'People, Not BJP should Decide who is Right on Karnataka Issue'

New Delhi, Oct 17 (PTI):
Terming the political crisis in Karnataka as a "clash" between two constitutional authorities, Law Minister M Veerappa Moily has said it was up to the ''right-minded'' people to decide who is right.

Moily, a former Karnataka Chief Minister, refused to get drawn into the debate over the role of Governor H R Bhardwaj, his predecessor in the Law Ministry. When asked about the decision of Bhardwaj to 'advise' the Speaker to maintain the position of the legislative assembly when Chief Minister B S Yeddyurappa was asked by the Governor to prove his majority, Moily said it was a not a transgression on the authority of the Speaker.

"It was an opinion....it is your perception (that it was a transgression)." On being persisted, Moily told Karan Thapar on Devil's Advocate: "It is a question of clash of two constitutional authorities -- one the Governor and the other the Speaker. Who is right on this is a question people should decide...right- minded people should decide, not the interested party like the BJP."

"As a Law Minister I cannot pass a value judgement...and in fact, whether the BJP has raised certain objections...yes they are the interested party. I don't think we can take their suggestions as objective and impartial," he said.

To a question on recalling Bhardwaj from Raj Bhawan, he said, "It is a constitutional process involved. Just because some opposition leaders want recall of the Governor...you know it's not done, unless it is objectively based on merit."

Asked whether the Governor should voluntarily step aside as he had become a figure of controversy, Moily said that question will not arise "in view of my first answer". Asked if he was 'distancing' himself from Bhardwaj, he said, "When certain issues are raised, defending or protecting will not come. Because it may be attributed to me that I am taking the side of Mr Bhardwaj because he happens to be in my party or my predecessor. It is not done like that....It will not even benefit Mr Bhardwaj even if he is on the right line."

When the anchor persisted that Moily was deliberately avoiding a comment on the role of Bhardwaj, he said it was not the case. "It is a question of assessing things on a correct perspective. And the stage has not come to me to assess because it has not reached that kind of a position where a Law Minister can offer his remarks," Moily said.

On being pointed that the Governor had "no business" to write to the Speaker, Moily said the Speaker invoked his power under the Tenth Schedule (anti-defection law) only on the day of the convening of the session.

"That's why if the Governor feels, it is his judgement, and I cannot question his judgement. If I make an attempt to interpret his judgement, then I would be crossing the frontiers of my position as a Law Minister," he said adding that "whether it is (Governor's) business or not, it is up to the judiciary to decide. Not for me or you or any people to decide."

On Governor addressing a press conference, he said there is one school of thought which says constitutional authority should speak less.

"But sometimes, the constitutional authorities are provoked to speak because sometimes his actions have been commented upon by interested parties. So it is ultimately for him to do that," he said.

At the same time, the Law Minister said, a constitutional authority cannot be deaf, blind to happenings around. "He cannot isolate himself from what is happening in Karnataka." To a poser on BJP's allegation that Raj Bhawan has become an epicentre of horse trading, he shot back saying the perspective of the people is the epicentre of destabilisation that lies in the BJP HQs here and also the CM's residence itself...."a man who swears by sword, dies by sword. This is what has happened to BJP," he said.
To a suggestion that Bhardwaj should be 'dispensed with' in the interest of democracy, he said, "It is up to the President of India as she is the constitutional authority."

Putting records straight, Moily said "on one thing I must correct the record: There is nothing unconstitutional done by the Governor. You may say it is improper, you may say it is incorrect, you may say it is little excessive. But I don't think, any way this action comes within the borderline of unconstitutional."

But he hastened to add that he has never said that the Governor's stand was improper or little excessive and he was merely referring to the statements of the BJP.

To a question on the recommendations of the Sarkaria Commission recommendations on appointment of Governors, Moily said that part of the recommendation "to my understanding has not been agreed to by any government - whether the NDA or the UPA."

He said there should be a consensus on ethics on the appointment of Governors.

    Power should be given to people to withdraw support to the MLA in the same way MLAs withdraw support to the Govt. Once people elect an MLA, he is on auto-pilot mode for 5 years with people having virtually no control over them. Dear Mr. Moily are speaking about this type of power to people?

    Whether Court decides in favour of Bjp or independents to be seen.We all know what has happened in last few days and how the honoured speaker office is changed to Yeddys office. Remember whether court judges in favour of Mlas or not blame will still go to BJP as people know the fact. Court will go as per the documents and papers.Abraham Lincoln ex us president used to say one can be legally correct but if he is morally wrong then its not a real victory. I wish all MLAs come out winningly & throw this corrupt Govt out by voting against them.

    Just to be clear.. Are you talking about same H R Bharadwaj who as a law minister

    1) Allowed the cases to be ped against Mr. Q and that Mr. Q decamped with all money in his london bank account. (Heard that Mr. Massimo son of Mr. Q was in Bangalore as a pay back)
    2) Same Bharadwaj who allowed the cash for vote drama during the vote on nuclear deal
    3) Same Bharadwaj who sat quietly Bhuta Singh Governor of Bihar did what he did.

    I was really proud of Bharadwaj as a law minister for upholding the constitution so high that most of the laws were abused right underneath it

    "As a Law Minister I cannot pass a value judgment...' something to check if there were any criteria to be a law minister!? / The credibility of a law minister. What certainly Moily is learned is to speak and retain a good mannerism and escape from issues to give a good image to the public. Done well. I don’t think the governor would have acted this way without the support from the LAW minister. At least he wouldn’t have dictated the speaker on what he has to do when he himself know he has no authority on speaker with his jobs as he is the supreme on the chair in parliament. If public still believe Governor was honest and ethically correct then it is called perception and not reality.

    People should decide who is right - as long as these people are from Congress Party. Is this what he meant? Speaker copied what Congress speaker did in Maharashtra for Vilasroa Deshmukh. Governor copied a number of governors in the past. Both exceeded their brief.

    Karanata isssue has become like One day cricket. Mr. Kumaraswamy thought he won the match only by spot fixing (instead of match fixing)and Third umpire(governer) declaring BJP is out when ground umpire (speaker) was supporting the playing team. After watching the replays Match refree (center) could not do any thing other than ordering for replay. At this time all spot fixed players were injured and JDS' good fielder was sitting in BJP bench, hence BJP is winning the one day thiller and Congress became only spectators.

There are people who criticise the Governor only because he is from Congress. As Mr. Shetty points out, is the Speaker right in his actions ?     If courts upholds the disqualification of all 16 MLA's, then BJP politicians can continue their development in resorts, squabbling over ministership. If court decides otherwise, it also proves that it is a political party, using unconstituional means to stay in power. The party should be barred for contesting election at least for next 5years.
    Then only political parties can learn lessons.

    There have been lot of talk going on in news channels as well as in public forums as to whether actions of Governor is right or wrong.

    In this case we have to analyse following events:

    If the actions taken by Speaker in the hush up manner in disqualifying the rebel BJP MLAs even before they defied the party whip are technically correct?

    Whether he can disqualify Independent MLAs at all?

    Even before the Disqualification Petition to speaker, meeting of police commissioner was called both by Chief Minister and Speaker, to discuss the actions to be taken on disqualified MLAs. So is this was preplanned and whether speaker was acting on orders from some unconstitutional authority?

    On the day of first floor test in the house, within 3 minutes or so the speaker could count the heads and gave the figure of 106 -0 even though BJP officially said that they have 105 MLAs support. So there is error in counting which is a gross mistake in such circumstances. Moreover Assembly was not in order as non MLAs were also present within the assembly hall.

    First two points may be decided in the court and hence even if Governor does not act no issues.

    But what about other two issues? Whether Governor has to just close his eyes or he has to uphold the constitution?

    Governor's decisions-are always open to different interpretations, by different people belonging to different parties. When power is misused blatatnly to subvert the very foundations & rules governing democracy by our vile politicians to their advantage, as in this case BJP misused the provisions of 10th schedule & speaker's office, which is undemocratic in principle.

    But they always accuse others when their actions are questioned by any authority or media. Here nobody is on higher(moral) ground or have moral right to question others authority as everything that happened in past fortnight is against democracy & all moral principles are trampled by all.

    Taking sides & defending our politicians misdeeds & corruption, at all level is not befitting to us common people-Enough is Enough-let us get together & teach all the politicians of all the parties we didn't vote them to take us for a ride.

    Dear Vijay Shetty (Gulvady/Dubai)I am neutral with regard to any political party as rightly said by one Kerala Bishop that Congress is lesser evil than BJP, which means that all political parties are evil to some extent and we should support the right candidate regardless of the political party.

    Moily has spoken very sensibly and with maturity and you must respect it and proud being from Dakshina Kannada. No petition has been filed in the High Court regarding confidence motion, rather 16 MLA's approached the Court for staying their suspension in the interim and overruling the suspension, Court rejected the stay petition however has adjouned the hearing with regard to suspension and will dispose on Monday 18th, which will ultimately decide the fate of Yeddyurappa.

    People???? Is congress ready to listen to the people? How many times the people of Karnataka need to decide Moily Saab? Media, constitutional experts and opinion polls already expressed their opinions. High court also ruled out the petition for staying confidence vote motion making clear that speaker's decision was right. You are a congressman and you need to support the governor otherwise you will be sent to some other state as governor. I think you learnt a lot from the mistakes of Bharadwaj who was a law minister in the last govt.

    I thought Moilly is discussing about next govt in Karnataka along with Sidhu n HDK. Governer is absolutely right what ever he did. Hence the 1st trust vote was not done in proper way, he asked for 2nd trust. After the court judgement again he will ask for the 3rd n final one. Instead of president rule n new election, better trust votes every month. All eyes will be on the High court judge tomorrow.

    Off course Mr. Moily you with your stooge Governor interfering the democratically elected Govt. Do not play with words which suites you. People clearly know your games and will choose the right persons. Better concentrate on the jobs that are allotted to you. Cases are piling up in the courts and Judges are influenced politically.
