NCB drugs case: Special Court rejects bail plea of Aryan Khan, 2 others

Mumbai, Oct 20 (IANS): In a huge jolt, a Mumbai Special NDPS Court on Wednesday rejected the bail plea of Aryan Khan -- the son of Bollywood superstar Shah Rukh Khan -- and two others, in the rave party raid case aboard a cruise ship on October 2.

The court also declined the bail applications of Arbaaz Merchant and Munmun Dhamecha, the two accused in the drug case lodged by Narcotics Control Bureau (NCB).

Khan's lawyer said that though the detailed order of Special Judge V.V. Patil is awaited, "they plan to appeal to the Bombay High Court today or tomorrow seeking bail".

Khan, Merchant and Dhamecha, along with five others were detained on October 2, and placed under arrest on October 3 after the NCB raid on the ship preparing to sail for a Mumbai-Goa cruise.

Initially, the Additional Chief Metropolitan Magistrate R.M. Nerlikar had sent them to a day's custody which was later extended till October 7, and later sent to judicial custody for 14 days, and transferred the case to the Special NDPS Court.

Later, their lawyers moved the Special Court for bail which was rejected after several days of hearing in which the NDPS' counsel Additional Solicitor-General Anil Singh vehemently opposed bail for the accused.

Among other things, the NDPS accused Aryan of being a regular consumer of drugs, dealing in narcotics with international links, etc., which was opposed by his teams of lawyers, and the other co-accused.

A total of 20 persons, including a foreigner, have been arrested in the sensational cruise ship raid.

    Technically and legally speaking as per NCB’ own report aryan was not in possession of any drugs. They didn’t find any drug from him. And also as per medical report submitted by the NCB in court, he didn’t consume any drugs. There no offence established yet. Now some total 30 grams of charas and ganja which are considered to be the mildest form of drugs against 3000 kgs of heroine, one of the hardest form of drg, which is a serious offence? As per Vidhi legal report 99.99% of drug cases are individual end user cases. No suppliers are ever arrested. That is the reason there is on an average 30% rise in drug consumption in India every year. Check the government data on narcotics cases available on their portal.

    Rule of Law v/s Rule by Law -- It appears ruling dispensation is now going by Rule by law - Elgar Parishad /Bhima Koregaon - professors - students in other cases -- activists all not getting bail - As explained by the lawyer no tests conducted till now on Aryan Khan to prove drug intake and various holes in investigation - why a BJP affiliated private detective was holding and running on first day into NCB office-- with ARYAN -- THIS IS NOT TO DEFEND BUT UNFORTUNATELY SO MANY HOLES WILL MAKE PUBLIC SCEPTICAL - Why go all into high seas drama for an oridinary arrest - so much of publicity -- yet we don't have concrete on anything --atleast in public domain -- on ARYAN --

    Pre-planned conspiracy by BJP. Misuse of power and public institutions for not throwing Hafta at BJP and not being thier blind bhakth. No evidence of drugs found in Khan’s possession. BJP activists were involved in raid. Whereas in UP Lakimpur Kheri terror against farmers, BJP minister’s involvement is clearly recorded in the video yet it is been dragged at the behest of BJP high command with frequent set backs. It’s impossible to get justice to an ordinary innocent person in Goonda Raj rule?????……

    A shivasena MLA has confirmed that this is revenge taken on Shah Rukh Khan by wife of some NCB officer for not giving her role in his next film...it seems highly likely as they did not find any drugs in Aryan's possession...

    If Rahul Gandhi was caught on drug case in the US why wasn’t he jailed in the US without bail and parole??????……In US there are no two laws one for opposition one for ruling govt and no Nagpur constitution.
