Don't Give me Death, I was Brainwashed Like a Robot: Kasab


NEW DELHI, Oct 10 (PTI): Pakistani terrorist Ajmal Kasab facing death penalty for the 2008 Mumbai terror attack claimed in the Supreme Court he was brainwashed like a "robot" into committing the heinous crime in the name of "God" and that he does not deserve capital punishment owing to his young age.

Though at the outset claiming innocence, Kasab posed a rider that even assuming he was guilty, death penalty cannot be awarded to him as he was brainwashed into committing the crime and was not beyond reform owing to his young age.

In his special leave petition challenging the death penalty, Kasab through counsel Gaurav Agrawal claimed that he was innocent and his so-called confessional statement had no evidentiary value as there was no corroboration.

The 24-year-old lone surviving gunman from the Mumbai carnage that left 166 persons dead submitted that he had retracted the disclosure statements, but the same was relied upon by the trial court and the high court for handing down the death penalty.

"The High Court ought to have held that even if the petitioner was guilty for the offences alleged this wasn't a fit case for imposing death sentence on the petitioner inter-alia for the reason that the petitioner's mind was completely brainwashed by the other co-accused.

"He was acting like a robot having been made to believe that he was acting in the name of God when he was allegedly told to commit the aforesaid offences," the appeal said.

The petition claimed that the high court which confirmed the death penalty did not consider the fact that at the time of the crime Kasab was only 21 years which should have been considered as a mitigating factor for not awarding him death penalty.

"For that the high court ought to have held that the petitioner was barely 21 years of age and being of impressionable mind has failed to see the difference between right and wrong, he therefore, did not deserve the death penalty.

"It is respectfully submitted that even apart from the petitioner's age, the prosecution's own case revealed that the petitioner was from an economically deprived section of society, that he left school at a young age and also ran way from home following a fight with his father.

"His mental ang moral faculties are not fully developed at such a young age and hence it cannot be asserted that the possibility for reformation is non-existent and that the alternative to the death penalty is foreclosed," the petition said.

According to the petition, the confessional statement was not corroborated by any evidence and Kasab was also not conversant with the Indian laws vis-a-vis statements made before the police and the judicial magistrate.

Further, the counsel said that there was no evidence to prove that Kasab had joined a conspiracy to wage war against India.

    In my opinion Kasab should not be executed and remain in his special high security jail cell life long.This is the highest punishment for a high rated criminal.By doing so he will be the permanent head ache and matter of embarasement/irritation for Pakistan.If he is uted there ends the unconfotability for Pak.This should not be.
    Anyhow we have already invested a huge amount on his jail cell and if he is eliminated cell will get vacant and keepting it d is another problem. However he should be feeded with ordinary lunch like now beeing feeded to Janardhan Reddy,Srinivas Reddy,Katta,his son etc.,
    Keeping Kasab alive is a permanent monument of Pakistan's misadventure.World should always see this.Religion factor has no place here.

Because when he prepared to do the crime, he knows he will be killed some how, but unfortunately he had saved by his luck because of his parents prayers n also by the Savior to realize his heinous crime before he fade away from this beautiful life n the World. The way he did blind crime, towards to innocent young people. If he is innocent, before he commit that crime in India, why din't he tried to do the same thing to his family, like how own brothers n sisters and his country people.

    Really, so bad to hear the statement, since long time keeping him in jail n waste of time n also money, because the amount our Government is wasting on him, that money would have used for the good purpose n on poor people's needs, as if there is no Electricity n at-least one Good Road in Mangalore. They would have used money for the betterment of Indian people.

    Because he did the crime which is shows openly and still our Justice is trying to be mercy on him. He do not have rights to live in this world, If there is let Almighty mercy upon him and be saved. But judgement wise not to spare him in any point of Mercy.

    We must agree that our police and what ever deffence we had in Mumbai to counter the terrorist was very weak in terms of sophisticated weapons.IPS officers like Karkare were not provided with such d weapons or not prepared to handle such situations.
    Now we have this bali ka bakra who is young and does not carry a passport and the police claim that he is from Pakistan which he might have never agreed.The case will linger in HC and SC and then go to the president mercy petition.As long as he is alive he will cost a lot for tax payers money and at the same time opposition has a subject to accuse the governments every now and then at every public gatherings.

    This is good news that his death sentence is stayed. The man who is a part of the group responsible for the death of 166 people and responsible for the death of police officers Hemanth Karkare, Vijay Salaskar, Ashok Kamte, Tukaram Omble should suffer all his life. If he is hanged, that's it all over. Keep him alive and torture him he will die a death everyday. He claims he is innocent what about the 166 innocent civilians???
