Anna should Not Dictate Terms to Parliament: Santosh Hegde

Bangalore, Aug 26 (IANS): Signalling a further rift with Team Anna, former Supreme Court judge and civil society member Justice N. Santosh Hegde Friday said Anna Hazare should refrain from dictating terms to parliament to pass a resolution on the three conditions he has set for calling off his 11-day-old fast.

"It is not fair to impose conditions on a democratic institution like parliament on a crucial issue like the Lokpal bill. Hazare's demand that his dictum should be accepted by parliament is demeaning," Hegde told reporters at the Freedom Park in the city centre where hundreds of activists and supporters of the anti-graft movement are staging a protest demonstration and fasting.

Noting that he no longer felt being a part of 'Team Anna' as the developments in the last 24 hours were aggravating the situation and leading to show of strength between the civil society and the government, Hegde said serving an ultimatum to parliament was not the way to fight graft as it would set a dangerous precedent.

"Telling parliament what to do within a timeframe is not the way to go about. As I believe in democratic principles, it is difficult to justify Hazare's terms for ending the fast. We should allow the democratic process to prevail," Hegde asserted.

Hegde was member of the joint panel which drafted the Lokpal bill that was referred to the standing committee after its modified version was introduced in the Lok Sabha early this month.

Reiterating his appeal to Hazare to end his fast as the latter's health and wellbeing was more important, the former Karnataka Lokayukta (ombudsman) said enacting the Lokpal bill would only be a beginning and the struggle against corruption would have to be continued till the entire system was cleansed.

"As Hazare's health is a matter of concern for all, he should end the fast immediately but carry on with the agitation to ensure that the government and lawmakers unanimously pass the Lokpal bill into an Act during this session itself in accordance with the rules of the house," Hegde added.

    Fight for corruption by Anna is ok as there is lot of corruption in india as well as gundaism. but His way of functioning is not ok as any slippage can give rise to riots as political parties can/will take due advatage. Anna cannot be compred to gandhiji at all. Taking support of communal parties for any cause is not at all acceptble. For killing one bird we cannot kill all birds. oppositins In past in centre has supported janata govts but at the right time to topple these govts they had given encouragements for the various strikes and eventually their cause of toppling was successful .Many expms including vp singh were victims of these topplings.

    The govt doesnt have politicial will to pass an anti corruption law,. The bill has been pending since last 40 years and so far govt didnt find it suitbale to pass the law. Now Hegde too should understand that when he was in his school days, this lokpall bill was introduced and nothing has been done till date. Do we require 40 long years to debate and pass the bill.. Is it not a mockery of democracy mr Hegde. Hegde cud u please tell the readers why do you want to weaken the public demand. Just to do so how many crores you have been paid???? We need anti corruption bill and all corrupt ploiticians and members of public need to be punished. If I am corrupt i deserve punishment. These thugs have looted our country and hoarded money outside our country... No eithics. We need electoral reforms. People above 65 should not be allowed to contest election. Minimum qualification should be graduation and maximum term for one candidate should not exceed two terms and there should be only two political parties. We should have the right to recall our elected representiative should they fail to deliver or prosecuted or indicted in any anti national or criminal activities, This is our next agenda and we shall prevail...

    Arvind Kejriwal, Prashant Bhushan and Kiran Bedi are making an innocent Anna Hazare a puppet.
    If they have a problem with the current government let them fight elections and prove their point.
    We need to have another bill to find out who is funding these people and what are their motives?

    If anna stop fasting, parliment has enought time to turn the situation. They are very tactic on these such things, by creating another turmoiol to divert the people eye. Karnataka Lokayukta is backed by Central Govt. to held up Karnataka Govt. scandals for their own benifit. Now surely ex Lokayukta chief insisting to end fast. Hegde point through Parliment, but the who ever there in Parliment is cunning politicians. There are many imortant people like TN Sheshan have requested to advise these 'foolish' advise backed by parlimentarians, these we are all should think.

    From the begining itself Annaji is insisting for a strong Lokapal Bill to be passed by the Parliament. He is always firm on his stand.

    Then why Santhosh Hegde is talking differently now.

    Why did he invite Chandre Gowda and other politicians to the Freedom Park.

    Santhosh Hegde is among the products of present system and gained prominence only because he became the Lokayuktha.

    Otherwise he would have been only a retired Supreme Court judge.

    We can not expect a total revolution from such people.

    On the otherhand, Annaji is a pure person [Mahathma] and has pledged his life selflessly for the welfare of the country and its common people.

    Annaji has the integrity to advise this corrupt parliamentarians to pass a strong Lokpal Bill.

    People should not listen to Hegde and such people and support Annaji whole heartedly.

    Sh. Anna Hazare should end his fast. The govt. and politicians are all deaf and beating round the bush. Only during elections they come to us with folded hands. They have no respect for people's voice and show don't care attitude. next time when people vote if not suitable candidate people should vote accordingly, 49-O is a rule in The Conduct of Elections Rules - 1961, which describes when a valid voter decides not to cast his vote in favour of any candidate a
    voter to reject all the candidates in the constituency if he does not find them suitable, so there will repolling till right candidate is ed.

NO ONE TOLD HIM TO FAST. HE IS FASTING WITH HIS OWN WILL AND NOW SETTING DEADLINE. WHAT HE IS SAYIG HAS TO BE DONE IS WRONG BECAUSE 3 PERSONS IN CIVIL SOCIETY ARE BACKING HIM LIKE KIRAN BEDI, KAEJRIWALA AND BUSHAN. THESE 3 CANNOT CHANGE THE CONSTITUTION ALONG WITH ANNA.     It is very important that this message went to Karnataka people and entire Nation through the words of Justice Santhosh hegde.It will create a positive impact on the people who were all these days mesmerized about UPA not approving the Lokpal bill. I think Hegde should also suggest the law making ministers and help them in drafting an effective law that can help people who can change the system.
    We should not forget that only the Lokpal bill or a new law cannot eradicate corruption unless we the people accept and commit on such anticorruption law.
    Are we ready or have patience to get the work done in any department at its own process with its own process .At a given situation of less staff in every government department including police force can we expect them to work like a robot to complete the work as prescribed in the legal system.
    1. Are we ready to file a complaint on a staff, officer or police who will be corrupt and at the same time he or she will be a friend of our close friend?
    2. Are we prepared to go ourselves to any government office without appointing an agent or proxy who speed up the process and pay bribes on our behalf?
    3. Are we ready to pay the service, stamp, registration, VAT and income tax by declaring the assets, property, and income actual?
    4. How can we expect the officers to complete the submitted process when it is clearly visible that the subject matter is either undervalued or wrongly d?
    5. Are we not partly responsible to induce even an honest officer to turn into a corrupt by offering cash or kind to approve and process a file, project or case that should go through its own process.
    If our answers for the above and for many points that we cannot out then we are really not ready for the lokpal bill and we are hypocrites if we say that we are with Anna.
    To conclude we need a bill which can help honest people to try and eradicate corruption. Because at present we do not have strong policy which can assist the people to take action against the corrupt system.

IT IS PEOPLE FOLLOWED IDEALOGIES OF GANDHIJI DURING INDEPENDENCE NOT KNOWING FULLY WELL WHAT IS WHAT LIKEWISE SATYAGRAHA IS THE BETTER WAY TO OUTST CORRUPTION THAN CREATING LAW AND ORDER PROBLEMS BY PROTEST.
    PARLIAMENT IS BY THE PEOPLE FOR THE PEOPLE AND TO THE PEOOPLE NEED TO BE MODIFIED FROM TIME TO TIME.

    Corruption cannot be removed by sweeng with broom. We have create institutions for the deterrance of corruption and punish the people who were found to be corrupt. There is a section 302 in IPC about the murder and punishment either for life or death. Inspite of this offence is committed. Regarding the corruption, the Parliament is only competant to make the law or amendment the constitution. The members are elected by the public. If they are not serving the people, the voters are responsible for that. To day situation is fluid one cannot stick to his own guns. Annas team should understand the gravity of the situation. Please do not criticise Justice Hegde. His work in Karnataka reflected to the nation.

    Its time everyone realised that this fight for corruption has gone too far away. The people who are too frustrated by corruption are all supporting anna blindly. The thing is that the same people are willing to pay any amout of bribe to get profits for themselves. In one particular international magazine I read one article, in which the journalist covering the anna's fast for the magazine hailed an auto from Ramleela grounds to the place where they parked their car. The auto driver says he fully supports anna's fight but at the end of journey demands some exhorbitant amount for their ride. The driver goes on to say that once the Jan Lokpal Bill is passed he will only take meter charge.

    It's the really sorry state of fight against corruption in India

    Once the Jan Lokpal bill passed then rightly Team Anna will demand that them being the pioneers of the Jan Lokpal, the lokpal will be anna and his team members. Then they may go on to behave like bulliying kids in schools who are afraid of none..

    Just like Dr hegde activist and author Arundhati Roy wrote in The Hindu newspaper that Hazare's Jan Lokpal is "a draconian, anti-corruption law" that would just add another unaccountable bureaucracy to the existing one — "two oligarchies instead of one".

    Parliament is supreme, so is the Life of Annajee is also supreme. Ever since independence and again since 1971, 1977, 1985, 1989, 1996, 1998, 2001, 2005 and in 2008 Jan Lokpal Bills is differed as a political game- trick. Lack of trust in the political system both Government and Opposition led Annaji to take extreme step to fast till end. Let us accept that our parliamentary democracy is flawed. Therefore, the argument that Anna Hazare is challenging the sanctity of Parliament is worthless because the "sanctity" of the citizens of this country is being also challenged by corruption in each and every govt. or non-govt. departments without being controlled by Jan Lokpal Bill. It is a pity that none of holding white color job are at the receiving end but only the ordinary poor civilians.

    Letting down Anna at this juncture is just like letting corruption to move on without being bothering sanctity of 12 days fasting by all of our grandfather, Anna who is fasting on behalf millions of Indians. Regret to say that non-stable people should not have been the part of Anna Team.

    There is no doubt that Santosh Hegde, Swami Agnivesh, T N Seshan, Ram Jethmalani, Somanath Chatterjee and scores of other people at that level who want Mr. Anna Hazare to give up his 11 day old fast are more knowledgeable about Lokpal/Janlokpal and Constitution than almost all of us who pass our comments in these columns. The UPA Govt has regretted its stupidity in arresting Anna Hazare and initiated an amicable solution by presenting 4 versions of Lokpal bill ( Govt,, Anna’s Team, Aruna Roy and Loksatta). Here, some opposition parties instead of coming to a consensus want to score some political points by attacking the Govt. and wasting precious time in the parliament.
    Anaa Hazare is a is a simple and honest man fighting for the right cause. But today, Kiran Bedi and Aravind Kejriwal have made him their prisoner at Ramlila Ground. During last 11 days Bedi and Kejriwal didn’t fast even for a single day. Food is served to all protesters (most of them are there for that reason) in plenty. Bedi has some scores to settle against Congress Party. She was denied the post of Police Commissioner of Delhi and later the post of CVC. She was an upright cop but when Anna was arrested she went to the extent of instigating the Delhi Police to revolt against the authority. So it is not unusual for the lady to stand by the side of fasting Anna and vigorously wave a large national flag which serves two purposes – food for TV cameras and some breeze for Anna.
    It has been reported in the press that Kejriwal is angry because he was not given the contract of Bhihar type experiment of registering RTI applications on phones to other states as well. So there is hidden agenda – to bring out the anger of middle class affected by corruption, divert the attention of innocent school going children, create mobocratic hysteria at the expense of Anna’s health and topple the elected Government with the help of some political parties. For them Janlokpal is secondary.

    Anna's good health is more important for all of us, but not for those dirty corrupted parliament members.Therefore,he must stop fasting immediately & take good care of his life to fight further.Sir,when years & years passed,there was no improvement/change in increasing price weekly/monthly for everything.When they dont know how to handle the Govt.responsibilites for the need of entire nation,then why the old rule is still existing.They got together & looted money in crores & crores.Is it written to do like this in any Indian Govt.rule or law.Now where is your High Court,Supreme Court Judges?What are they doing,only watching the good & bad news in TV. Do they need FIR from the public? Why can't they send those corrupted famous parliament members (male & female)immediately direct to Tihari Jail.Why they are not punished still, for sending Anna Saab to jail without any reason? The entire nation need good government without corruption.This is possible only if those barking dogs are kept permanent in jail.You have all the power to go ahead & do the right thing to help the whole nation.Please help us & not them.For years & years they ate good free food,enjoyed with all free facilities without spending money for anything.Now they deserve food & accommodation at Tihar jail(free)on permanent basis.

    If the Parliament is competent enough ( by the peope for the people, of the people ) your statement is acceptable. We have now reached such a road block, where people do not trust the system. The so called 'Democracy" is hijacked by politicians, bureaucrats, industrialists. The fundamental principle of democracy " Socio economical justice to all " is a dream.Untill unless the whole system is revived and made to work as pronounced in the constitution, we are making mockery of democracy.Peaceful revolution is the only answer and ANNA and his team are doing the same. We are not legal expert like you. We supported you in your fight against corruption. If you now change your stand, sorry we are not with you, as we are not ready to wait fir decades, to witness another upserge by the people, as another ANNA maynot take birth in near future.

    Justice Hegde expressed the real spirit of democracy>. The parliament should see the maximum happiness of maximum number of people. The prime minister and entire parliament members are prepared to debate the demand of Anna team, these people change frequently their attitude.These people threatening parliamentary democracy procedure which can not be accepted. This will lead to moral corruption.The dictatorial system should be stopped.What is acceptable to Anna team need not be acceptable to the entire country. There are other groups they also intend betterment and social welfare of the society but it is not acceptable.because they do not follow democratic principles.The desire of Sri Anna and our most sincere prime minister is to eradicate corruption. These two sincere people can contribute more to democracy and eradication of corruption. Kindly do not force these people deviate from the system of democracy which it self is part of moral corruption. The greatness of the prime minister is acceptable to all.Let us also honour the opinion of parliament and let democracy to prevail

    A wise stand and statement from a wise man.What I felt is also the same thing.Ultimately democracy of India must prevail as it is acknowledged by the world and looking @ us with a hope.India's democratic system is largest living democracy of the world and that should be maintained and safeguarded @ any cost.Justice Santhosh Hegde's timely statement @ this juncture is very crucial and valid.

    Thank God our dear Sanyosh Hegde realised the fact that Annagi is gone too far,though little is better than never.r. Sir, please advice your friends Mr. Kezrival, Mrs. Bedi.and the father n son duo the great Bushans,not to ill advice sri Annagi. These people are more interested in their own agenda, which our Annangi is kept in dark.They keep on changing the goal post, as the govt. agrees to their conditions one after the other. Hegdegi tell these guys that enough is enough.

    Santhosh Hegde himself told that, we cannot wait for 20 years for Parliament to pass the lokpal bill. Anna Hazare is saying samething, lokpal bill needs to be implemented immediately. Is Mr.Hegde changing his words every minute? or is media twisting his words?

    Probably you dont look at the corruption level in India. When Parliament/Government closes it eyes on increasing corruption in the country yoiu did not speak. Paliament, as guardians of Nation,try to difuse tension rather than finding ways and means to bring down corruption. Now the whole nation in anger. Until this time you were sleeping ? When Volcano erupts who can stop it? It is time,Government start thinking what needs to be done. Until such time, if you can do something, go ahead try to stop Anna Hazare or try what best you could do to save the Nation.

    Mr. Hegde the parliament is of the people. Its the people who count and not the superiority of the institution. Certainy, the process should be followed in good-faith and not to dodge or postpone the issue and that it what is happenning now. The PM and the Congress FOOLiticians are fooling the people, including yourself. You should be asking Anna nad not showing the rift between Anna team, this rift itself is a opprtune weapon to the Congress and UPA.

    thank god good sense has prevailed at least now. in a democratic setup, parliament is supreme and every citizen has a right to make know our aspirations in any form that is permitted in the constitution. but to set a time frame speaks of either arrogance or ignorance. i am sure there will be many more cracks in team anna and good sense will prevail on everyone. let us not make use of the goodness of anna for a few people's popularity
