Apex Court Stays Kasab's Death Sentence


New Delhi, Oct 10 (IANS): The Supreme Court Monday stayed the death sentence awarded to Ajmal Amir Kasab, the lone gunman captured alive during the Nov 26-29, 2008 Mumbai terror attack.

An apex court bench of Justice Aftab Alam and Justice C.K. Prasad stayed the death sentence till it hears his petition challenging his conviction and death sentence.

At the outset of the hearing, Justice Alam said that "we have to afford him full opportunity" to defend himself as provided in the judicial system.

"That is the price we have to pay to uphold the supremacy of law," the court said.

Senior counsel Raju Ramachandran, who has been appointed amicus curiae (friend of the court) to defend Kasab, said: "People may believe it otherwise, but the due process of law demands that the accused should be given full opportunity to defend his case in the highest court."

Kasab was one of 10 Pakistanis who illegally sailed into India from Pakistan and launched the Nov 26-29 mayhem killing 166 people, including many foreigners.

He was awarded death sentence by a Mumbai trial court May 6, 2010. Besides other charges, he was convicted for waging war against the nation. The Bombay High Court upheld the verdict.

    I think the courts should use their time to complete the pending cases and give justice to the deserving instead of wasting time and resources on useless cases. today one of the reason why there is rampant crime in india because we are poor in time. justice to be swift to be effective.     Caught on camera and how could court stay of his death penalty!!He is unfit to live in the civilized world.Need to hang him with out time waste if need arises to amend the legal system those who are waging war against our country be it anti-nationals or be it hostile nations individual..

    How many more years you will give him to prove not guilty? 60 years more? when we know very well that this Pakistani terrorist have waged war again us on our soil.

    Shame on Congress they have not hanged a single terrorist responsible for killing thousands of Indians. The congress is protecting the terrorist for minority votes. We should not be surprised if kasab gets a Congress ticket.

    Mr Shawnaz , I salut and apreciate your courageous statement, if every people thinks like you , means country is greater than religion ,India will be on top of the world.Terrorist no matter which religion should be punished and should not get sympathy.Its not hidden anymore terrorist no matter Indian or Pakisthani have sympathisers in India!!Only people like you can change them

    The provision of giving opportunity to defend oneself in our judicial system applies only to the bonafide citizens of our country and not to the citizens of our hostile country who is bent upon disturbing the peace in our country... Please go ahead and ute him as its proved beyond doubt that he is a Paki and waged war against our nation....This is misinterpretation of our constitution and our legal system.. Today I am ashamed...
