No Death for Dara Singh in Staines Case, SC Upholds Life Term

New Delhi, Jan 21 (PTI): In a setback to CBI, the Supreme Court on Friday dismissed its plea for death penalty to Dara Singh, convicted for burning alive Australian missionary Graham Staines and his two minor sons in January 1999 while upholding life sentence given to him by the Orissa High Court.

A bench comprising Justices P Sathasivam and B S Chauhan, while dismissing the agency's plea for death penalty, said the punishment can be imposed only in the "rarest of rare" cases depending upon the facts and situation of each case.

In the present case, the apex court said, the offence committed by the convicts, though highly condemnable, does not fall in the category of rarest of rare to warrant death sentence.

Dara Singh and Mahendra Hembrom were found guilty of burning to death Staines and his sons, who were sleeping inside a van outside a church, at Manoharpur village in Koenjhar district of Orissa on January 22, 1999.

The bench had on December 15 last year reserved its judgement after hearing at length the arguments of CBI's counsel and Additional Solicitor General Vivek Tankha and counsel for the convicts.

Senior counsel K T S Tulsi and Ratnakar Dash, besides counsel Sibo Shankara Mishra, appeared for the 12 convicts.

Appearing for CBI, Tankha had told the bench that Dara Singh deserves death sentence as the murders were committed in a most "diabolic and dastardly manner" which warranted exemplary punishment.

Dara had filed an appeal challenging his conviction and the life sentence awarded to him. The appeals were admitted by the apex court in October 2005.

On May 19, 2005, the Orissa High Court had commuted to life imprisonment the death penalty imposed by the sessions court on Dara Singh for the murder of Staines and his two minor sons -- Philip, 10, and Timothy, 6. Along with Dara, another person Mahendra Hembram was convicted in the case.

However, the High Court had acquitted 11 others who were awarded life terms by the trial court in the case.

The trial court in Khurda had in September 2003 convicted all the 13 accused. While Dara Singh was awarded death sentence, others were given life imprisonment.

    Shame to the Judiciary for the remarks against Staines that Darasiggh killed him because he was converting tribals. It is a fore runner to the anti cinversion bill. Kudos to The Hindu, Mr Ram and other great Journalist who have condemned this judgement.

    The fact is that one has no right to kill any innocent person in the name of religion. So THis is a tragic and inhuman act by kiiling the innocents and must be punished. Another fact is that By firgiving such inhuman murderer by Mrs. Staines is greater than the humanity. It is very difficult to forgive such a person but she followed God's ways and forgiven the culprit which the living example by a Christian who followed Jesus foot steps in her life by giving living example to all humanity. Even Jesus our lord forgave the people those who killed him and He ressurected from the Tomb. He is a loving God and living amongst us. So God will surely look from above and change this prson one who killed this missionery and sons he will repent and change his attitude life and he may start a good life and good works. God is merciful and kind those who repent. Let us pray so that such act many not repeat and let us live in harmony and crime less soceity so that everyone live in peace.

    Dear Ismail P, I understand your anxiety. Here i didnot mean that it is not the rarest of the rare case. In my opinion it is, but the Meaning of my words are -God is the creator and he is the ultimate deciding factor of every human being. He knows what to be done and what not to be done. It is not impossible for God to turn dara singh's heart for better. God has given him one more chance to think about his own life and mistake. The judiciary has done better than doing worse. i suppose i have clarified you.

    People who destroy social Harmony by breaking families in the name of religion. Priests of all religions who use Goons/Anti National elements to eliminate thir adverseries should all be given the death penalty alongwith Dara Singh.

    The people who have commited the crime were awarded death sentence the very second... Even though they might breathe and talk .. They will never be able to Laugh in life cause they know that they have committed a grave sin , by burning and killing someones son , Husband and Father . No matter what the law of India or world says , but the Jurdgement of God is the ultimatum!!!

    I read the story of a person
    who killed a Nun from Kerala in
    north India, who was working with the socially discarded section of
    the society. She stood against
    the exploitation of the landlords,
    and they hired a killer to kill
    the Nun.

    His life was totally touched by
    the forgiveness displayed by her
    family, and the murder became a
    Christian missionary now. With
    God, all things are possible.

    When Dara Singh is changed by the
    love of Christ, can we imagine
    the impact he can create!

    I AM NOT HAPPY ABOUT THIS DECISION.CULPRITS SHOULD HAVE BEEN GIVEN MUCH WORST PUNISHMENT SO THAT NO ONE WILL DO SUCH CRIME AGAIN. May be GOD has some special plan or else how such a crime burning alive the people that too 2 small innocent children cannot be considered as rarest of the rare? May GOD shower his blessings on Mrs Staines and her only daughter who are still continuing the good works of Mr Staines in Orissa...

Who cares Dara and his gang.Judges is your judgement wright? Make it most comman case and wave off every thing.There are evidences in history to say it is most common elsewhere.

    Though, I am not in favour of the death sentance to Dara Singh, not even a life sentance, but release all of them immidiately, since the wife of Staines, has forgiven them, I dont agree with the SC statement, which says,

    the offence committed by the convicts, though highly condemnable, does not fall in the category of rarest of rare to warrant death sentence.

    If, burning alive, three persons, which includes 2 minor children, is not rarest of the rare cases, then what Will.??? .

    If Dara Singh and his group had spared the life the 2 children, but burned only Graham Staines, for what ever wrong, Dara Singh might have thought, he committed, then I agree, it would not be a rarest of the rare cases of Murder.

    It was not ,is not and will not be a rarest of the rare case BUT a common of the very common case and
    does not invite any punishment
