Bengaluru, Aug 30: A three-judge bench comprising of Justices Indira Banerjee, A S Oka and M M Sundresh has quashed the Karnataka High Court order granting permission to the state government to consider the application for use of the Idgah Maidan in Chamarajpet for holding religious activities particularly Ganesh Chaturthi celebrations for a limited period from August 31.

This implies that no Ganesh Chaturthi festival will be celebrated at the Idgah maidan in Chamarajpet on Wednesday, August 31.

The Supreme Cour has ordered status quo by both sides as of August 30 while hearing pleas in the Bengaluru Eidgah maidan case

Earlier today, the Supreme Court heard a plea against the Karnataka HC order by the Karnataka Waqf Board allowing the state government to hold relegious events on the currently disputed ground.

The matter was then referred to the three-judge bench of Justices Indira Banerjee, AS Oka and M M Sundresh citing difference of opinion among the two judges hearing the case earlier.

Senior advocate Kapil Sibal argued before the court that the Karnataka HC's order is in violation of the 1964 order passed by the Supreme Court. Responding to the court's question about whether any other religious festival has been celebrated at the said maidan ever, Sibal noted that 'no religious function has been conducted on the land since 200 years.'

Sibal also argued the Karnataka HC's order might change the "character of the maidan" and that a "nod to the pooja at the maidan might hurt communal harmony."

"What is your apprehension regarding? Is it only for one particular festival that is to be celebrated at the maidan tomorrow or regarding permission for all festivals to be celebrated at the maidan?," the bench asked the Waqf side. In response, Sibal reiterated that "no other religious festival should be allowed except what we are allowed to do."

1600-odd police force deployed at Maidan

Meanwhile, as a precautionary measure, about 1600 police personnel deployed in and around Idgah Maidan. Security has been beefed up here to prevent any untoward incidents on the day of Ganesha Chaturthi.

    Supreme court has told that the status quo be maintained until title case is diposed. . Is secularism a one way street? why waqf went to supreme court as it would be only a one day event?. once the case is diposed, Ganesh Chaturthi will definitely be celebrated there.

    Needless politics.. Idgah ..becoming the greatest issue .. Bangalore is drowning .. ..drowning us All ok ..many layout s... Because of trust deficit .. political chicanery .. vested interests who like to inflame .. Keep political pot boiling .. otherwise no real achievements...ruling dispensation.... —————— It is nevertheless clear Muslims and leaders would have been magnanimous among their matured elders to give for 2 days for celebration of a major Hindu festival .... Idgah Maidan ... But knowing that it is not as simple and as already said trust deficit this issue going on ... It is also clear only for mischief this issue of wanting the grounds as though there is no other place in Bangalore ... So Lord Ganesha known for removal of obstacles .. Pray for no obstacles among communities..

    The High Court had earlier said the government could give permissions, but the waqf board went to the Supreme Court, arguing no other religious festivals have been held there "for 200 years". The court's three-judge bench thus ordered "status quo as of today" at the 2.5-acre ground. During the hearing, the state's lawyer asked for "a government-managed temple" to be allowed for two days, saying "no permanent structure will be built". At this, the board's lawyer shot back, "The then CM of UP also gave an assurance, in the Babri Masjid case. You know what happened there," referring to the 1992 demolition of the mosque, in place of which a Ram Temple is now coming up after a Supreme Court judgment.

    Bangalore Municipality claims that though they are not the owners on paper, it is implied by default, the maidan belongs to them. On the other hand, Wakf board claims the maidan land belongs to them. Under such circumstances, the learned judges have given a right judgement. The justice prevailed.
