"these passengers were indifferent and careless in their reply" means that when TC asked for "special discounted penalty" the travellers would not have agreed to pay. There are hundreds of travellers who travel without tickets everyday, but this is all legal if you are ready to pay a small fee.

Ticket less travel on a train illegal. But it becomes a crime when you misbehave with a ticket officer when he asks for your tickets.
