Mangaluru: POCSO accused acquitted after DNA report turns negative

Mangaluru, May 15: The court here acquitted a man accused of sexually assaulting minor girl, as the DNA report proved that there is no relation between the child that was given birth by the minor girl and the accused man.

Akshath, who was facing the accusation of sexual assault and impregnating minor girl, was acquitted by the second additional FSTC district sessions court.

In the complaint, it was accused that accused Akshath had approached the minor girl in 2019, when she was alone at home of Ashokanagara in Dharmasthala, on the pretext of asking hair setting machine and had sexual intercourse with her. Later also he had physical intimacy with the minor girl several times and this resulted in the minor girl getting pregnant. A case under POCSO, IPC 376 was registered against the accused.

Justice Radhakrishna, who conducted inquiry of the case said that the accused is released as the DNA report confirms that he is not the father of the child given birth by the minor.

S P Chengappa, Vijay Mahantesh and Rahiyana argued for the accused.

    Prosecutors Chengappa, Mahantesh and Rahiyana need to find our the real culprit and make arrangements for the torture Akshath underwent all this time. POSCO needs to pay one crore for overenthusiasm in trying to convict a wrong person. I don't say Akshath is innocent. But 17 year old also needs to change her way of life. Let her give the list of all those she was intimate with. It cannot be her personal freedom as she has tried to convict a wrong man.

    May be girl tried to protect her real friend and blamed innocent. I am just thinking, if it was in another state, he would have been killed in encounter and people would have praised police for their prompt action.

    Now the burden is on the victim minor girl to recall & give names of other possible accused...., and seek Court's direction for DNA test....!!!! come what may... Justice should be delivered..., may be it is appropriate for the Law keeping officers to give protection and support to the girl & obtain the list.
