Patanjali case: SC expresses displeasure over misleading advertisements continuing after product lic


New Delhi, May 7 (IANS): The Supreme Court on Tuesday took a stern stance while hearing the contempt case against Patanjali, stressing the need for immediate action to address misleading advertisements continuing despite the suspension of product licences.

A bench of Justices Hima Kohli and Ahsanuddin Amanullah expressed dissatisfaction over the persistence of Patanjali's misleading advertisements on various platforms, including the internet and television channels, as it pointed out Uttarakhand's earlier actions, including the suspension of manufacturing licences for 14 products and the filing of a criminal complaint against Patanjali, its Managing Director Acharya Balkrishna, and co-founder Baba Ramdev under relevant legislation.

Despite these measures, the court questioned senior advocate Balbir Singh, representing Patanjali, about the continued presence of misleading ads, particularly on social media platforms.

He assured the bench that Patanjali was aware of the issue and committed to addressing it comprehensively by the next hearing.

However, the court expressed concern over Patanjali's collaboration with certain media channels, which continue to air these advertisements.

Justice Amanullah reiterated the significance of the suspended licences, saying that products under suspension cannot be sold or dealt with in any manner.

The court criticised the State Licensing Authority for not taking proactive measures to ensure compliance with the suspension orders, stressing that the onus is on them to enforce the suspension effectively.

Justice Kohli said that it is not the court's role to instruct the Licensing Authority on their duties and called for proactive measures without the court's intervention. The court dismissed Singh's request for the exemption of Patanjali's Managing Director and co-founder from personal appearance, stating that such requests must be formally submitted through the appropriate channels.

    SC would not have taken the route of warning, another warning, bigger warning , louder warning, stern warning, if the case not involved with someone not close to BJP top leadership. This is one fundamental aspect of constitution, where one can see the values are getting erode, with executive influence, to apply uniformly rule of the law.

    IMA is silent on various ads which are dangerous to health like Vimal. Also ads on gaming etc where many are loosing huge money and end up in loans and family are getting effected. Big celebrities like film actors, sports person are featuring on ads and they do not have any social responsibilities. They are only interested in making money. Court should come heavily on them.

    Pathanjali may be culprit but , why IMA target Pathanjali only for mis-leading advertisement, because they create lots of health awareness thro yoga & suggest alternate food habits and caution people against excess use of allopathic medicines. No doubt this heath awareness campaigns by Baba Ramdev giving good results for people. There are several mis-leading ads by various other companies endorsed by celebrities, claim to provide "health benefits" etc etc but are nothing but chemicals which is the cause for various diseases in long run. If IMA is so concerned about peoples health then they must do a research & take suo moto action and create a awareness.

    In india Ayurvedic (herbal), organic, halal are scam. There are so many fruit drinks claims no preservatives dangerous for consumption. Biscuits, cookies shampoos sold in supermarket chains contains detergents Moreover not suitable human or animal consumption. Certifying authority dipped heavy corruption. FSSAI and ISO certificates sold for 30000rs depends on the quantity.
