UAE court orders Dh60,000 compensation in phone harassment case

Dubai, May 9: Aman has been directed to pay a total compensation of Dh60,000 after a court found him guilty of repeatedly harassing another man through persistent phone calls that caused significant emotional distress and mental suffering.

The court further ordered him to pay an additional Dh9,000 to the victim, following an earlier criminal court decision that had already granted Dh51,000 as temporary compensation in the same matter.

According to court records, the victim had filed a civil suit seeking Dh100,000 in damages, alleging that the defendant intentionally subjected him to continuous harassment over a period of time through repeated calls, resulting in psychological harm.

The case had earlier gone through criminal proceedings, where the accused was convicted for intentionally causing nuisance and disturbance through repeated phone contact.

During the civil proceedings, the defendant argued that the claim should be dismissed, stating that the legal requirements for civil liability had not been fully met and that compensation had already been awarded in the criminal case.

However, the court ruled that findings in criminal judgments hold evidentiary value in related civil cases, particularly regarding the occurrence of the offence, its legal classification, and the responsibility of the accused.

The court noted that the earlier criminal ruling clearly established that the defendant had intentionally caused distress to the plaintiff through repeated and unwanted communication.

Based on the evidence and prior judgment, the court concluded that the victim had suffered moral and emotional harm and assessed fair compensation at Dh60,000.

Since Dh51,000 had already been awarded earlier, the court ordered the defendant to pay the remaining Dh9,000, along with applicable court fees and legal costs.
