Bangalore: Another Setback for Yeddyurappa: HC Rejects Plea to Quash FIR

Bangalore, Aug 26: In yet another setback to the former Karnataka Chief Minister B S Yeddyurappa, the State High Court’s Division Bench rejected his plea for quashing the FIR lodged by the Lokayukta police on a private complaint on the alleged irregularities in the award of contracts for Upper Bhadra Irrigation Project work.

The Division Bench comprising Mr Justice K L Manjunath and Mr Justice H S Kempanna, in their order on Yeddyurappa’s petition for quashing the FIR lodged by the Lokayukta police on the private complaint filed by State JD(S) General Secretary and spokesman Y S Y Datta, MLC.

The complaint was filed in the Lokayukta court, which later ordered a probe on August 8. Subsequently an FIR was filed by Lokyukta police on Aug 10.

Senior advocate of Supreme Court, U U Lalit, who appeared on behalf of the former Chief Minister, had in his petition challenged the complaint and order of reference by Special Lokayukta Judge N K Sudhindhra Rao under Sec 156(3) of CrPC (initiating criminal proceedings) on the ground that the Judge was not a magistrate and therefore lacked the necessary jurisdiction to take cognisance of the complaint.

''The complaint has to be taken cognisance and referred to under Sec 202 of CrPC, which is nothing but collection of evidence,” he submitted.

The Senior Counsel had argued that the lower court had exceeded its jurisdiction and therefore the FIR by the Lokayukta police would have to be dropped.

But the High Court ruled there was no merit in this argument and held that the Special Judge had power to refer to refer the complaint filed before it for investigation to Lokayukta police under Sec 156(3) of the CrPC by virtue of the powers vested in him to receive a private complaint and take cognizance.

''The special judge enjoys all powers of criminal jurisdiction, except those specifically denied,” the High Court Division Bench contended.

    What happens to the Yeddi's picutres on 108 Ambulances???
    First of all who has given him the right to put his pictures on the vehicles?? It's the tax payers money used to buy these ambulances and puts his pictures on them. This is a wrong practice in India, Any scheme introduced has either Rajiv Ghandhi or Karunanidhi or Mayavati or Laloo!!!
    Why is this????

    though iam a bjp support i donot want to support any corrupt leader.we must also keep in mind the rigt person to be put behind bars is manmohan singh,as he is the leader of many accused like raja,maran,kamadi and many more who has looted this countrys wealth,though he is a leader,he says he knows nothing,then why he should continue as leader it is shameful.at the same time no respect left for yeddy or reddy

    I still remember police beating poor farmers, their mistake is farmers want to meet Yeddy when he his CM 3 days they are waiting to meet cm, but he did not meet farmers. Farmers badly injured many of them woman and old people.
    We are eating food because of poor farmers. We have give to respect, we have to help farmers. If don’t know this simple logic. Then ur a waste.
    if u come out and said to police to stop beating farmers, police will stop immediately.
    Now it is ur turn - we want to see ur beautiful photo inside the jail.
    Thank u God for punishing bad people.
    All bad people remember u will get punishment from God. So kindly corrupt politician and corrupt officer work for needy people, some where people will bless u, we poor people don’t. want money, we just want peace – love.

    Masty time is over. Power is gone too. Thanks to BJP factions supporting Anna desperately! Now anybody offring discount to Yeddy for cash or kind return will be under the scanner. Nobody wants problem if new lokpal bill is strictly implimented!! Yeddiji has resigned during most difficult time. In the sence, whole nation wants to get rid of Coorruption.
    Best alternative for Yeddiji is to sit back and relax. Enjoy the returns of past karma.

    When 'power less' nobody show any mercy or owns Yeddy.He might not anticipated such kind series court verdict against him.Certainly BJP Karnataka going to loose it's credebilty once Yeddy joins Katta & son in PARAPANA AGRAHARA.By the by how Halappa not went to jail so far yet facing a serious rape charges?After Eddy ,Reddy will foolow the suit and............finally may Shobakka...What a TAMASHA of BJP party.

    Eddy should surrender to the police and go for court arrest if he is clean.He is downgrading not only himself but also the entire party supporters.He should resign from the party and fight the legal battle on his own then only he can prove the state that he was innocent.
