Bangalore: Illegal Mining Report - Govt Action Frivolous, says Santosh Hegde

Bangalore, Oct 14 (PTI): Former Karnataka Lokayukta Justice Santosh Hegde today dismissed as ''extraordinary and absolutely frivolous'' the grounds on which the BJP government decided to seek reconsideration of his report on illegal mining as the head of the anti-corruption watchdog.

Speaking to reporters here, Hegde, a former Supreme Court judge, saw the Government move as one aimed at "delaying" (the implementation).

"The reasons given by the government are rather extraordinary", he said, adding they are "absolutely frivolous" and appeared to be "layman's excuses".

The state cabinet had yesterday decided to seek the views of the (yet-to-be-named) Lokayukta whether the July 27 report submitted by Hegde as the then Lokayukta is in compliance with law, particulary with reference to principles of natural justice.

The BJP government's contention is that the then Chief Minister B S Yeddyurappa and the then Ministers and mining magnates from Bellary -- G Janardhan Reddy, G Karunakara Reddy and B Sriramulu, who have been indicted in Hegde's findings, were not heard before the report was prepared.

Yeddyurappa resigned in the wake of his indictment.

Hegde asked why the government did not reject his report if it indeed violated constitutional provisions and principles of natural justice.

The reasons cited by the government gave an impression that he does not know law, applied law unfairly and he had malice towards the government. "If they reject, (public) reaction will be different. That's why they are delaying".

Asserting that he acted within the jurisdiction of the Lokayukta, Hegde said the anti-graft body had the power to recommend removal of public representatives, including Ministers and the Chief Minister.

The terms of reference set by the government for the probe had mandated fixing responsibility vis-a-vis illegal mining and investigate misdeeds by public servants, including ministers.

He also argued that being a preliminary report, there was no need, as per norms, for hearing the then Chief Minister, Ministers and officials who had been indicted.

Hegde said he had only recommended follow-up action (on the report) to the competent authority (the Governor) and he has never given a direction to do so.

He said a lot of hard-work and conviction have gone into preparation of the report and the government was now treating it as a "bunch of useless papers".

To a question, he agreed the Lokayukta post being vacant was an "advantage to the government". "Why they are not appointing, I don't know".

Hegde's successor Justice Shivraj Patil resigned last month after a controversy had erupted over plots owned by him and his wife in the city allegedly in violation of rules.

Hegde slammed the government for constituting a committee, chaired by an Additional Chief Secretary, with officials of Forest and Mines as members, to study his report and suggest action, saying "it's like after judgement is given by the Judge, it's referred to the accused to see whether it's good or bad."

    Dear Hegdeji, you are not the only one gem in entire judicial system in India. We appreciate your report against all BJP Leaders. But what about other Parties Leaders involvement? We all know that Mining business was not started in BJP Government in Karnataka. It is an ongoing business for several decades now. Moreover you have been instructed to report since from Year: 2000 to 2009 instead you prepared the report from Year: 2006 to 2010 that also without conducting any hearing with concerned person and several contents of your report have been copied from the earlier report issued on same subject by somebody else too
    Like any judicial, administration and functional systems in India, you did your job but you have no moral responsibility to make any comments for actions taken by the Government

    Dear C K DAYANANDA, MANGALURU. Many of your comments I disagree but here I agree with your this comment - " Britishers were far better than these people as they were atleast respecting Gandhi and other freedom fighters." not because of any prejudice mentality but I had worked under them for more than 15 years in the Middle East.
    In their management, if they sack due to whatsoever reasons are, after that termination issue, they will treat that person with dignity and never harm them. They will do whatever support required to obtain another job. This quality is lacking very much with Indian sub continent people. We are very good in blame game.

    Only thing I do not like about British system which we follow in Indian civil administration is their way of functioning is time consuming. I feel Santosh Hegde's report is no exception to this system.

    All those who stood for values and fight for justice, will definitely will face resistance and Honourable Ex Chief Justice Mr. Santosh Hegde is no exception to this, as he stood for values & justice.

    I am sure Justice Santhosh Hedge is right but I am not clear about the difference in recommendation and decision as claimed by state government, Mr.Gowda is a puppet CM of Eddy like MMS at UPA, so how he can work against Eddy.This government is trying to dump this report in dust bin by using delay tactics or unnecessary queries like Congress government did in past to save Dharam and SM Krishna.If there is a constructive opposition party in state then Justice Hedge need not respond.Congress also want to close this issue in the earliest to be safer for next election....if this issue does not close in the earliest Dharam, Krishna, Muniyappa will be in trouble like Eddy..... All chors...no option for Karnataka
    voters....

    Nothing will happen to these BJP leaders. They have full support of Madam Sushma Swaraj and Mr. Arun Jaitley. How can they not support them when they have gulped millions of rupees from the share of these mining robbers and land grabbers.

    I wish law prevails over all and put Mr. Yeddy behind bars. He is next in line.

    Everybody in public limelight has agenda, whether it is congress, BJP, BSP, AIADMK, DMK, RSS, SRS, almost all NGO's and Anna Hazare team.

    Anna Hazare and his cohorts will never accuse any politician in any BJP ruled states -whether it is Uttarakhand, Jarkhand, Karnataka, Gujarat, MP etc. As per Anna Hazare's team only Congress is anti-corrupt and BJP politicians are all saints everywhere.

    That is why being politican and looting India's public wealth and resources, is the best professsion in India to get rich.

    YES they should have been heard deny that- they have not looted anything- only they are doing their duty to serve the people by amassing wealth for their future generations at the expense of 6 crore people-the purprose for which they were waiting all these long years.
    Now Yeddy is facing music everyday in courts, Reddys are cooling their heals in Jail for doing their work!
    This is how people(BJP)always fight corruption!
    Now Bheeshma of BJP is on "Desh Yathra" instead of "Vanaprastha" to protect the corrupt whose money is used for "Rath-Viman Yathra".
    Modi might have arrested Santhosh for finding fault with him. Thank God Karnataka Govt.- don't have that Absolute Fascist Power YET!?

    I have now lost respect towards Sadananda Gowda completely. You are just like Yeddi and Reddy by trying to protect them. I hope you are not involved with them. To say that a retired Chief Justice of Supreme court did not know the law it is laughable. If Advani is really interested dealing with corruption he should deal with this first. Where is Anna Hazare and his party now? Why Anna is not opening his mouth? Has he also received a gold sword from Reddy's?

    The report was not done by not duplicate Commission of state constituting time to time to fool the citizens .It was LOKAYUKTA report and has constitutional stamp up on it.Besides the scope work of Lokayukta are clearly stipulated.Under the prevention of corruption act,all public servents CM/ministers/MLA/MP/Councilors and even Panchayath members are coming under the purview of the act

    When BJP trapped by it's follies which was in Lokayukta report, under pressure from KAANADA KAI, EDDY/BJP/Sanghparivar, cabinet trying to goggle weakness in the report which may backfire on the law point of view as well as people point of view.BJP, certainly venturing dangerous precedent which may undermine the very foundation of the Democracy.SHAME SHAME...
