Poverty, not Pleasure, Forces Women into Prostitution: Court


New Delhi, Feb 14, (IANS): The Supreme Court Monday said it was because of ''abject poverty'' and not for ''pleasure'' that a woman is compelled to indulge in prostitution. It also ordered formulation of rehabilitation schemes for sex workers. 

“If such a woman is granted opportunity to avail some technical and vocational training, she would be able to earn her livelihood by such vocational training and skill instead by selling her body," said the apex court bench of Justice Markandey Katju and Justice Gyan Sudha Misra.

While dismissing an appeal by Budhadev Karmaskar against his life sentence for killing a sex worker, the court said: “Sex workers are also human beings and no one has a right to assault or murder them.” 

Karmaskar “committed the murder in a brutal manner of a helpless woman and deserves no sympathy from this court”, the bench said. The “society must have sympathy towards the sex workers and must not look down upon them. They are also entitled to life of dignity in view of the Article 21 of the constitution and their problems also need to be addressed,” the judges said.

The court order referred to noted writers, including Sarat Chandra Chattopadhyay, Russian novelist Dostoevsky’s novel "Crime and Punishment", Urdu poet Sahir Ludhianvi and also referred to Amrapali, the legendary courtesan who was a contemporary of Lord Buddha.

In the novels of these writers, the court said, sex workers were shown to be of very high character who sacrificed their body to earn some bread for their improvised families. The court directed the central and state governments to prepare schemes for giving technical and vocational training to sex workers and sexually abused women.

The court said the schemes should also include the marketing of the products that would be produced by the rehabilitated sex workers. In the absence of such an arrangement, things would get back to the square one as they would not be able to feed themselves.

The schemes, the court said, should mention in detail who would give technical and vocational training and in what manner they would be rehabilitated and settled by offering them employment.

The court issued notice to the central and state governments asking them to file response stating the steps taken by them on its directions.  The case would come up for hearing May 4.

    As everybody in this materialize world try to get richer and richer, many people who lose the fight can get poorer and poorer. This is the law of materialism.
    So the answer is including us, who gain money as they lose money (it's zero sum game).
    The answer is including themself also. Because they don't have enough potential to be rich.
    But these things happens naturally. Like yin and yang, days and nights, black and white, rich and poor. So don't think about living poorer for other people to get richer.
    What we can do is to help the poor as we can.
    In India main causes for poverty are Over Population, No or Less education, Religious Blind believes, Jealous, Revenge, Cheating in Tax, Cheating in food distribution, and rapes. Even Political leaders, oficers, and rich people are involved in many cases of abuse the females.

    I think there are two things here 1. the need to prostitute 2. driven to prostitute. I think the second one is the worst. The first is an option to make some quick money as sex sells. As long as the individual is an adult and following the rules there should not be an issue. However the second one is sad. Plain simply economic situation drives this. Education and employement can eliminate this problem.

    Guys, it’s we who make them prostitutes, not poverty or any type of force. If we treat those girls as our sisters and help those in their needs there won’t be a single prostitute. Everyone wants to have pleasure without respecting feelings of needy. We are ready to spend in lacks for our lust we are ready to pay them money for their body but won’t help them without any lustful desire. So blame ourselves guys, we are spoiling them, nobody else. Accept it or leave it. On road, in office, in neighborhood everywhere we rape them physically or through our lustful eyes. If we donate 1 percent of our income there wont be any poor or no any prostitute.

No Government can eliminate it .Better legalise it and take care of prostitues with good medical help who in return will take care of customers.Otherwise ,AIDS will wipe out world before we wipe out prostitutes.     It was told that some of the prostitution dens are regular homes filled with their family members & children in a shanty one room house with a shady curtained corner or tiny room for their flesh-trade. In between their customer’s visits they cook their daily food, sweep/swab the house, breast feed their babies, feed their young ones etc. They just shut their mind and give-in to meet their daily expenses. Sometime they take drugs to shut their mind and they are mostly emotionless.

    Is it the only way for poor girls to earn money or to feed their poor family. I totally disagree with this,there are many ways to earn money but reality is they dont want this job for many reasons, like : low salary,low dignity etc etc.If we have real burden of our poor family we should accept these kind of jobs like low salries etc etc. I agree in some work places girls sexually abused but not everywhere. Iam against these people who abuse innocent girls, but it should not encourage girls to take any bad decisions or to take steps like prostitution.
    These girls become prostitues to feed their one family but they destroy many families behind them.So I request such grils if ur going through any poverty u can work in any part of the world safely,if u feel any insecure or abuse my ur coll'gues. There are Laws to prevent you,if they dont act there are many groups & human rights to help you.

    How easy for us to point our fingers at others and call them prostitutes!Has anyone try to find out the financial problems they go through, Last week one lady met me and asked for little help for her kids school fees, I was angry and misunderstood her, later evening i went to school and found the real problem,

    The Nuns told me her story, I paid the fees for her kids,I was in tears in my car while driving.This lady who's husband is drunk all the time and left them alone and this woman was forced into Bad acts in order to provide, No one helped her, instead they wanted her to have sex and take Money..

    Today I treat this woman as my family and my sister,please help someone today change their life.and see the difference it makes.My wife and me saw the world in the eyes of the poor for the first time, it was eye opener for me.Our children will learn some thing good out of us..if we follow and help the needy instead of talking Bad about them and hurting them

    Prostitution starts from the days of 'MOGHULS'..who are having more than one thousand wives kept in 'kotas' which are still prevailing in lucknow/hyderabad/mumbai/kashmir and also in our ancestral land in pakistan called 'hira mandi'...For there livelyhood these people nowadays jumped from 'mujras' to prostitution.. nawabs gone..but left us these things..(inhee logo ne) are continuing by other peoples..Jai Ho..

    It is a good observation by the court but the same court protects culprits by delaying the process
    and punishment dueto petty reasons. To be precise Rathoad case no shakti came forward to pressurise justice to the family.

    But for Men, it is PLEASURE AND NOT POVERTY, that makes them convert their
    sisters/daughters/wives/mothers into prostitutes, and owe unto them.

    In my opinion the people quoted by Ram, Mangalore are prostitutes of the Nation, and not the women who do it out of poverty. And what can be said about the Govt, on whom the country had placed the trust, are blind towards scams afer scams just to protect their power.

    It is true as Ram said, India is One of the biggest corrupt Democratic system today we can see...!!!???

    The main reason for the POVERTY today in India is non other than BAD, DIRTY AND CORRUPT POLITICAL SYSTEM of India.

    The Law makers are the Law breakers. Below Poverty Line people of India are just ignored by every Political parties.
