Bangalore: Court Cancels Karnataka Deputy Ombudsman's Appointment

Bangalore, Apr 3 (IANS): In a major embarrassment for the Karnataka government, the state high court Tuesday quashed the appointment of former high court judge Chandrashekaraiah as the state's Upa Lokayukta or deputy ombudsman.

Justices N. Kumar and H.S. Kempanna set aside the appointment on the ground that chief justice of the high court was not consulted, a constitutional requirement in appointing the Lokayukta and Upa Lokayukta.

Chandrashekaraiah, who was Karnataka High Court judge between 1995 and 2004, took over as the second Upa Lokayukta in January, the first major appointment by Chief Minister D.V. Sadananda Gowda.

His appointment was challenged by two Bangalore advocates, M. Anand and J.C. Krishna, who contended that the appointment was invalid as it had been made without consulting the chief justice of Karnataka High Court.

Chandrashekaraiah is involved in a row over owning a site from a housing society formed by high court employees.

Karnataka has one more Upa Lokayukta in S.B. Majage, also a former state high court judge.

However, the post of Lokayukta has been lying vacant since Sep 15 last year when former Supreme Court judge Shivaraj V. Patil quit following a row over owning two house sites from two housing societies in Bangalore in violation of rules.

    No need to worry, appointed by CM rejected by HC, again will be appointed by HC to be rejected by Governor. After all everybody wants this only. Even Lokayukta report will not be carried out fully since we have classic example of Yeddy & Reddy Cases. Hegde issued the report with 59 culprits but only Yeddy & Reddy gone to jail so what about others? In this situation do we need Lokayukta & for what? Person like “Anna” will keep on shouting at “Jantar Mantar” in Delhi till his death. For at least next 60 days no body will bother since IPL5 seasons starts today and then rainy seasons will starts so nobody will join the “Morcha”

    It is simple....Karnatka Government is smart and good in fooling its people. The more its drage the feet and time passes it is good for Government and can avoid Lokaukthas raids on cabinet ministers, MLAs and finally beuraucrates.....JAI HO....

    Therefore, present State Govt of BJP has neither experience in ruling nor serious in it's constitutional obligations..

    DVS should go now. He has failed deliberately in all aspects. He is trying to please RSS. Law n order situation is worst. All his appointments have been cancelled by High court n CAG. Shanker Bideri before, now Chandrashekar. He failed to expand ministry. Rave Party, porn gate. All scandals no any developmental work. Now he is tryig to introduce cow slaughter bill To please RSS n loosing support of minority even. I hope he will resign n make way for Jagdish Shetter. Only Lingayats can handle BJP.
