Delhi HC asks Centre not to back NSFs till they comply with National Sports Code

New Delhi, Jun 3 (IANS): The Delhi High Court on Friday directed the Centre not to resume financial and other support to National Sports Federations (NSFs) till they comply with National Sports Code, 2011 and judicial orders.

However, the bench of Justice Najmi Waziri and Justice Vikas Mahajan asked the government to ensure the assistance provided to sportspersons through the Sports Authority of India whenever it is necessary.

The compliance of the Sports Code by NSFs is expected to be completed by the end of this month, the court said, adding those non-compliant in this regard will have a suspension of their recognition.

Last week, the high court had directed Sports Secretary in the Ministry of Youth Affairs and Sports to ensure complete compliance with the National Sports Code and derecognise those NSFs which are in violation of the code.

The bench was dealing with the plea moved by advocate Rahul Mehra, who sought compliance by NSFs with the Sports Code and orders passed by the courts.

In the last hearing also, the HC had directed the Sports Secretary to withdraw financial and all other kinds of support to all the NSFs which are in violation of the National Sports Code.

"Let Secretary, Ministry of Youth Affairs and Sports, Government of India ensure that the constitution of NSFs concerned with Gymnastics, Handball, National Yogasana, Tennis, Volleyball, Mallkhamb, and Motor Sports as well as Equestrian, Rowing, Golf, Squash Racquets, Yachting, Polo is made available by them to the Ministry by the coming Monday. The same will be examined preferably during the course of the week and to the extent that they are not in compliance with the Sports Code, directions/notice shall be issued an apropos suspension of their recognition. An affidavit in this regard shall be filed by a Joint Secretary in the said Ministry with the prior approval of the Sports Secretary," said the earlier order dated May 26.
