Kundapur, Aug 29: It’s the miserable tale of Sudarshan Nayak, a native of Tekkatte, near here, who is employed as a jawan in Central Reserve Police Force (CRPF) and stationed in Manipur.

The apathy of the local administration has meant that he is unable to construct his house on a plot approved under military quota in his native village.  Nayak has not been able to fulfil his cherished dream of owning a house for more than ten years due to the hassles of the village council.

Sudarshan had approached the taluk panchayat court, district Magistrate’s court, and Kundapur Assistant Commissioner’s court since the orders that they had issued to grant a building license to Nayak had not been implemented by the gram panchayat which has been withholding the license disregarding the status of armed personnel.

Nayak had purchased a five cent housing plot under survey number 231 / 4 B (2) in Tekkatte village on June 17, 1999, under Karnataka Land Grants rule 18.  The housing plot lies besides a dirt road.  It’s been bought at a cost of Rs 5,000 per cent vide challan number 35 and the application for land conversion was made paying Rs 440.  The title deed has been issued in Nayak’s name.
He is the son of Janardhan and Rukmini Nayak, residing in Tekkatte, near here.  Nayak joined the armed forces after his II PUC in Tekkatte. He has been working with CRPF since the past 20 years.
 
Nayak served during the Godhra riots and has also bagged a commendation certificate from the United Kingdom for his duty as part of the peacekeeping force in Kosovo.  He has served in Tripura, Andhra Pradhesh, Mumbai, Secunderabad, and Chennai and presently serves in Manipur.  It’s indeed a pity that Nayak has not been issued a building license to construct his house.

Taluk Panchayat verdict:

The Taluk panchayat issued orders to Tekkatte gram panchayat to issue building license to Nayak on the basis of the High Court judgement.  It also instructed Tekkatte gram panchayat to revert within a week.  It sought and explanation from gram panchayat according to taluk panchayat chief executive officer.

No consensus:

The building license was not issued mainly because 10 gram panchayat members did not support the decision of gram panchayat development officer, president, and vice-president.

Panchayat Raj analyst and lawyer T B Shetty said that it’s a clear case disregarding the High Court judgement.  Tekkatte gram panchyat had a chance to clarify their stand on the case.

“I am miserable since I was not even treated as an Indian national.  I have purchased the housing plot and not encroached.  I am fed up of the mental torture caused by the gram panchayat.  Although, the courts have given judgement in my favour, the gram panchayat has been harassing me. I will continue my struggle till I get justice from gram panchayat,” added Nayak.

    Dear Sudarshan, rather than continuing the struggle without direction it is better to approach an able advocate and file a contempt petition against the authorities concerned and get justice from the court of law. Teach a lesson to all those involved in this issue. This is an example of argogancy of the authorities.

    Innocent man is harassed by tricky land laws. What I have endured all these years that I cannot purchase a small piece of land that is entitled as 'Agtricultural' just for the reason that I am not a farmer by inheritance. My motive is not building an apartment block but genuine agriculture. On the contrary, Yeddy has swallowed up 300 Acre of agricultural land and converted it into housing plots. Is the law for the convenience of politicians ? We have faced enough - we should come on the road and involve in mass protest !

    What land did the government give this loyal soldier if the case cannot be resolved by moving 3 courts? All the departments concerned are answerable to this Jawan.State and Union government too is party to this situation. If these officials are true let them bell these Taluk panchayat officials and haul them in court and send these miscreants permanently stay home.

    This is how they treat a military personnel and its very common in Karnataka, irrespective of the party which rules.

    When my father, an Ex-Serviceman was trying to build a house on the land purchased by him, the village panchayat secretary did try to find a way to get some bribe. He did not sanctioned the conversion of land from agriculture to non agriculture for a long time.

    It took sometime to get a stern warning letter from the Ex-Servicemen rehabilitation department to the village panchayat, but good six months were lost.

    The same happened with Department of Telecom, to move a telephone wire which was crossing through the site planed for home.

    If we won't pay bribe nothing works.

    But its possible to get the work done without paying bribe, but it takes a long time and struggle.

    That too a serving military personnel cannot get time to run behind these people as he is not posted at his native place.

    But we say Jai Javan Jai Kisan....but I think its now Die Javan, Die Kisan !!

    This is the fate of our Jawan, despite all documents why these 10 Panchayat members are harassing him? May be they are looking for money? Over to you Mr. Nagesh Nayak,may be BJP is ruling in Thekkatte Panchayat. I hope justice will be done, this brave soldier must have justice by all means, his dream of his own house should come true.     It quite interesting and amazing story between our JAWAN and Panchayath Members !!!Why those 10 members ganged against him is million dollar question!!!!.Keeping aside all difference of opinion, the concerned Panchayath Members grossly undermined the petitioner's status and for that they night be taken in to task.If GP's reason for not awarding license to build an house(basic need)is malicious, then Zilla Parishath has the right to supersede or revert local Panchayath's decision.But however it is inhuman and arrogant on local Panchayath in dealing with our JAWAN.An in depth investigation need to be done by CEO of ZP or by DC.
