elections or banned rallies which they didn't do. Lastly no one moved the SC or HCs for the above through PIL. Courts and people woke up it was too late.

    Firstly charge all politicians with murder for encouraging / weddings and election rallies with no control of crowds. Charge Yogi with murder for allowing kumb mela. Then only we will have uniform law for all and then only we can call as democratic country.
