Mangaluru: Court acquits all accused in 2012 homestay raid case citing lack of evidence

Mangaluru, Aug 6: In a significant judgment, the Sixth Additional District and Sessions Court of Mangaluru has acquitted all the accused in the homestay illegal raid case of 2012.

Judge Kantharaju delivered the verdict on Tuesday, August 6, stating that the accused were found not guilty due to insufficient evidence.

Among the total 44 accused, three had passed away during the proceedings, and journalist Naveen Soorinje had been discharged from the case earlier.

The court has now cleared the remaining 40 accused of all charges. The defense team, consisting of lawyers Shambhu Sharma and Kishore Kumar, presented their arguments in favour of the accused.

Background

On July 28, 2012, activists from the Hindu Jagarana Vedike, affiliated with the Sangh Parivar, allegedly attacked a birthday party at an unlicensed homestay in Mangaluru.

The 12 individuals at the party, including five girls, were reportedly beaten, stripped, and molested. Some of the girls had their faces blackened. The activists claimed the youngsters were consuming alcohol and engaging in "indecent activities."

In response, hundreds of locals, including women, staged protests, complaining that the police had failed to address "illegal activities" at the homestay despite receiving multiple complaints.

It was alleged that Hindu Jagarana Vedike President Jagadish Karanth demanded a crackdown on such "obscene activities."

Parts of the attack were captured on camera by a reporter at the scene and were broadcast on various news channels.

    And then people wonder why no MNCs setup office in Mangalore... Right wing extremism (all religions included) always has a free hand here. Sadly young graduates have to migrate to other parts of the country to find jobs.

    As students from wealthy and well-connected families, the girls never fought back out of fear of not getting married; they never appeared in court. However, the case took 12 years, during which the accused suffered psychological distress and punishment. In the end, all of the girls have found happy endings.

    The same justice of a clean chit was given in the pub attack case, with the judgment citing insufficient evidence, despite news channels broadcasting the attack and nationwide outrage. A few years later, the court exonerated Pramod Muthalik and the goons who mercilessly attacked those boys and girls. The Congress government was in power at the time; if they had wanted, they could have approached the high court to challenge this verdict, but they didn't. Today, even with ample evidence, such as live footage showing a girl being slapped and a photo of a man holding a girl inappropriately, the judicial system still grants clean chits due to "insufficient evidence," which is a mockery of democracy. The government should at least consider approaching the high court to challenge this verdict. They blame the BJP government, but the late Defence Minister Manohar Parrikar banned Muthalik from entering Goa, despite the BJP being in power there. Parrikar challenged Siddaramaiah, saying if the Congress government had guts, they should ban Muthalik as he did, but the Congress had no guts. During the homestay attack, it was the BJP government, and still, the hooligans were in jail for a year without bail. These same hooligans cursed the BJP government and, until the 2024 MP election, when they didn't get a ticket for MP, they slammed the BJP and brought up the homestay attack.

    I hope the judge is given a governor position in the future. Goondas who blatantly went assaulted men and sexually touched the body of women. And today these goondas are roaming the city to "protect" the same girls. This is not on them. This is on from the big politicians down to the ingrained hate filled voter

    Justice is joke in India. This means anyone can enter anywhere and do anything to anyone. No one is gonna question them bcoz of lack of evidence, even though the video footage was watched by people in twin districts. Yup, no one attacked them.

    In the end, this is what happens: insufficient evidence. Because of such judgments, attackers, rapists, and murderers get away. This is the decision of our country’s courts. No one fears the law; even if they go to jail for a few years, in the end, the case is closed due to insufficient evidence. But there is one court above all, and no one can escape from it.

    If no sufficient evidence then why these fringe anti social elements were in the premises, is it to enjoy the party??????…..One of accused had stolen jacket and watch from the party goers and many girls and boys were admitted to the hospital on assault on them. Is this not sufficient evidence???????……As usual clean chit with garlands to guilty and gallows to the innocent. This is BJP’s justice.

    Do you remember?? In Gujarat, there was a case where five people convicted of gang rape and murder during the 2002 Gujarat riots were released and garlanded by supporters of BJP. This incident caused significant outrage and raised concerns about the justice system and political influence.

    Everything has a price these days. Imagine an entire video being there of goondas beating up people and the judge can't find evidence. I am surprised victims haven't been put in prison by the same authorities.. What a shame..!! Black day.
