Bengaluru: Rape case can be settled through compromise - High court

Bengaluru, Jun 2: The Karnataka high court has dismissed a case of rape contested by a woman against four members of a family and ruled that the complainant and the accused could reach a compromise and end the legal proceedings against rape.

A woman had on February 16, 2022 filed a complaint against Satish and charged him with rape and threat to life, insult and extortion against three others with the Byadarahalli police.

The court under the judge M Nagaprasanna heard the case against the accused K Satish, Srinivas, Kokila and Mamatha, residents of Byadarahalli in Bengaluru after all the four had moved the court to annul the legal proceedings.

The judge ruled that the matter should be sorted out through a compromise.

The public prosecutor pleaded that a case of rape should not be treated lightly and appealed to the court not to allow a compromise.

The lawyer on behalf of the accused however, quoted several judgments passed by the Supreme Court and other courts that allowed for compromise to be reached between the accused and the victim to which the court agreed.

    I have never heard any court in any country to suggest that a criminal charge of rape can be compromised! If that were allowed, men will behave like dogs... go after all the bitches. ... What a state! Even in war, soldiers who commit rape are guilty of international war crime. I am positive, the Supreme Court will have something to say about the Karnataka High Court judgement

    Once upon a time Karnataka means people with progressive thinking and wisdom. These days this state become a laughing stock and most intolerant in entire India. Even the judiciary giving verdicts which not at all suits their judgement capability. All institutions behave like RSS guided brains. Pathetic

    Ridiculously pathetic, coming from the Honourable High Court. Can Rape be compared to a minor traffic accident which can be compromised by two parties ? What about the life long trauma the rape victim has to go through ? If a family member of the court officials was a victim of rape, would they agree to settle for a compromise , as thy have directed or drag the culprit and give him the maximum punishment ? This will only give way to rich people taking advantage , as they can now get away with rape by paying the victim, with a take-it-or-leave it attitude.

    @ Sanjay, Hebri, Blood Money (Diya) is only if a person causes the death or injury of a person (whether accidentally or intentionally), that person must pay the victim's family so called 'blood money'. The victim or his family reserves the right to decline the 'blood money' and seek punishment for the accused. Blood Money is not for Rape. Open your eyes!

    Most preposterous -- can we have rape by consent- -- or the complainant has falsely charged -- this also a crime -- (Amber Heard has to pay -- JOHNNY DEPP -- 0--- problem is these days --well read judges possibly are lacking -- (we do not have blood money law system -- -- as practiced possibly some countries -- )--
