All 122 2G Licences Granted During Raja's Tenure Cancelled


New Delhi, Feb 2 (IANS): The Supreme Court Thursday cancelled all 122 licences granted to telecom firms during the tenure of former communications minister A. Raja and left it to the trial court to judge if Home Minister P. Chidambaram needed to be tried.

The apex court bench of Justice G.S. Singhvi and Justice A.K. Ganguly said but for the initiative of enlightened citizens looking for clean governance, unsuspecting citizens would not have known the misuse and arbitrary manner in which second-generation (2G) telecom licences were granted.

The court said the companies whose licences stand to be cancelled will continue to offer their services for four months during which time the telecom regulator will look into the matter and make recommendations for the fresh auction.

The court, taking note of the arbitrary manner in which licences were granted, slapped a cost of Rs.5 crore each on Unitech, Swan Telecom and Tata Teleservices and said half of that will go to the court's legal aid services and the remaining to defence services.

Varying costs have been imposed on other companies also.

The verdict came on a plea by Janta Party president Subramanian Swamy's plea seeking an investigation into the alleged role of Chidambaram, who was finance minister when these 122 licences were issued to these companies.

Lawyer Prashant Bhushan had also filed a petition seeking cancellation of licences.

The two-member bench said the trial court of the Central Bureau of Investigation (CBI) can determine if Chidambaram needed to be investigated, but declined another plea to form a special investigative team for that.

    I have a big question here.

    When Karnataka chief minister n cabinet ministers were doing a scam of worth Rs 1.76 Laks crores, what was BJP Party president n Pakistan led Advani was doing?

    There are two possibilities here.

    1. Advani knew and supported the chief Minister n cabinet ministers for this mine scam. In this case Advani should be in jail.

    2. Nitin Gadkari  is dumb and he has no control over his party ministers. In this case he is unfit to be in the post and should resign immediately.
    Corruption is in BJP blood itself.

Public Accounts Committee Chairman and Senior BJP Leader Mr. Murli Manohar Joshi had opposed auctioning of 2G spectrum in 2007, saying it would lead to cartelisation and hit PSUs like, BSNL and MTNL. He then wrote a ltter to Prime Minister Manmohan Singh on December 12, 2007, opposing auctioning of 2G spectrum for the same reason. But in 2011 Mr. Joshi and his party members were accusing home minister P Chidambaram, who was then(2007) finance minister, for having caused immense loss to the exchequer by failing to push for auction of 2G spectrum. Is it not double standard of BJP?

    2G scam happened in January 2008. It came to light by the end of 2010.

    In the year 2010, 3G came to Indian telecom market. By now a 4 Lakh crores Rs scam would have already happened by the ministers of UPA. This will come to light by the end of this year..

    Karnataka's yearly state budget value is nearly 1 Lakh crores. With 1.76 lakh crores we can have two budgets.

    With another 44,000 (courtessy - Kalmadi) crores we can have 200 KM metro rail for two cities.

    It is good that now at least “FIRST COME FIRST SERVED” policy in allocating telecom spectrum will go. It was NDA Govt who started the allotment on the basis of “FIRST COME FIRST SERVED’. BJP minister, Late Mr. Pramod Mahajan, is the originator of all telecom scams. Then came Arun Shouri and he and subsequent telecom ministers including Maran( who was in NDA earlier) continued same policy. No one bothered to calculate/estimate the losses to the exchequer till 2008 allotments or send the culprits to jail like Raja.
    When it comes to corruption, all political parties are sailing in the same boat. We cannot be ive when talking about corruption. The UPA government might be mired in corruption but what about BJP governments’ record in Karnatak, Uttarakhand, Madhya Pradesh and even Gujarat (no Lokayukta since 11 years! ). The Got will now auction the spectrums to the highest bidder but the public may have to pay more for telecom service.

HEnce at that particular time, FCFS model was followed. Any subsequent policy should consider the prevailing situation and act accordingly. If following the auction method in 2008, govt. would have earned more revenue, then why follow the 2003 policy which would fetch lower revenue in 2008. To change the policy means A Raja/DMK could not favor their cronies. If DMK could not favor their cronies means it would have withdrawn the support to UPA Govt. then UPA govt. would have fallen. you got it?

    Mr Diwakar has a point here which many of us will agree to. The idea of spectrum sale was not about income for the government but to put communication within the reach of every citizen. That was the aim and the decision of the government. Income and Profit was not even thought of. Raja erred and allocated the licences to his cronies for money and for this he has to pay the price. But this cannot be described as a loss to the government. Now when the prices of telephone calls go up our same wise commentators here writing stupid comments will start crying and blaming the government for the increase in call costs.

    As per Supreme Court verdict, new allocation of licences will be on the basis of 'First Come First Serve' basis which is disturbing. Had it been issued to the highest bidder, we would have got more funds and also would have come to know the extent of the loss caused by UPA to the exchequer.

    Big slap on all those used to support congress corruption in this forum. Corruption is curse for India. Oppose corruption irrespective of party line. Especially there was a big bunch of so called intelectuals in this forum who used to ignore congress corruption and highlight only BJP corruption in this daiji forum. Many people just used to laugh at Nagesh Naik's comments. Nagesh also proved correct in his observations to a large extent. Entire Union government is proved to be at fault. They Must resign.

    Best judgement from Supreme court. This is the only way corruption can be abolished. If Chidambaram is involved he should be tried n punished.     Now Tamasha starts.. what will happen to the 5 paise call rates.. Finally poor man is hit by cancellation who has option to use mobile at very low cost.. Middle class and upper class will enjoy the tamasha who can offord to pay more.. It appears that what ever may be burdon on public upper class dont want premium facilities to be used by poors.. If license fee is more.. all the operators will charge more... By sucking the blood let treasury be filled..

But today with the blessing of UPA Government due to “Marriage of convenience” wanted to rule India again with collaborating with tainted rural Political Party like DMK etc and now entire Nation pay high price for their corruptions of all time high and utter shame in International level too. At last truth is prevailing at the end all 122 2G licenses are cancelled by SC. Dear Friends, whether you are a supporter of UPA or BJP , finally common public like you and me will suffer. What next??? 2G service in our Indian Mobile will discontinue with immediate effect!!!!!!!! Again few Public or Private Companies funded by Nationalized or Sahakari Banks will go bankrupts. Who suffers now???? Common Public like you and me friends!!!!!!!
