Bangalore: Mangalore Airport Licence Expiry – HC Seeks Clarification

Bangalore, Sep 23: An advocate named Mohan has filed public interest litigation in the state High Court (HC), seeking directions to the authorities concerned to strictly abide by the provisions of Aircraft Act and other rules while renewing the licences of the airports. The petitioner also has sought the intervention of the High Court to restrain Airports Authority of India (AAI) from operating the Mangalore International Airport at Bajpe till its licence is renewed. He has alleged that the Directorate General of Civil Aviation has committed dereliction of duty in not repeatedly checking the safety aspects of Mangalore and other airports and not taking steps to renew their licences, even after the licences of several airports expired long back.
The HC, on Wednesday September 22, instructed the additional solicitor general of India, Kalyan Basavaraj, to clarify where the matter relating to the renewal of the licence of Bajpe airport stands as of now. The division bench comprising Justice D V Shylendra Kumar and Justice H S Kempanna questioned as to how is the airport being operated without licence, besides wanting to know the reasons for the negligent attitude of AAI in getting the licences renewed, and questioned as to what would happen if some tragedy occurs at the airport in the meantime. It said they will have no other option but to order the closure of the airport in question, if its licence is not renewed.
The petitioner argued that the licence of Mangalore airport had expired a few weeks after 158 passengers lost their lives in an air crash there. He claimed that the passengers do not get any compensation if an aircraft crashes at an airport having no valid licence, and blamed DGCA for not having genuine concern about the safety of the air passengers.
The bench, after expressing deep anguish at the attitude of Directorate General of Civil Aviation, adjourned the hearing in the case, after issuing instructions as above.
